Mayor White called meeting to order at 1:00 p.m. Special Agenda Item No. 2 -- Presentation, possible action, and discussion of resolution declaring results of City Runoff Election June 13, 2009. Kay Parker, Presiding Judge of Central Counting Station presented a resolution canvassing the results of the June 13, 2009 runoff election. A motion was made by Council member Maloney to approve Resolution No. 6 -22- 2009 -02 as presented and seconded by Council member Massey, which carried 6 -0. Special Agenda Item No. 3 -- Oath of Office administered to newly elected Councilmember and presentation of Certificate of Election. Municipal Court Judge Ed Spillane administered the oath of office to Katy Marie Lyles, Place 4. Mayor White presented newly elected Council member Katy -Marie Lyles with the Certificate of Election. Special Agenda Item No. 4 -- Adiourn. Hearing no objections, Mayor White adjourned the meetings at 1:10 p.m. on Monday, June 22, 2009. PASSED AND APPROVED this 91h day of Jam, 2009. (1a APPROVED City Secretary Connie Hooks Mayor Ben White RESOLUTION NO. 6-22-2009-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, ACTING AS THE CANVASSING BOARD TO CANVASS THE RUNOFF ELECTION CONDUCTED ON JUNE 13, 2009. WHEREAS, on June 13, 2009, a runoff election was held for the purpose of electing Place 4 on the College Station City Council; and WHEREAS, the returns tabulated at Central Counting held in the College Station City Council Chambers on June 13, 2009 recorded a total of 3,164 votes cast or 8.31 % of the registered voters at said election; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That each of the candidates received the following total number of votes at said election, COUNCIL MEMBER PLACE 4 Katy -Marie Lyles Lynn McIlhaney 1,807 1,350 PART 2: That the City Council officially finds, determines, and declares that the election was duly and properly ordered, that legal notice of such election was duly given in the English and Spanish language, that the election was duly and legally held, and all residents, qualified voters in the City of College Station, Texas were permitted to vote in the election; and PART 3: That the City Council hereby certifies that this resolution contains the total of all votes received by each candidate including early votes as prescribed by Section §87.1231 of the Texas Election Code and that the results have been duly canvassed in accordance with State Law; and PART 4: That the precinct results for each candidate on Election Day and Early Voting shall become a part of this Resolution; and PART 5: That Katy -Marie Lyles was duly elected as City Council member Place 4 for a three year term and she shall take the oath of office and receive a certificate of election as prescribed by the laws of the State of Texas and the Charter of the City of College Station.
