It lists and describes City activities that were identified which have impacts on the community's appearance . Staff separated these activities into programs, projects, regulations and incentives for purposes of organization . The report satisfies the first milestone on the action plan for this issue. A copy of that action plan is attached as well . The report also includes two spreadsheets that address budget allocations for each activity and where there are tangible results, those are shown as well . This inventory was presented to the Community Appearance Committee on July 25th . If Council would like a formal slide presentation or a discussion of any aspect of the report staff will be happy to oblige . Since its inception, Austin Art in Public Places has developed a diverse collection of public art at sites throughout Austin, employing local artists, as well as artists of national renown. The program's national Visual Arts Slide Registry is an important resource for artist selection. The program is administered by Art in Public Places Coordinator under the direction of the Art in Public Places Panel, composed of seven visual art and design professionals from the community appointed by the Austin Arts Commission. Working closely with Project Architects, User Departments, and the community, the Panel and Coordinator insure that high quality art reflecting the artistic and cultural diversity of Austin is acquired for the enjoyment and education of Austin citizens and visitors . The Art in Public Places Panel also reviews donations of artwork to the City of Austin. Austin Art in Public Places presents an on-going exhibition series curated by the Art in Public Places Coordinator in the main lobby of the City Municipal Building, 124 West Eighth Street, Austin, Texas . The Art in Public Places Panel meets at 6:30 p .m . on the second Wednesday of each month at the Austin Parks and Recreation Department Conference Room, 200 South Lamar Boulevard. TEXA ~5==9~~~======,,__-~==;r=;i ORDINANCE NO. 850926-0 AMENDED BY ORDINANCE NO. o ~ I 0 o 1 -d_ AN ORDINANCE AUTHORIZING ALLOCATION OF CERTAIN FUNDS FOR ART IN THE CONSTRUCTION OF PUBLIC WORKS; PROVIDING FOR A REVIEW OF SUITABLE CAPITAL PROJECTS AND FOR AN ARTIST SELECTION PROCESS; ESTABLISHING A SPECIAL FUND DESIGNATED "PUBLIC ARTS FUND"; SUSPENDING THE RULE REQUIRING THE READING OF ORDINANCES ON THREE SEPARATE , DAYS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Austin accepts a responsibility for expanding experience with visual art; and, WHEREAS, such art has enabled people in all societies b etter to understand their communities and individual lives; and, WHEREAS, artists capable of creating art for public places must be encouraged and Austin's standing as a regional leader in art enhanced; and, WHEREAS, public art is a resource which stimulates the vitality and economy of the City; and, WHEREAS, a policy should be established to direct the inclu- sion of works ~: of art in r.laj or city construction projects; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: PART 1. (b) "Commission" means the Austin Arts Commission. (c) "Construction cost" means actual construction cost, excluding architectural, engineering and administrative costs, costs for fees and permits, and indirect cost, such as interest during construction, advertising and legal fees. (d) "Capital Improvement Program (CIP)" means the City's program bearing the name for advance planning of capital develop- ments. (el "Public Arts Fund" means the segregated account containing funds to be used for the acquisition, installation and maintenan ce of art and arts projects in, upon and adjacent to City buildings, parks and open spaces. One percent (1%) of the original estimated construct i on cost of a City construction project shall be set aside and used for art or arts projects; however, dedication exceed $200,000 for a one percent ( 1 % ) sum shall be installation of such art in, at provided, that if the project installation or display of art, the Public Arts Fund. that in no case shall any such single construction project. (b) Concurrent with the award of the contract for any City construction project, the City Council shall appropriate to the Public Arts Fu:nd, the one percent ( 1 % ) sum provided for herein- above. PART 3. (a) The Austin Arts Commission shall appoint an Art in Public Places Pane l to provide review responsibility for the provisions of this ordinance. (b) The Art in Public Places Panel, with the Art in Public Places Coordinator, shall make periodic r~views, at least annually, of all CIP projects and other City construction projects, for the purpose of making recommendations regarding appropriations for works of art and arts projects. (c) The Art in Public Places Panel, through the Arts Commis- sion, shall recommend to the City Manager, or the City Council, as appropriate, a method or methods of selection and commissioning of artists with respect to the design, execution and placement of works of art and fine arts projects in connection with City con- struction projects. (d) All recommendations for the placement of art and arts projects shall be the initial responsibility of the Art in Public Places Panel. The same shall be reviewed by the Commission and submitted to the City Manager or City Council with the Commission's comments. I . I (e) The Panel shall, for any proposed work of art which requires extraordinary operations or maintenance expenses, receive prior approval of the Public Works Director -which will house such work of art. TEXA::>===============~ I (f) The Commission shall promulgate procedures, and guidelines in consultation with the Arts in Public Places Panel and the Art in Public Places Coordinator to facilitate the implementation of this ordinance. Such guidelines shall include mechanisms to: (1) Determine the cases in which it would be inappropriat e \ to display art in a City building; \ ( 2) Identify suitable art objects for City buildings; (3) Encourage the preservation of ethnic cultural arts and crafts; (4) Facilitate the preservation of art objects facts that may be displaced by a construction project; and