AN ORDINANCE REZONING A 6.71 ACRE TRACT OF LAND SITUATED IN THE
THOMAS CARUTHERS LEAGUE, ABSTRACT NO 9, BRAZOS COUNTY, TEXAS, AND
BEING A PORTION OF THE 21 32 ACRES OUT OF TRACT NO. 5, SAID TRACT 5
BEING PART OF THE 88 52 ACRES CONVEYED BY THE FEDERAL DEPOSIT
INSURANCE CORPORATION (FDIC), IN TS CAPACITY AS LIQUIDATOR OF THE
FIRST BANK & TRUST, BRYAN, TEXAS, TO TAC REALTY, INC., SAID TRACT BE NG
MORE PARTICULARLY DESCRIBED IN VOLUME 1157, PAGE 194, OF THE DEED
RECORDS OF BRAZOS COUNTY, TEXAS, FROM R-1 SINGLE FAMILY RESIDENTIAL
TO PLANNED UNIT DEVELOPMENT P.U D -LAND USE INTENSITY RATIO NO TWO
WHEREAS, on April 13, 1995, the City Council of the City of College Station convened
and pursuant to notices prescribed by law held a pubhc hearing with regard to the
app ication for the rezoning of 6 71 acres of property situated in the Thomas Caruthers
League, Abstract No 9, Brazos County, Texas, and more particularly descr bed as
follows
Being all that certain tract or parcel of land lying and being situated ~n the Thomas
Caruthers League, A-9, in College Station, Brazos County, Texas, and being a portion of
the tract of land celled 21.32 acres out of Tract No 5, said Tract 5 being part of the 88 52
acres conveyed by the Federal Depos tnsurance Corporation (FDIC), ~n ~ts capacity as
Liquidator of the First Bank & Trust, Bryan, Texas, to TAC Realty, Inc, by Special
Warranty Deed, Volume 1157, Page 194, of the Official Records of Brazos County, Texas,
and being more particularly described by metes and bounds as follows.
BEGINNING. at the most easterly comer of Lot 9, Block Twenty-One (21), of Woodcreek,
Section Six South as recorded in Volume 2109, Page 199, of the Official Records, said iron
rod also being in the southwest line of a 50-foot wide private street called Stonebrldge
Drive,
THENCE- 463 33 feet In a southeasterly direchon along the arc of a counter-clockwise
curve, sa~d cuwe having a central angle of 46' 45' 10", a radius of 550 00 feet, a tangent of
237 74 feet and a long chord beanng S 60° 44' 28" E at a d~stance of 436.45 feet for the
po,nt of tangenCy,
THENCE: S 84' 07' 03" E conhnumg along sa~d Stonebndge Drive nght-of-way for a
distance of 138 88 feet for corner, said comer also being in the west nght-of-way line of
Stonebrook Drive (based on a 60-foot nght-of way width),
THENCE S 05' 52' 58" W along said west right-of-way line of Stonebrook Drive for a
distance of 278.19 feet for comer,
THENCE' N 84° 07' 02" W for a distance of 264 28 feet for comer,
THENCE along the south line of the beforementloned 88 52 acre tract for the following five
(5) calls
S 71° 42" 27" W for a distance of 230.83 feet for comer,
S 27° 06' 40" W for a distance of 134 65 feet for comer,
N 41 ° 44' 35" W for a distance of 282.83 feet for an angle point,
N 36° 55' 53" W for a distance of 149 62 feet for an angle point, and
N 31° 44' 16" W for a distance of 5 74 feet for comer,
said corner also being the most southerly corner of Lot 8, Block Twenty-one (21), of the
beforernentloned Woedcreek, Section S~x South,
THENCE N 45° 01' 24" E along said Woodcreek, Section Six South line f. ora d~sta.nce of
472.51 feet to the POINT OF BEGINNING and containing 6 71 acres of lan(], more or less

WHEREAS, the above-descnbed property ~s currently zoned R-1 Residential and the
current use ~s undeveloped;
WHEREAS, the owner of the above-described property, TAC Realty, Inc, purchased the
property on December 8, 1989, by deed recorded in Volume 1157, Page 194, of the
Official Records of Brazos County, Texas,
WHEREAS, the owner has applied for the rezomng of the above-described property to
Planned Unit Development-Land Use Intensity Ratio No. Two zoning,
WHEREAS, the C~ty Council of the C~ty of College Station, Texas, heard evidence that the
area in which the above-described tract ~s located ~s predominantly Planned Unit
Development zoning but very few lots are available for development in the area;
WHEREAS, rezomng the subject tract of land would continue the Planned Unit
Development character of the area outward to the C-3 Commercial property fronting Rock
Prairie Road;
WHEREAS, rezon~ng the subject tract of land would allow the owner to develop the
property in such a way that ,t fills a need in the local real property market; and
WHEREAS, the subject rezomng is consistent w~th the C~ty's Comprehensive Plan for
development,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the above-described property ~s hereby rezoned from
R-1 Residential to P.U D. Planned Unit Development-Land Use Intensity Raho No Two,
effective immediately
