AN ORDINANCE REZONING A 2 315 ACRE TRACT SITUATED IN THE THOMAS
CARUTHERS LEAGUE, ABSTRACT NO. 9, BRAZOS COUNTY, TEXAS, AND BEING
A PORTION OF THE CALLED 15.2 ACRES OF LAND CONVEYED BY F. A. KIKER TO
SMITH DAIRY, QUEENS BY DEED RECORDED IN VOLUME 330, PAGE 889, OF
THE DEED RECORDS OF BRAZOS COUNTY, TEXAS, FROM A~O AGRICULTURAL -
OPEN TO R-1 SINGLE FAMILY RESIDENTIAL
WHEREAS, on May 11, 1995, the City Council of the City of College Station convened
and pursuant to not,ces prescribed by law held a public hearing with regard to the
application for the rezoning of a 2.315 acre tract situated in the Thomas Caruthers
League, Abstract No 9, Brazos County, Texas,
WHEREAS, the above-described property is currently zoned A-O Agricultural Open
and the current use ,s undeveloped;
WHEREAS, the owner of the above-described property, Omar Smith Enterprises, Inc.,
purchased the property by deed recorded in Volume 330, Page 889, of the Deed
Records of Brazos County, Texas;
WHEREAS, the owner has applied for the rezoning of the above-described property,
Being all that certain tract or parcel of land, lying and being situated m the THOMAS
CARUTHERS LEAGUE, Abstract No 9 in College Station, Brazo$ County. Texas, and
being a portion of the celled 15.2 acres of land conveyed by F A. Kiker to Smith Dairy
Queens by deed recorded in Volume 330, Page 889, of the Deed Records of Brazos
County and being more part,culafly described by metes and bounds as follows'
BEGINNING' at the most westerly comer of the said 15.2 acre tract, said comer also
marking the intersechon of the northeast right-of-way line of Rock Prairie Road and the
southeast hne of a 60-foot wide pnvate accesswey commonly celled Hams Road;
THENCE N 39' 38' 00" E along the said Hams Road for a distance of 236 71 feet for
comer;.
THENCE S 73' 37' 22" E through the Intenor of the said 15 2 acre tract and along the
City of College Station City Limits hne for a distance of 454 31 feet for comer, said
comer also being in the northwest hne of the 4.24 acre Robert R Poling tract described
in Volume 1326, Page 264 of the Official Records of Brazce county, Texas,
THENCE- S 39' 38' 00" W along the smd Poling tract for a d~stance of 246.48 feel for
comer, said comer being in the beforementioned northeast line of Rock Praine Road,
THENCE N 72° 29' 00" W for a distance of 450.55 feet to the POINT OF BEGINNING
and centa~mng 2 315 acres of land, more or less.
WHEREAS, the C~ty Council of the C,ty of College Station, Texas, heard evidence that
the area in which the above-described tract is located is predominantly undeveloped;
WHEREAS, rezoning the subject tract of land would allow the Owner to utilize the land
for its best suited purposes by implementing stngle family residential housing,
WHEREAS, rezon~ng the subject tract of land would allow the owner to develop the
property in such a way that it fdls a need ~n the local real property market, and

WHEREAS, the subject rezon~ng is consistent with the City's Comprehensive Plan for
development;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the 2 315 acre tract mentioned above is hereby
rezoned from A-O Agricultural-Open and R-1 Single Family Residential, effectwe
immediately.
