HomeMy WebLinkAbout1991-1892 - Ordinance - 04/25/1991ORDINANCE NO. 1892 AN ORDINANCE VACATING AND ABANDONING A PORTION OF A DRAINAGE EASEMENT WHICH CROSSES AND LIES WITHIN LOT 2 AND LOT 3, BLOCK WOODCREEK SECTION TWO IN THE CITY OF COLLEGE STATION, TEXAS. 11, WHEREAS, the City of College Station, has received an Application for the Abandonment of a Portion of a Drainage Easement which crosses and lies within Lot 2 and Lot 3, Block 11, Woodcreek Sec- tion Two in the City of College Station, more particularly de- scribed on Exhibit "A" attached hereto; and WHEREAS, the property owners, Kerry and Maryvonne L. Cooper, have agreed to grant the City of College Station a twenty foot (20') wide easement, more particularly described on Exhibit "B" at- tached hereto, for the maintenance of the drainage channel in exchange for the abandonment of the forty foot (40') wide easement; and WHEREAS, on April 25, 1991, the City Council of the City of College Station, Texas, heard the application of Kerry and Maryvonne L. Cooper for the vacation and abandonment of the drainage easement which crosses and lies within Lot 2 and Lot 3, Block 11, Woodcreek Section Two, recorded in Volume 750, Page 347 of the Deed Records of Brazos County, Texas; NOW, THEREFORE, be it ordained by the City Council of the City of College Station, Texas, that a forty foot (40') wide strip of land previously platted as a drainage easement which crosses and lies within Lot 2 and Lot 3, Block 11, Woodcreek Section Two in the City of College Station, be abandoned and vacated; that the Mayor and City Secretary be authorized to convey by quit claim deed on behalf of the City of College Station any right or claim which the City has in and to said forty foot (40') wide strip of land to Kerry and Maryvonne L. Cooper; and that Kerry and Maryvonne L. Cooper execute a twenty foot (20') wide easement to the City of College Station for the maintenance of the drainage channel.