arti- (5) Prescribe a method or methods of competitive selection of art objects for display; ( 6) Prescribe procedures for the selection, acquisition a~d display of art in City buildings; ~nd (7) Any other matter appropriate to the administration of this ordinance. PART 4. Works of art selected and implemented pursuant to the provisions of this .ordinance and any amendment thereto may be placed in, on or about any municipal construction project or other municipally-owned, leased or rented property. They may be integral to or integrated within or about such property and may be either temporary or permanent. Placement of works of art shall be recommended by the Commission, and upon approval of such placement of the City off ice rs and employees responsible for the design or construction of such projects shall make appropriate space avail- able for the placement of works of art. PART 5. All art and arts projects acquired pursuant to this ordinance shall be acquired in the name of the City of Austin, Texas, and title thereto shall vest in the City. PART 6. The rule requiring that ordinances shall be read on three separate days is hereby suspended, and this ordinance shall become effective ten days from the date of its passage, as provided by the Charter of the City of Austin. Equipment shall not mean items that are custom designed or that create a new use for a City Construction Project, whether portable or affixed; and iii) "Real Property Acquisition Costs" shall mean payments made for the purchase of parcels of land, existing buildings and structures, and costs incurred by the City for the appraisals or negotiations in connection with such purchase for a City construction project; provided, however, that a City Construction Project for the acquisition and/or development of parkland or parks shall have included in its construction cost the Real Property Acquisition Costs, as defined above. iv) "Debt Issuance" shall mean those ex- penses incurred by the City of Austin for the issuance of bonds for a City Construction Project. v) "Permits and Fees" shall mean payments made for all permits and fees asso- ciated with a city Construction Project. (d) "Capital Improvement Program (CIP)" means the City's program bearing the name for advance planning of capital developments. (e) "Public Art Funds" shall mean the segregated accounts containing funds to be used for the selection, acquisition, installation, and sub- stantive structural repair and maintenance of art and art projects in, upon, and adjacent to City buildings, parks, open spaces, and other public sites. One account shall be created for all general fund departments and separate account(s) shall be created for the enterprise fund departments. (a) All City Department Heads and the Director of Financial -Services, after consul tat ion with the Art in Public Places Coordinator -as des.l,g- nated by the Director of the Parks and Recreation Department -shall include in all estimates for necessary expenditures and all requests for authorizations or appropriations for City Con- struction Projects, an amount to be set aside and used for the selection, acquisition and display of works of art and art projects equal to at least one percent (1%) of the construction cost, as defined herein, of any such construction project as originally estimated in the CIP and/or authorized in the City's annual operating budget for the year in w~ich such estimate or request is made. The minimum amount to be appro- priated for art shall be the total City-funded portion of the construction cost, as defined herein, for the City construction project, divided by one hundred (100). If the source of funding or appropriate law governing any particular project precludes art as an object for expenditure of City funds, the amount of funds so restricted shall be excluded from the construction cost, as defined herein, in making the aforesaid calculation. Under no circum- stances shall the 1% appropriation be calculated on City construction projects with a construction cost of less than FIFTY THOUSAND AND N0/100 DOLLARS ($50,000.00). Except as provided in Part 2(d) below, the 1% appropriation for art shall not exceed TWO HUNDRED THOUSAND AND N0/100 DOLLARS ( $200, 000. 00) for a single City construc- tion project. (b) Concurrent with the appropriation to fund the related City construction project, the City Council shall appropriate the one percent (1%) sum, as calculated in Part 2(a) herein, to the proper Public Art Fund. (c) The art or art projects financed from the Public Art Funds shall be an integral part of the City construction project, or be placed in, at or near the City construction project. TEXAt>-================;; for the installation or display of art, the amount of money for such project calculated under Part 2 (a) herein shall be appropriated to the proper Public Art Fund for use at other appropriate public sites; provided, however, the transfer of monies from one project to another is not authorized, if legal restric- tions on the source of the funds prohibit such transfers. ( d) As calculated under Part 2 (a) above, the one percent (1%) sum shall not exceed $200,000.00 for a single City construction project; provided, however, that the Art in Public Places Panel, through the Commission, may recommend to the city Council during the course of the City of Austin normal budget cycle an exception to this limita- tion for those City construction projects which merit or require a larger expenditure for art and art work by virtue of the project scale or function. PART 3. That Part 3 of Ordinance No. 850926-0 be and is hereby amended to read as follows: PART 3 :·1 (a) The Austin Arts Commission shall appoint an Art in Public Places Panel to provide review responsibility for the provisions of this Ordi- nance. (b) The Art in Public Places Panel, with the Art in Public Places Coordinator, shall make periodic reviews, at least annually, of all CIP projects and other City construction projects, for the purpose of making recommendations regarding appropriations for works of art and arts pro- jects. (c) The Art in Public Places Panel, through the Arts Commission, shall