AN ORDINANCE AMENDING CHAPTER 4, SECTION 17 OF THE CODE OF ORDI-
NANCES OF THE CITY OF COLLEGE STATION, TEXAS, REGULATING SEXUALLY
ORIENTED COMMERCIAL ACTIVITIES WITHIN THE CITY OF COLLEGE STATION
SPECIFICALLY AMENDING THE DEFINITION OF SAID ACTIVITIES, CLARIFYING DIS-
TANCE MEASUREMENTS, AND REGULATING SIGNAGE.
WHEREAS, "Aduff' businesses and sexually oriented enterprises have not served to
enhance the community's cultural, moral or commercial well-being, but instead create
criminal activity and expose minors to pornographic material; and
WHEREAS, the City Council of the City of College Station has determined that additional
restrictions placed upon "Adult" businesses and sexually oriented commercia~ enter-
prises would serve to contribute to the public health, safety and welfare; and
WHEREAS, the City Council of the City of College Station has held a public hearing to
determine the necessity of this ordinance amendment;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS:
That Chapter 4, Section 17A(9), of the Code of Ordinances of the City of College
Station, Texas is hereby amended to read as follows:
"(9)
Enterprise - Means a 'sexually oriented business' which includes a sex
parlor, nude studio, modeling studio, love parlor, adult bookstore, adult
movie theater, adult video arcade, adult movie arcade, adult video store,
adult motel, or other commercial enterprise the primary business of which
is the offering of a service or the selling, renting, or .e. xhibiting of devices or
any other items intended to provide sexual stimulation or sexual gratifica-
tion to the customer."

That Chapter 4, Section 17B, of the Code of Ordinances of the City of College Station,
Texas is hereby amended by adding a paragraph (3) to read as follows:
"(3)
Any bookstore, movie theater, or video store, unless that business is an
adult bookstore, adult movie theater, or adult video store under Section
17A(9)."
III.
That Chapter 4, Section 17C(3), of the Code of Ordinances of the City of College
Station, Texas is hereby amended to read as follows:
"(3)
No permit shall be issued for an enterprise located within a one thousand
foot radius of any church, school, or licensed day care center."

IV.
That Chapter 4, Section 17C, of the Code of Ordinances of the City of College Station,
Texas is hereby amended by amending paragraph (5) and by adding a new paragraph
(6) to read as follows:
...or because it contains one or more coin-operated machines that are
subject to regulation or taxation, or both under State law.
(6) It shall be unlawful for the owner or operator of any enterprise as herein
defined and regulated, or any other person to erect, construct or maintain
any sign for the enterprise other than one attached sign as defined by the
City of College Station Zoning Ordinance No. 1638 Section 12. SIGN
REGULATIONS.
In addition, this one attached sign shall not contain any flashing lights or
moving parts, shall be rectangular in shape and shall not exceed fifty (50)
square feet in area. It shall contain no photographs, silhouettes, drawings
or pictorial representations of any manner, and shall not advertise either
graphically or verbally, either by explicit or literal expression, connotation
or implied reference, any specified sexual activities or specified anatomical
areas.
The s~gn may contain only the name of the enterprise and/or one or more
of the following phrases: Adult bookstore, Adult movie theater, Adult
lounge, parlor or cabaret, Adult novelties, Adult entertainment, Adult
modeling studio, Adult video."

This ordinance shall become effective from and after its passage in accordance with the
City Charter of The City of College Station.
