HomeMy WebLinkAbout10-08-09-2h - Resolution - 10/08/2009RESOLUTION NO. 10- 08 -09 -2h A RESOLUTION REPLACING RESOLUTION NO. 09 -01- 2009 -03 TO REFLECT NEW POLLING LOCATION FOR VOTERS IN THE CITY OF COLLEGE STATION DURING THE PERIOD OF VOTING FOR THE SPECIAL ELECTION ON NOVEMBER 3, 2009, AUTHORIZING THE MAYOR TO SIGN A REVISED NOTICE OF ELECTION AND REVISED INTERLOCAL GOVERNMENT AGREEMENT BETWEEN THE CITY OF COLLEGE STATION AND BRAZOS COUNTY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION: PART 1. Resolution No. 08 -27- 2009 -2f was adopted by the College Station City Council at its regular meeting on August 27, 2009 for the purpose of adopting an Interlocal Government Agreement with Brazos County for the conduct and management of the City of College Station Special Election to be held on Tuesday, November 3, 2009; and PART 2. Resolution No. 09 -01- 2009 -03 was adopted by the College Station City Council at a special meeting on September 1, 2009 for the purpose of proposing ordinance, submitted as Section 83, initiative petition, providing that camera enforcement of red light violations shall be unenforceable; authorizing the Mayor to sign notice of election; providing a severability clause; and providing an effective date; and PART 3. Brazos County Clerk notified the City of three changes to abovementioned resolutions. The changes are noted as follows and recorded in the Interlocal Government Agreement and amended notice of election. • Early Voting October 19 -30 Rudder Tower, 2 nd Floor Joe Routt Blvd. TAMU Campus • Precinct 80 Christ United Methodist Church, 4201 Hwy 6 South • Part 7 of Resolution No. 9 -01- 2009 -03 shall be amended to delete the language regarding officials authorized to be present at Central Counting Station. "Mayors and members of the City Council." PART 4. The polls for said special election shall be open from 7:00 a.m. until 7:00 p.m. PART 5. The City Secretary is expressly authorized to perform all duties necessary and to assist the Brazos County Clerk in conduct of said election. PART 6. Direct recording electronic voting devices shall be used for voting at the foregoing election precincts and electronic counting devices and equipment shall be used for counting the ballots at said election. PART 8. Early voting shall be conducted by the Brazos County Clerk, 300 East 26 I Street, Bryan, Texas, and optical scan balloting shall be used for early voting by mail and direct recording electronic voting devices shall be used for early voting by personal appearance. Early voting by personal appearance for the special election shall be held on the following dates and times: Resolution 10 -08 -09 -2h EARLY VOTE * October 19 — October 23; Monday — Friday *There will be no weekend * October 26 — October 28; Monday — Wednesday *October 29 & 30; Thursday - Friday 8:00 am — 5:00 pm voting 8:00 am — 5:00 pm 8:00 am — 8:00 pm EARLY VOTE SITES: Brazos County Administration Building — 200 S. Texas Ave, Bryan, Texas Arena Hall — Tabor Road & N. Earl Rudder Frwy., Bryan, Texas Galilee Baptist Church — 804 N. The following slate of officials and other designated persons are hereby authorized to be present at the Central Counting Station to observe the election counting process: Presiding Judge of Central Counting Station Brazos County Clerk and designees College Station City Secretary Connie Hooks and designees Data Processing Manager and Tabulation Supervisor Representatives of the Secretary of State's Office, Hart Intercivic and Texas Voting Systems, Inc. PART 10. The Brazos Center located at 3232 Briarcrest Drive, Bryan, Texas is hereby established as the Central Counting Station to receive and tabulate votes and ballots cast in said election. PART 11. All resident, qualified voters of the City of College Station shall be permitted to vote in the Special Election. In addition, the election materials as outlined in Section 272.005, Texas Election Code, shall be printed in both English and Spanish for use at the polling places and for early voting for said election. PART 12. The Mayor is authorized to sign a Notice of Special Election as prescribed by the State of Texas. The Notice of Special Election shall be published in accordance with the provisions of the Texas Election Code and the City Charter. PART 13. Should any part, section, subsection, paragraph, sentence, clause or phrase contained in this resolution be held to be unconstitutional or of no force and effect, such holding shall not affect the validity of the remaining portion of this resolution, but in all respects said remaining portion shall be and remain in full force and effect.