recommend to the City Manager, or the City Council, as appropriate, a method or methods of selection and commis- sioning of artists with respect to the design, execution and placement of works of art and fine arts projects in connection with Ci~y construction projects. If the method or methods of selection deemed appropriate by the Art in Public Places Panel, through the Arts Commission, include the use of compensated consultants or 4 - r;================ClTY OF AUSTIN. TEXAS=============== juries for evaluation of art proposals, the payment schedules for said consultants must be reviewed and approved by the City. (d) All recommendations for the placement of art and arts projects shall be the initial respon- sibility of the Art in Public Places Panel. The same shall be reviewed by the Commission and the appropriate contract submitted to the City Manager or the City Council, as appropriate, with the Commission's recommendation. (e) The Panel shall, for any proposed work of art which requires extraordinary operations or maintenance expenses, receive prior approval of the General Services Director and the Director of the department that receives such work of art. (f) The Commission shall promulgate procedures, and guidelines in consultation with the Arts in Public Places Panel and the Art in Public Places Coordinator to facilitate the implemen- tation of this ordinance. (1) Such guidelines shall include mecha- nisms to: . •. ~· (A) Determine the City con- struction projects at which it would be inappropriate to display art; ( B) Identify suitable art objects for City buildings;_ (C) Encourage the preservation of ethnic cultural arts and crafts; (D) Facilitate the preservation of art objects and artifacts that may be displaced by a construction project; (E) Prescribe a method or methods of competitive selection of art objects for display; (F) Prescribe procedures for the selection, acquisition I \ I I I I I I L====s =====- rr===============C I TY OF AUSTIN. TEXAS=============== and display of art in City buildings; and (G) Any other matter appropriate to the administration of this ordinance. (2) The Com.mission has established an initial set of procedures implementing this ordinance, which are attached hereto as Exhibit "A" and incorporated herein by reference. (g) All expenses associated with the routine upkeep and maintenance of the art works and art projects shall be the responsibility of the City depart- ment at which the art work is displayed. If performed by such department, such maintenance shall receive the prior approval of the Art in Public Places Coordinator. All repairs and maintenance .shall comply with any contractual obligations entered into by the City in the acquisition of those art works. PART 4. That Ordinance 850926-0 be and the same is hereby amended bX 1 adding a new Part 6, which shall read as follows: PART 6. ~he ~revisions of this Ordinance shall be reviewed by the City Council on an annual basis. PART 5. If any provision, section, subsection, sentence, clause or phrase of this Ordinance, or the application of same to any · person or set of circumstances is for any reason held to be unconstitutional, void, -0r invalid, the invalidity of the remaining portions of this Ordinance shall not be affected thereby, it being the intent of the City Council in adopting this Ordinance that no portion hereof or provisions, or regulations contained herein, shall become inoperative or fail by reason of any uncon- stitutionality of any other portion hereof and all provi- sions of this Ordinance are declared to be severable for that purpose. PART 6. Part l.c) of this Ordinance shall apply to all eligible city Construction Projects receiving approved funding after the effec~ive date of this Ordinance. All other provisions of this Ordinance, with the exception of Part l.c), shall govern the implementation and administra- tion of City Construction Projects approved since the effective date of Ordinance No. 850926-0. 6 I 11 I' rr===============CITY OF AUSTIN. PURPOSE Th e purpose of these guidelines is to establish a process for the se lec t ion, purchase, commission, placement, and maintenance of works of art via the expenditure of the monies generated through Ordinance #850926-0 as amended, generally referred to as the Art in Publi c Places Ordinance, signed into law on September 26, 1985, and effective ten days thereafter. This ordinance is understood to apply to only those projects which received approved funding af ter the effective date. These guidelines shall not be understood to apply to donated works of art, as those instances are covered by a separate donations policy. II. IN TENT A . It is the stated intent of the Art in Public Places Ordinance to direct the inclusion of works of art in City construction projects in order to expand the citizens' of Austin experience with visual art and enable them to better understand their commu- nities and their individual lives. By encouraging artists capable of creating works of art in public places, the Art in Public Places Program shall strive to stimulate the vitality and economy of the city and enhance Austin's standing as a regional leader in the arts. Thus, it is the goal of the Art in Public Places Program to expend the percent funds on works of art and art projects of redeeming quality which advance public understanding of visual art and enhance the aesthetic quality of public places. This goal shall be realized through: 1. The commission of artists and works of art .of the highest quality, which represent an expression of our time, contribute to a sense of the City's identity, and entail some measure of public significance; 2. The nurturing of the artistic vitality of the City of Austin through the encou- ragement of local artistic endeavors; 3. The encouragement of public dialogue which increases public understanding and enjoyment of visual art, through appro- priate public education forums and pro- grams; 4. The encouragement of public interaction wi th public places, areas which provide for public ownership and accessibility, via the placement of works of art; 5. The commission of a broad range of