The building is anticipated to have commercial use, lobby and residential amenities with parking on the ground floor, along with a parking garage and residential units above similar to the character of other developments in the area. A variance for the height of the proposed building was approved in March 2026. The building is anticipated to be 25 stories in height, and the tallest corner will sit at 620’-8” Above Mean Sea Level (AMSL) or 282’-8” Above Ground Level (AGL). To assemble the building, and the main tower crane needed for the construction, the applicant has requested this variance up to 738’ Above Mean Sea Level (AMSL) for the helper (mobile) crane and for the tower crane a variance of up to 710’ Above Mean Sea Level (AMSL). Per the Airport Zoning Ordinance for the Page 5 of 90 Airport Zoning Board of Adjustment April 7, 2026 Page 2 of 3 Easterwood Airport, the maximum height limitation for this site is 520.6’ AMSL. The applicant is requesting a height variance for the temporary helper crane of approximately 217.4’ and a main tower crane height of 189.4’. ORDINANCE INTENT: The purpose of the Airport Zoning Ordinance is to establish clear and unambiguous regulations for the protection of the lives and property of users, owners, and occupants of and in the vicinity of Easterwood Field Airport and for the protection of airport operations. A literal application or enforcement of the regulation would result in practical difficulty or unnecessary hardship. 2. The granting of the relief would result in substantial justice being done. 3. The granting of the relief would not be contrary to the public interest. 4. The granting of the relief would be in accordance with the spirit of the regulation. The board may impose any reasonable conditions on the variance that it considers necessary to accomplish the purpose of airport zoning. Page 6 of 90 Airport Zoning Board of Adjustment April 7, 2026 Page 3 of 3 The variance request is to allow for a temporary helper (mobile) crane to assemble the tower crane and the tower crane itself needed for the construction of this Highrise. The height variance request of 217.4’ for the helper crane and the 189.4’ for the tower crane to conduct the necessary work for the proposed mixed-use structure on the property. The overall helper crane’s height will sit at a maximum of 738’ Above Mean Sea Level or 400’ Above Ground Level. The overall tower crane’s height will sit at a maximum of 710’ Above Mean Sea Level or 375’ Above Ground Level. The FAA has made the determination that No Hazard to Air Navigation is present for the helper (mobile) crane and tower crane. In consultation with the EAM team, the TAMU System has no objections to the granting of a variance for the helper (mobile) crane and tower crane. Allowing the height encroachment for the temporary helper crane and tower crane would result in substantial justice being done. The relief would not be contrary to the public interest as it has been deemed acceptable by the FAA, Easterwood Airport and the TAMU System with additional safety precautions and communication processes between the applicant and airport required. The relief would be in accordance with the spirit of the regulation to allow development while protecting lives, property, and airport operations. STAFF RECOMMENDATION After reviewing the request and the related criteria, the information provided by the FAA, EAM and TAMUS, staff recommends approval of the request. The granting of the variance would result in substantial justice being done without being contrary to the public interest, and the spirit of the regulation remains. ATTACHMENTS 1. LOCATION: 501 Nagle St NORMANDY SQUARE CONDOS, ALL BLDGS & ASSOCIATED BPP ZONING: NG-3 Residential Northgate PROPERTY OWNER: NORMANDY SQUARE LLC APPLICANT: Kimley Horn PROJECT MANAGER: Gabriel Schrum, Staff Planner gschrum@cstx.gov RECOMMENDATION: Approval BACKGROUND: The applicant has been coordinating a new student development on this lot located at the corner of Nagle Street, and Cherry Street. The building is anticipated to have 7 stories, with residential units and a parking garage above similar to the character of other developments in the area. This height variance for the tower crane will allow for it to operate and assist with construction of this development. The building is anticipated to be 80' in height, and does not require a height variance for the structure, since it does not go beyond the allowed threshold of 470.6' Above Mean Sea Level (AMSL). To conduct the construction needed for the building the applicant has requested this variance up to 545’ (AMSL) for the tower crane or 200' Above Ground Level (AGL). Per the Airport Zoning Ordinance for the Easterwood Airport, the maximum height limitation for this site is 470.6 AMSL. The applicant is requesting a height variance for the temporary helper crane of 74.4'. Page 50 of 90 Airport Zoning Board of Adjustment April 7, 2026 Page 2 of 3 ORDINANCE INTENT: The purpose of the Airport Zoning Ordinance is to establish clear and unambiguous regulations for the protection of the lives and property of users, owners, and occupants of and in the vicinity of Easterwood Field Airport and for the protection of airport operations. The variance request is to allow for a temporary tower crane to needed for the construction of this midrise. The height variance request of 74.4 feet will allow for the tower crane to conduct the necessary work for the proposed multifamily development. Page 51 of 90 Airport Zoning Board of Adjustment April 7, 2026 Page 3 of 3 The overall tower crane’s height will sit at a maximum of 545' Above Mean Sea Level or 200’ Above Ground Level. The FAA has made the determination that No Hazard to Air Navigation is present for the helper crane. In consultation with the EAM team, the TAMU System has no objections to the granting of a variance for the use of the crane. Allowing the height encroachment for the crane would result in substantial justice being done. STAFF RECOMMENDATION After reviewing the request and the related criteria, the information provided by the FAA, EAM and TAMUS, staff recommend approval of the request. The granting of the variance would result in substantial justice being done without being contrary to the public interest, and the spirit of the regulation remains. ATTACHMENTS 1.
