Consideration, discussion, and possible action to approve meeting minutes: •April 7, 2026 Board Member Yung moved to approve the meeting minutes from April 7, 2026, Board Member Cepak seconded the motion, the motion passed 4-0. 2.2.Public Hearing, presentation, discussion, and possible action regarding a variance for an Accessory Structure located at Westminster Ph 1, Block 1, Lot 1, Acres 3.534, generally located at 3650 Barron Cut-Off Rd. The Subject property is zoned R: Rural. Case #AWV2026-000006. Staff Planner Schrum presented the request explaining that the applicant Clint Merritt is requesting an increase in allowable accessory structure size from 567 sq.ft. (25% of principal structure) to 1,000 sq.ft., requiring a 433 sq.ft. variance. •UDO section 6.5.B.5 limits accessory structures to 25% of the principal structure. •Staff determined the request does not meet criteria 1, 2, 6, 7 and 9 of UDO Section 3.6.1(E)(1). •The lot is a deep corner lot exceeding 500 feet in depth, but the lot’s depth is not an extraordinary condition that deprives reasonable use. •Mr. Merritt can still build a compliant accessory structure. •Similar large structures in the area were permitted as detached garages, not accessory structures. •Hardship resulted from Mr. Merritt’s preferences, not land conditions. •The UDO standards are not restricting the utilization of the property. Page 2 of 22 Staff Planner Schrum recommended denial. Chairperson Collins opened staff questions. Board Member Cepak sought clarification regarding hardship criteria, agricultural equipment storage, alternative structure options, and whether Mr. Merritt could pursue a detached garage or additions to the primary residence. Staff Planner Schrum explained that the UDO considers whether the land can reasonably be used for its intended purposes (single-family and agricultural). Because Mr. Merritt could still build a 567 sq.ft. compliant structure, and could pursue alternatives like a detached garage, staff did not view the criteria as met. He clarified that accessory structure rules are tied to the principal structure’s size, not the acreage or agricultural needs, and detached garages are regulated differently. Chairperson Collins opened the public hearing. Clint Merritt, Applicant, was sworn in and available for questions. Board Member Cepak asked what the purpose of the building was while Chairperson Collins asked whether Mr. Merritt had considered using a detached garage instead. Mr. Merritt answered that he would store some equipment in the structure. Mr. Merritt was not aware of the distinction between accessory structures and detached garages. Board Member Cepak then asked staff whether there were alternative paths that would allow Merritt to build a structure of similar size without requiring a variance. Staff Planner Shrum acknowledged that an addition to the home could increase the allowable accessory-structure size and noted that a detached garage could bypass some restrictions. Chairperson Collins closed the public hearing. Board Members briefly discussed: •Difficulty establishing extraordinary conditions (criterion #1) •The fact-finding nature of the Board and the requirement that all criteria be affirmatively met. •Rural character vs suburban precedent concerns. •Potential alternative pathways such as detached garages or expanding the primary structure. •Frustration regarding criterion strictness and equity in property-rights contexts. •A request that staff work with the applicant on any alternative compliance options. Page 3 of 22 Assistant City Attorney David Purnell emphasized that the Board is a fact-finding body, obligated to uphold ordinance standards and reiterated that whether criteria were met is solely a Board determination, but staff’s technical analysis held that multiple criteria were not satisfied. Chairperson Collins motioned to deny the variance as it does not meet the necessary nine criteria. Board Member Yung seconded the motion, the motion to deny fails 2-2, with Board Member Cepak and Board Member Mendizabal voting against the motion. Board Member Cepak motioned to approve the variance as it is not contrary to the public interest due to the following special conditions: it’s the property owner’s land and the variance will set the precedent for others. Board Member Mendizabal seconded the motion, the motion to approve fails 2-2, with Chairperson Collins and Board Member Mendizabal voting against the motion. Chairperson Collins motioned to deny the variance as it does not meet extraordinary conditions affecting the land. Board Member Yung seconded the motion, the motion to deny fails 3-1, with Board Member Mendizabal voting against the motion. LOCATION: 313 College Avenue Culpepper at TAMU Subdivision Phase 1, Block 1, Lot 1 (4.9 acres) ZONING: NG-2 Transitional Northgate PROPERTY OWNER: 313 COLLEGE AVENUE OWNER LLC APPLICANT: HPAM SIGN PRO LLC PROJECT MANAGER: Jeff Howell, Senior Planner jhowell@cstx.gov RECOMMENDATION: Staff recommends denial of the variance. BACKGROUND: The applicant has submitted a variance application to allow for modified standards for a projection sign for the mixed-use development in Northgate at the corner of Legacy Point Drive and College Avenue. The 7-story building is anticipated to have commercial use, lobby and residential amenities, along with a parking garage and residential units above the ground floor similar to the character of other developments in the area. The building is currently under construction. As part of the sign permit, only two signs are proposed at this time, one of which is an attached sign, while the other is projection