works of art, reflective of the overall diversity of current works in the field of visual art; 6. The commission of works of art varying in style, scale, medium, form and intent representative of the local, regional, national, and international arts commu- nities; 7. The encouragement of artists to reach creative solutions to the aesthetic pro- blems they have been employed to solve; 8. The broad distribution of commissions among artists; 1.,..t' 9. The broad geographic distribution of works of art in the City of Austin; 10. The encouragement of true collaborative efforts between artists and architects, engineers, and landscape architects. III. DEFINITIONS A. "ARTS COMMISSION" -The Austin Arts Commission, as appointed by the City Council. B. "ART IN -PUBLIC PLACES PANEL" - A standing committee appointed by the Arts Commission, responsible for advising the Commission on matters relating to the implementation of the Art in Public Places Ordinance. (See Section V.) c. "ARTIST" - A practitioner in the visual arts gene- rally recognized by critics and peers as a profes- sional possessing serious intent and ability who is not a member of the Project Consultant's firm or employed thereby. 2 D. "VISUAL ARTS PROFESSIONAL" -An artist, arts edu- cator, art critic, arts administrator, arts dealer, designer, art historian, cur a tor, fine art collector, architect, urban planner, or landscape architect who is well respected in his/her field, knowledgeable with regards to contemporary visual art, and willing to participate effectively in a panel process without conflict of interest. E. "WORKS OF ART or ARTWORK" -All forms of original creations of visual art which may be portable as well as permanent. To include but not limited to: Paintings of all media, including both portable and permanently affixed works such as frescoes and murals; Sculpture of any form and in any material or com- bination of materials. To include statues, monu- ments, fountains, arches, or other structures in- tended for ornamentation or commemoration. Also included are reliefs, mobiles, kinetic, electronic, and neon sculptures; Other works of visual art, such as inscriptions, stained glass, fiber works, carvings, mosaics, photographs, drawings, collages, textile works, and prints. Also included are crafts both decorative and utilitarian in clay, fiber, wood, metal, glass, stone, plastic and other materials; Artist designed landscapes and earthworks, including the artistic placement of natural materials or other functional art objects. F. "PROJECT CONSULTANT" -Any firm, individual, joint venture or team of firms or individuals with which the City contracts, as selected by the Council, for design consulting services related to construc- tion projects. G. "CONSTRUCTION PROJECT" -Any capital project paid for wholly or in part by the City of Austin to construct or remodel any building, decorative or commemorative structure, park, or parking facility or any portion thereof. H. "CAPITAL IMPROVEMENT PROGRAM (CIP)" -The City's .program for advance planning of capital developments. 3 I. "ELIGIBLE PROJECT" - A construction or remodeling project, as defined above, for which the source of funds is not restricted by law or regulation as to its use for artworks. The Ordinance extends to the construction or remo- deling of all buildings, as defined by the City's Comprehensive Zoning Ordinance and irrespective of its function; decorative or commemorative structures; parks (including but not limited to swimming pools, land development, playscapes, picnic structures, jogging trails, restroom facilities, and athletic courts); or parking facilities (public lots, garages, parking terminals or other structures or accommo- dations f or t~e parking of motor vehicles off the street or highway, and includes equipment, entrances, exits, fencing, and other accessories necessary for the safety and convenience in the parking of vehicles), or any portion thereof. However, the Ordinance does not extend to street and sidewalk construction, underground water and sewage lines, electrical transmission and djstribution lines, electrical sub-stations, and/or water pump stations. In order to be considered eligible for the Art in Publ iC:-1 Places Progra1a, a remodeling project must provide a new use for or an addition to an existing space by making structural changes. This shall be understood to include rehabilitation projects which extend the useful life of a structure as well as restoration projects which return a structure to a previous condition. Examples of such projects would include the construction of office space from exist- ing storage space, the addition of a wing to an existing structure, and the restoration of a struc- ture such as that of the Old Main Library. Because of the administrative costs associated with the transfer of funds and the selection of an artist, a project must have an original estimated construc- tion cost of over $50,000 in order to be -considered eligible. Purely decorative remodeling projects such as new carpeting, painting, or the installation of portable partitions shall not be considered eligible projects. Normal maintenance and repair to an existing struc- ture such as the replacement of a roof, broken windows, or out-dated heating/cooling systems shall not be considered eligible projects. If, however, these costs are part of a larger eligible project, 4 then they shall be included in the total construction cost on which the 1% is assessed. The Art in Public Places Ordinance extends to con- struction and remodeling projects planned through the City of Austin's biennial capital improvement planning process (CIP) as well as those planned at the departmental level. CIP projects are generally funded either through bond propositions or current revenues, whereas non-CIP projects are funded through the annual operating budgets. The Ordinance states that in no case shall the 1% dedication exceed $200,000 for a "single City construction project." For CIP projects a single City construction project is identified by a serial number, which is included as a line item in a single approved bond proposition and/or in an