City Council Workshop Meeting

1. Presentation, possible action, and discussion on items listed on the consent agenda.
Item No. 2c - Carmel Place Rehabilitation — Mayor Pro Tem Ruesink inquired about the
replacement of a 450 ft. section of failed pavement on Carmel Place. Mark Smith, Director of
Public Works explained the street consistently failed due to moisture in the soil over the past
fifteen years.
2. Presentation. possible action. and discussion of the current State of the Department - End of
Year statistics, a Citizen on Patrol program and a ioint discussion with Planning and
Development Services as it relates to a Neighborhood Ranger program.
Police Chief Jeff Capps updated Council on current "State of the Department," a review of the
2009 crime statistics, and a look at the trends observed in the first 3 months of 2010.
Bob Cowell, Director of Planning and Development Services presented an overview of
developing two new programs in the City. These programs were associated with
Neighborhood Policing. Council expressed support for the programs.
No formal action was taken.
3. Presentation, possible action, and discussion regarding City Council review of Council Meeting
Procedures.

Council directed staff to revise the Council meeting procedures to reflect a maximum three
minute time limit for speakers and to not allow the deferment of time to other speakers.
4. Presentation, possible action, and discussion regarding Citv Charter review.
City Secretary Connie Hooks presented an outline of topics Council may consider for a future
Charter review. These topics related to:
➢ Compensation for Elected Officials
➢ Election System
➢ Petition Provisions
➢ Other Sections of the Charter
City Attorney Harvey Cargill, Jr. briefly explained the legal issues related to the compensation
for elected officials.
Council member Crompton moved to appoint an advisory charter commission comprised of
former Mayors of College Station, hold two public hearings to receive public input, and make
recommendations to City Council any specific language or clauses that should be revised.
Council member Maloney seconded the motion. Council members emphasized the
importance of the City Council to discuss any charter issues and subsequently, hear the
citizens input.
Council briefly discussed the pros and cons to change the general election date from May to
November. No action was made.
Council member Crompton withdrew his motion and Council member Maloney withdrew his
second.
Council made a decision to designate a special workshop session in the near future to discuss
charter issues.
5. Presentation, possible action, and discussion regardina a Texas A &M Student Liaison to the
City CounciL
Removed from agenda to a future council meeting.
6. Council Calendar
Council discussed upcoming activities.
At 5:03 pm, Mayor White announced that the City Council would convene into executive
session pursuant to Sections 551.071 and 551.074 of the Open Meetings Act to seek the
advice of our city attorney and Personnel.
9. Executive Session will immediately follow the workshop meeting in the Administrative
Conference Room.

Consultation with Attorney IGov't Code Section 551.0711: possible action. The Citv
Council may seek advice from its attorney regarding a vending or contemplated litigation
subject or settlement offer or attorney- client privileged information. L"h ation is an
ongoing process and questions may arise as to a litigation tactic or settlement offer, which
needs to be discussed with the City Council. Upon occasion the City Council may need
information from its attorney as to the status of a pending or contemplated litigation
subject or settlement offer or attorney- client privileged information. After executive
session discussion, any final action or vote taken will be in public. The following
subiect(s) may be discussed:
Litigation
a. City of Bryan's application with TCEQ for water & sewer permits in Westside/Highway
60 area, near Brushy Water Supply Corporation to decertify City of College and certify
City of Bryan
b. City of Bryan suit filed against College Station, Legal issues and advise on Brazos
Valley
Solid Waste Management Agency contract, on proposed methane gas contract
c. Water CCN / 2002 / Annexation / Wellborn Water Supply Corporation
d. Weingarten Realty Investors v. College Station, Ron Silvia, David Ruesink, Lynn
McIlhaney, and Ben White
e. Chavers et al v. Tyrone Morrow, Michael lkner, City of Bryan, City of College Station,

Legal Advice
a. Discussion of Legal Issues Regarding: Wellborn Incorporation Request
b. Contemplated Litigation, Legal remedies available to abate weeds, rubbish, brush and
other unsanitary matter from a lot in the College Hills residential area.
Personnel (Gov't Code Section 551.0741: possible action
The City Council may deliberate the appointment, employment, evaluation,
reassignment, duties, discipline, or dismissal of a public officer. After executive session
discussion, any final action or vote taken will be in public. The following public
officer(s) may be discussed:
a. City Secretary
Action on executive session or any workshoE agenda item not completed or discussed in
today's workshov meeting may be discussed in tonight's Regular Meeting if necessary.
No formal action was taken.
Council returned from Executive Session at 6:30 pm to complete Workshop Agenda.
7. Presentation, possible action, and discussion on future agenda items: A Council Member may
inquire about a subiect for which notice has not been given. A statement of specific factual
information or the recitation of existing Policy may be given. Any deliberation shall be limited
to a proposal to Place the subiect on an agenda for a subsequent meeting.

Council member Stewart requested future agenda item on the establishment of a five member
citizen Economic Development Advisory Committee charged with the oversight of
development on Hwy 60 and Hwy 6. This committee would be assigned to Economic and
Community Development Director David Gwin. Council member Lyles seconded the
motion. Motion carried unanim ously, 7 -0.

8. Discussion, review and possible action regarding the following meetings: Arts Council of the
Brazos Valley, Audit Committee, Brazos County Health Dept., Brazos Valley Council of

Code Review Committee, Design Review Board, Historic Preservation Committee, Interfaith
Dialogue Association, Intergovernmental Committee, Joint Relief Funding Review Committee,
Landmark Commission, Library Committee, Metropolitan Planning Organization, National
League of Cities, Outside Agency Funding Review, Parks and Recreation Board, Planning and
Zoning Commission, Sister City Association, TAMU Student Senate, Research Valley
Partnership, Regional Transportation Committee for Council of Governments, Texas

Mayor Pro Tern Ruesink reported on recent activities of the Sister City Association.
Council member Stewart reported on TAMU Senate meeting.
Council member Lyles reported on the recent meeting of the Health Department Board and
supply of flu shots. She also reported on the recent hire of executive director of Arts
Council.
11. Adjourn.
Hearing no objections, Mayor White adjourned the workshop meeting at 6:45 p.m. on
Thursday, April 8, 2010.