sign. The projection sign, proposed on the side of the building facing College Avenue, is larger and extends from the building further than the ordinance allows. The UDO Section 5.8.B.12. ‘Sign Standards’ provides criteria for projection signs, including that a projection sign is allowed up to a maximum of 18 square feet and that all extremities of projection signs, including supports, frames, and the like, shall not project more than three (3) feet from the exterior building face. Page 5 of 22 Zoning Board of Adjustment Page 2 of 5 September 1, 2026 The sign is proposed to be 30 square feet in size (3 ft. x 10 ft.), exceeding the maximum size by 12 square feet. The sign is proposed to be located attached to the wall via detachable brackets placed 7” from the wall. With the sign being 3’ in width, it would be exceeding the allowed distance from the building face by 7”. APPLICABLE ORDINANCE SECTION: UDO Section 5.8.B.12.c.4. ‘Projection Signs’ ORDINANCE INTENT: To establish clear and unambiguous regulations pertaining to signs in the City of College Station and to promote an attractive community, foster traffic safety, and enhance effective communication and exchange of ideas and communicate information. Concepts related to traditional neighborhood development, which promotes a mixture of non-residential and residential uses in a pedestrian- oriented setting, have been incorporated within the standards for the Northgate zoning districts. In addition to the allowance of unique sign formats, such as projection signs, other traditional neighborhood development concepts have been incorporated into the Northgate zoning districts, such as increased density, wider sidewalks and compatible high-quality building design. Extraordinary conditions: That there are extraordinary or special conditions affecting the land involved such that strict application of the provisions of the UDO will deprive the applicant of the reasonable use of his land. Staff has found that no extraordinary or special condition exists that would deprive the applicant a reasonable use of the land. The applicant states that unique traffic conditions exist and raised medians restrict the turning movements and amount of time to identify the property. The applicant has stated that “Unlike a typical corner property with unrestricted access, approaching drivers are committed to specific travel paths due to the raised medians”. While there are center medians on College Ave., this property is located on the corner of two roadways and the UDO allows for attached signage as well. Based on the proposal, a sign can be installed to meet the criteria as specified in the UDO. A special condition does exist on this property as there is a public utility easement which extends along the property line adjacent to the building, which is why the applicant has proposed this sign to include detachable brackets in the event the sign needs to be removed temporarily. The characteristics related to a detachable bracket as compared to a non-detachable, permanent bracket does not necessarily make the proposed sign extend further from the wall. The easement is not depriving the applicant the reasonable use of the land. 2. Other property: That these conditions do not generally apply to other property in the vicinity. There are no extraordinary conditions identified that deprive the applicant the reasonable use of his land and thus, do not apply to other area properties. Other properties within the Northgate Design Districts are limited to the same sign standards. This development includes the largest building in NG-2 adjacent to College Avenue. Access to the property is limited to Culpepper Drive and Legacy Point Drive. 3. Enjoyment of a substantial property right: That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant. The variance is not necessary for the preservation and enjoyment of the substantial property right of the applicant. The building is still under construction and the sign has not been installed yet. If the variance is not granted, the applicant will still enjoy the property right of using the property and is able to provide signage that is in compliance with the UDO. 4. Hardships: That the hardship is not the result of the applicant’s own actions. A hardship has occurred based upon the applicant’s own actions and does not occur due to an extraordinary condition of the land. The applicant has stated that the hardship is that “visibility of the building identification becomes critical well before motorists reach the entrance. The proposed sign sizes have been carefully designed to function primarily as wayfinding elements rather than advertising”. The building is currently under construction and is a multi-story building built at the intersection of two roadways. The hardship is a result of the applicant’s desire to have signage larger than allowed by the Unified Development Ordinance. Page 7 of 22 Zoning Board of Adjustment Page 4 of 5 September 1, 2026 5. Subdivision: That the granting of the variance will not have the effect of preventing the orderly subdivision of land in the area in accordance with the provisions of this UDO. The granting of the variance will not prevent the orderly subdivision of land in the area in accordance with the provisions of the UDO as the entire property has been subdivided. 6. Flood hazard protection: That the granting of the variance will not have the effect of preventing flood hazard protection in accordance with Article 8, Subdivision Design and Improvements. The granting of this variance will not have the effect of preventing flood hazard protection in accordance with Article 8, Subdivision Design and Improvements as the site is already developed and due to no portion of this property being located within floodplain. 