approved annual capital budget. As non-CIP projects are not indicated on a line item basis in a departmental budget, identification of a single construction project under the Art in Public Places Ordinance and Guidelines must be determined on a case-by-case basis between the Coordinator, the appr~priate departmental represen- tative, and representative of the Financial Services Department. Pursu~~t to the Ordinance, the Art in PUblic Places Panel may through the Artsr Commission, recommend that the City Council make an exception to this limitation for those City construction projects which merit or require a larger expenditure by virtue of the project scale or function; provided, however, such recommendations must be made and reviewed by City Council during the course of the normal budget process. J. "USER DEPARTMENT" -The City Department which will occupy or otherwise administer the use of the project upon its completion. Where more than one department is involved, the user departments shall have the authority to decide who represents them. K. "COORDINATOR" -The staff person hired by the Director of Parks and Recreation to coordinate and facilitate the implementation of the Art in Public Places Ordinance as adopted by the City Council of the city of Austin. L . "ELIGIBLE COSTS" -The original estimated construc- tion cost as defined in the Art in Public Places Ordinance. Any costs related to the construction of the project which are not specifically excluded 5 b y said definition shall be included in the calcu- lation of the one percent (1%) assessment. M. "CONSTRUCTION COST" -As defined in the Ordinance to mean the total City-funded portion of a City construction project as originally estimated, ex- cluding demolition, equipment, and land acquisition costs, costs for fees and permits as well as those costs associated with debt issuance. N. "MANAGING DEPARTMENT" -The City Department respon- sible for the implementation of the design and/or construction of all city of Austin owned facilities. 0. "PROJECT MANAGER" -The City staff person charged with the responsibility for the implementation of the design and/or construction of the City of Austin owned facility which meets the definition provided hereinabove for an eligible project. I V. APPROPRIATION AND ALLOCATION OF FUNDS A . All City Department Heads and the Director of Financial Services shall, after consultation with the Art in Public Places Coordinator, include in all estimates of necessary expenditures and all requests for authorizations and appropriations for City construction projects, an amount for art equal to at least one percent (1\) of the original esti- mated construction cost of any eligible project. For CIP construction projects the original estimated construction cost shall be that estimated in the CIP for the year in which such funding is approved by the City Council. For non-CIP construction projects subject to the provisions of the Ordinance, the original estimated construction cost shall be that amount initially authorized in the departmental budget by the City Council. If the source of funding or appropriate law with respect to any particular project precludes art as an object of expenditure, the amount of funds so restricted shall be excluded from the total project cost in making the aforesaid calculation. B. The minimum amount to be appropriated for art shall be the total City-funded portion of the construction cost for the City Construction project, divided by one hundred (100). 6 c. For those projects which are only partially funded by the City of Austin, the one percent (1%) assess- ment shall be based on the City's portion of the original estimated construction cost. All City grant applications for federal, state, or county support of eligible construction projects shall include a request for funds for the purposes of the Art in Public Places Program. Additionally, the City of Austin shall actively seek to encourage its partners in all joint public/private ventures to participate in the Art in Public Places Program. D. As provided in the Ordinance, the Art in Public Places Panel, with the Coordinator, shall make periodic reviews, at least annually, of all CIP projects and other · City construction projects. This review shall occur during the city of Austin's biennial CIP process and annual operating budget process, for the purposes of making recommendations to the Financial Services Department regarding appropriations for works of art and art projects. E. Public Art Funds shall be established by the City of Aus:t:in for the purposes of administering the Art in ·Public Places Program. The funds contained in said accounts shall be used for the selection, acquisition, installation, and substantive structural repair and maintenance of art and art projects commissioned and/or purchased through the Art in Public Places Program. One account for all general fund departments shall be established within the Parks and Recreation Department and separate fund(s) shall be established for the enterprise fund depart- ments. As provided in the Ordinance, the city Council shall appropriate the one percent monies to the proper Public Art Fund concurrent with the appropriation to fund the related City construction project. These Public Art Funds shall be maintained in accord with accepted governmental accounting procedures. All appropriations to and allocations from the various Public Art Funds shall occur in accord with any legal restrictions associated with the source of funds. F . As provided in the Ordinance, in the event that an eligible project is deemed inappropriate for th·e siting of public art by the Art in Public Places Panel, the 1% monies shall be appropriated to the proper Public Art Fund, for use at other more appro- 7 p riate public sites, unless prohibited by any legal restrictions associated with the source of funds. G. The Art in Public Places Panel shall allocate funds for artwork projects subject to their legality of expenditure according to source. Given the specific use limitation on a wide variety of fund sources (general obligation bonds, revenue bonds, grants, operating budgets, etc •. ), eligibility of expenditure must be determined on a case-by-case basis in con- sultation with the appropriate City Departments. H. The City Manager or .his designee shall authorize all disbursements from the Public Art Funds. V. COMPOSITION AND FUNCTION OF THE ART IN PUBLIC PLACES PANEL A. The Art in Public Places Panel, appointed by the Arts Commission, shall have seven (7) members and serve as a standing committee of the Arts Commission. The Art in Public Places Panel shall be comprised of one representative from the Arts Commission and others as the Commission might appoint. At a minimum the Panel's membership shall include five (5) visual art professionals, two of whom shall be representa- tives from the environmental design fields (archi- tecture, landscape architecture, urban planning/ design). Selection of the panelists shall reflect the ethnic, artistic, economic, and demographic diversity of the community. All panelists shall possess a knowledge of contemporary visual art. Panelists shall serve for no more than one two-year term every five years. The Director of Parks and Recreation or his designee shall serve ex-officio without vote. The Panel shall elect its own Chairman and establish by-laws. Staggered terms shall be provided for by the drawing of lots such that three members of the first panel shall agree to serve for only one year. B. The primary functions/responsibilities of the Art in Public Places Panel are to: 1. Assist the Arts Commission in the promul- gation of guidelines to implement the provisions of the Art in Public Places Ordinance, including methods of selecting artists and commissioning works of art; 8 2. Provide review responsibilities for the provisions of the Art in Public Places Ordinance and its Guidelines; 3. Make recommendations regarding appropria- tions for works of art and art projects, through the Arts Commission, to the City Council or City Manager; 4. Review, on a biennial basis, the artwork projects of the Art in Public Places Program as a reflection of the intent of the Art in Public Places Ordinance and Program. VI . DEVELOPMENT OF AN ART IN PUBLIC PLACES PROJECT Art in Public Places projects may occur in, at, or near public buildings, parks, and open spaces. These may be sites which are under development or existing sites where construction is complete. The Art in Public Places Panel, with the assistance of the Coordinator, shall on an on-going basis actively explore potential sites for Art in Public Places projects. In this, the Panel shall seek the input of various city Departments as well as the community at large, to identify both future planned and existing sites. Once an Art in Public Places project i s developed, information will be disseminated, as appro- priate through the media and mailings, well in advance of the selection process to provide artists adequate time to prepare any necessary submissions. For sites under development, it is preferable to involve the artist in the earliest phases of the design process to ensure a totally integrated solution. Therefore, at the earliest time possible, all City Departments shall · inform the Art in Public Places Panel, through the Coordinator, of proposed or planned eligible construction projects. This will allow the Art in Public Places Panel time to adequately review the project's potential for incorpora- tion of artwork and to plan for an appropriate artwork project. The Department responsible for an eligible construction project shall subsequently keep the Coor- dinator apprised of the selection of the Project Consul- tant. Additionally, provisions for the artwork project shall be appropriately included in the design program for the construction project. The development of an Art in Public Places project and subsequent selection of an artist shall commence immediately upon the selection of the Project Consultant. 9 Once a project i s developed, the Art in Public Places Panel with the Coordinator shall recommend to the Arts Commission, in the form of a written prospectus, the overall approach and selection process for each artwork project. This prospectus will strive for a solution that will allow for the artwork, whether purchased or commissioned, to be appropriate to the particular project site . This prospectus can rrovide for the direct purchase of an existing work(s) of art, the selection of an ar- tist (s) to complete a specific work(s) of art, or the selection of an artist(s) to participate in a design team approach with the project consultant. A. The Art in Public Places Coordinator shall research the background of each eligible project, consulting with the user department, project consultant, project manager, and community representatives. This infor- mation shall be recommended to the Art in Public Places Panel for finalization in the form of para- meters regarding: 1. Recommended format for participation of the artist in the construction project's design process and/or media. 2. Recommended location(s) within the site. s ·i'ting of the artwork may be determined prior to the selection ~f an artist or proposed by the artist selected for the project. In the case of sites under development, it is preferable to allow the artist and the project consultant to coordinate the location of the artwork within the construction project. In the case of existing sites where construction is complete, the final location shall be determined by agreement between the City departments involved and the Art in Public Places Panel, with the appro- priate approval of any Boards or Commis- sions. In either case, whenever possible, the artist selected should be given the opportunity to recommend siting of the artwork. 