7. Comprehensive Plan: That the granting of the variance would not substantially conflict with the Comprehensive Plan and the purposes of this UDO. Utilization: That because of these conditions, the application of the UDO to the particular piece of property would effectively prohibit or unreasonably restrict the utilization of the property. The application of the UDO standards to this particular property does not restrict the applicant in the utilization of their property. The applicant is still able to utilize their property as a mixed-use development. The applicant has indicated that “the requested sign area and projection are not intended to create excessive visual impact. Rather, they compensate for the reduced visibility caused by the raised medians, restricted turning movements, and the dense urban streetscape where buildings compete for limited sight distance.” 9. Substantial detriment: That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this UDO. Granting the variance would not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering the UDO. Based on the information provided, this sign is proposed to be located over a Public Utility Easement (PUE) and extends towards College Avenue. While the sign does include detachable brackets, the UDO requirements for size and projection dimensions are there to protect the visual aesthetic of the Northgate area. The applicant has stated that “The proposed blade sign has also been designed to maintain adequate pedestrian clearance along the public sidewalk and will not obstruct pedestrian circulation or accessibility. The projection has been carefully coordinated to balance visibility with public safety and compliance with applicable clearance requirements.” ALTERNATIVES The alternative exists to reduce the square footage of the sign and reduce the distance the sign projects from the wall to meet the requirements as specified in UDO Section 5.8.B.12.c.4. ‘Projection Signs’. The applicant states “The request represents the minimum deviation necessary to provide safe and effective wayfinding while preserving the City’s aesthetic objectives.” With this building being so large as compared to those around it and its proximity to the roadway, the building itself may be able to act as a landmark. Also, if the desire is to provide visibility, additional attached signage may be added to the building as a multi-story structure such as this with a common entry, the total maximum area of attached signage is 600 square feet with the distribution of square footage and location being ultimately up to the landlord. The requested variance is necessary because of the unique physical characteristics and traffic conditions surrounding the property. The site is bordered by raised medians on both College Main Street and the intersecting roadway, which significantly restrict turning movements and reduce the amount of time motorists have to identify the property and safely navigate to the appropriate entrance. Unlike a typical corner property with unrestricted access, approaching drivers are committed to specific travel paths due to the raised medians. As a result, visibility of the building identification becomes critical well before motorists reach the entrance. The proposed sign sizes have been carefully designed to function primarily as wayfinding elements rather than advertising. The proposed signage consists of: • One (1) double-sided blade sign totaling approximately 30 square feet, projecting 3’-7” from the face of the building. The 3’-7” projection is the minimum distance necessary to allow the blade sign to extend beyond the building façade and adjacent architectural elements, providing adequate visibility for motorists and pedestrians approaching from multiple directions. A lesser projection would significantly reduce the effectiveness of the sign as a wayfinding element due to the limited sight lines created by the building location, surrounding structures, and raised medians. The proposed blade sign has also been designed to maintain adequate pedestrian clearance along the public sidewalk and will not obstruct pedestrian circulation or accessibility. The projection has been carefully coordinated to balance visibility with public safety and compliance with applicable clearance requirements. Although the blade sign extends into the public easement, it has been engineered with a detachable mounting system that allows the entire blade sign assembly to be removed without affecting the building structure should future City maintenance, utility work, streetscape improvements, or right-of-way projects require its removal. This detachable design minimizes any long-term impact within the easement while allowing the property to maintain effective identification. The signage is appropriately scaled to the architecture, complements the character of the Northgate District, and enhances public safety by allowing visitors to identify the destination earlier, reducing abrupt lane changes, unnecessary circulation through the district, and last-minute turning movements. Granting this variance would not confer a special privilege but would instead allow this uniquely constrained property to achieve a level of visibility comparable to neighboring properties that are not affected by the same access limitations and sight-distance constraints. The request represents the minimum deviation necessary to provide safe and effective wayfinding while preserving the City’s aesthetic objectives.