3. Maintenance assessment of the potential for vandalism and/or accidental damage at the project site. 4. Recommended residency requirements for artists during the course of the project, 10 based on the suggested format for participation of the artist in the design process. B. The Art in Public Flaces Panel shall, with the assistance of the Coordinator, determine the method of artist selection to be used for each project. The method of artist selection employed and the determination as to how that method is to be implemented will depend upon the Panel's overall approach to each project and its commitment to fulfilling all aspects of the stated intent of the Art in ·Public Places Program. l. The Art in Public Places Panel shall establish and the Coordinator shall main- tain an open slide registry for all artists interested in being considered for commis- sions through the Art in Public Places Program. The Slide Registry shall serve as the primary resource in the competitive selection of artists/artworks. 2. The Art in Public Places Panel shall m~intain the following general guidelines regarding the methods of artist/artwork selection which may be employed for a particular project: a. Open Entry Competition -Any artist is eligible to enter, with recognition of the possible residency requirements. The site and prospectus are appro- priately advertised. Artists may be asked to submit slides of their past work, resumes, and letters of intent related to the specific project or specific proposals for the project under review. b. Limited Entry Competition- The jury invites a limited number of artists to parti- cipate in the selection process. The artists selected may be asked to submit slides of past work or proposals based on the project prospectus. The names of the artists invited 11 to participate shall be publicly announced upon receipt of written acceptance of the invitation. c . Direct Selection of the Artist -An art i st is invited to par- ticipate in the project and may be asked to develop a pro- posal for the project. If desired a team of several artists may be put together. d. Direct Purchase of an Existing Art work - A completed work of art is purchased. No more than ten percent of the cost of the work may go toward a dealer or agent. 3. In the case of a limited competition and direct selection, an artist may be asked to develop an artwork proposal for a specific Art in Public Places project. If asked to develop a proposal, an artist may be paid a proposal fee on the basis o~_.an approved fee schedule. This schedule shall be determined by the Art in Public Places Panel and consist of a sliding schedule based on the total project com- mission . c . The Art in Public Places Panel shall determine the jury format most appropriate to each project, to include the number of jurors, the necessary expertise and recommended jurors. D. The Art in Public Places Panel shall then recommend to the Arts Commission, in the form of a written prospectus, the overall approach to the project including the method of artist selection and the format for jury selection. The Arts Commission shall subsequently review and approve the prospectus in an expedient manner (at the next full meeting of the Commission) , so as to ensure the timely selection of an artist. VII . J URY SELECTION AND RESPONSIBILITIES For each Art in Public Places Project an independent j ury of visual art professionals shall be established 12 for the purposes of making an artist/artwork recommen- dation. · The following guidelines shall be used by the Art in Public Places Panel in the development of a jury for each project and in determining the jury's respon- sibilities: A. The Art in Public Places Panel shall establish and the Coordinator·shall maintain a file of potential jurors containing information on the experience and expertise qualifying individuals to serve in this capacity. B. The artist/artwork for each project shall be recom- mended by a jury to the Art in Public Places Panel, with the format for the jury selection approved by the Arts Commission. The Art in Public Places Panel shall have the option of constituting itself as a jury. No gallery owner, dealer, or art agent may serve as a juror due to the potential for con- flict of interest. No juror may serve more than once in any two year period, in an attempt to bring a diversity of interests to the selection process and to more precisely match the expertise of the jury members to each project. · c . The Art in Public Places Coordinator shall facilitate the selection of each jury and subsequently serve as staff to that jury. D. Each jury shall be comprised of either three or five jurors, depending upon the size and complexity of the individual project. E . Each three member jury shall include at least one visual artist, and each five member jury shall include at least two visual artists. Other jurors shall be chosen from among the field of visual art professionals. Additionally, each three member jury shall include at least one local juror, and each five member jury shall include at least two local jurors. F. Each jury shall be aided by a non-voting, advisory panel. This panel shall be appointed by the Art in Public Places Coordinator on a project-by-project basis. The panel shall include at least one person connected with those who will be in constant contact with the facility where the artwork will be placed. This individual (s) may be a City employee or a community representative, depending on the nature of the project. The advisory panel shall also 13 i nclude the project manager, the project consultant, and a representative of the user department. G. Jury payment for professional services rendered shall be determined by the Coordinator, in consul- tation with the Art in Public Places Panel, and recommended to the City Manager or his designee for the approval of disbursement. such contractual payment shall be in keeping with the standards of the field, not to exceed a maximum of $125 per day plus food , travel and lodging expenses. Anyone receiving compensation by the City as either a full-time employee or a separate consultant, members of the Arts Commission who may serve as jurors and any members of _the Art in Public Places Panel who serve as j urors may not receive compensation as a juror. H. The Art in Public Places Panel shall issue written instructions to jurors detailing the jury's duties and responsibilities relating t6 the project, prior to the first meeting of the jury. These instructions shall outline the method by which the jury is to make its selection as well as the technical and aesthetic criteria on which that selection is to be base4. The jury shall adhere to these written instructions and criteria in making its recommen- dation. I. The Coordinator shall, in consultation with the Art in Public Places Panel, determine the overall budget for the selection of an artist and the com- mission of a work of art, prior to the first meeting of a jury. This budget shall be recommended for approval to the City Manager or his designee. This budget shall be based on the scope of the project and the proposed method of selection. Expenses related to the selection of an artist will be kept to a necessary minimum as required by each project. The jury shall adhere to this budget, except in the instance where it is proven to be inappropriate, at which time the initial budget may be altered to accommodate the new conditions, subject to the approval of the City Manager or his designee. J. Each juror shall have one vote, with no juror pos- sessing the right of veto. If a consensus cannot be reached by the jury within a reasonable amount of time, as determined by the Art in Public Places Panel and the Coordinator, then a vote shall be taken with the majority carrying the decision. 14 K. VII I. The jury shall have the option of making no recom- mendation, if there is no proposal judged to be of sufficient rneri t. In such instances the matter shall be referred back to the Art in Public Places Panel for resolution, which may include a new selec- tion process or the abandonment of the project. CRITERIA FOR SELECTION OF ARTISTS AND/OR ARTWORK PROJECTS A. B. c. D. E. All Art in Public Places projects are open to any professional artist, within a project' s possible res id ency requirements as delineated by the Art in Public Places Panel. Members of the Project Consultant's firm or anyone employed thereby, members of the jury, or employees of the City of Austin shall be excluded from considera- tion. Artists shall be selected on the basis of the appropriateness of their proposal to the particular project and its proba- bility of successful completion, as in- dicated by the merit of their past work. In the case of the design team approach, an artist's willingness to fully partici- pate in a collaborative process shall also be considered a criteria for selec- tion. All Art in Public Places Projects are budgeted for a pre-determined amount. In making its selection, the jury shall bear in mind the purposes of the Art in Public Places Program, always aiming to achieve the highest aesthetic quality. The jury shall, in making its selection, give due consideration to the appropriate- ness of the proposed design in terms of its scale, form, content and design with respect to its immediate and general, social and physical environment. The jury shall also give due consideration to the proposed design, its materials and construction for questions of dura- bility, maintenance, public access, appro- priateness, safety, and security. 15 F. The aforementioned criteria are the minimum aesthetic criteria on which the jury shall base its selection. Other criteria may be established by the Art in Public Places Panel as dictated by a project's particular requirements. Any additional criteria shall be outlined in the jury's written instructions . I X. REVIEW OF THE JURY'S SELECTION The jury's recommendation shall be transmitted to the Art in Public Places Panel in the form of a written report. The preparation of this report shall be faci- litated by the Art in Public Places Coordinator. In reviewing the jury's recommendation, the Art in Public Places Panel and the Arts Commission shall take into account the Art in Public Places Program's goal of devel- oping a diverse collection, its commitment to the jury process and the role of the Commission as a bridge between the arts community and the City of Austin. These con- siderations should outweigh individual aesthetic pre- ferences in the Panel's and the Arts Commission's review of the jury's selection. A. As stated in the Ordinance, it is the initial respon- sibility of the Art in Public Places Panel to recom- mend the p l acement of works of art and art projects. The Panel shall review the . jury's recommendation to determine if the process for selection was pro- perly implemented, if the jury responded appropri- ately to the project's prospectus, and if the recom- mendation satisfies the intent of the project. If the Panel determines that the procedure for selection was improperly implemented, the Panel shall have several options including returning the matter to the jury for ·clarification, requesting that the jury recommend a different. artist, developing a new program or convening a new jury panel. Prior to the Panel's recommendation being forwarded to the Arts Commission, the user and managing depart- ments responsible for housing the work shall be requested to view the proposal for technical feasi- bility and maintenance expenses. In cases where legitimate problems are demonstrated to the satis- faction of the Art in Public Places Panel, the jury may be reconvened to select an alternative work. Once the jury's selection is approved by the Art in Public Places Panel, it will be recommended to the Arts Commission for a formal vote. 16 B. The Arts Commission shall review the recommendation of the Panel on the basis of procedural matters, to ensure that the prospectus, as approved by the Commission, was appropriately responded to through the selection process. In the event that the Com- mission has questions regarding the selection pro- cess, those questions shall be referred, in writing, back to the Panel for clarification. c. The Arts Commission's recommendation shall be for- warded to the City Council or the City Manager, as appropriate, in the form of a proposed contract for the purchase or commission of a work of art. The City Manager or City Council shall, in keeping with the City Charter, determine if the proposed contract is consistent with all relevant Ordinances and city purchasing policies. In the instance that the Arts Commission's recom- mendation is disapproved, the matter shall be re- turned to the Arts Commission for further review. X. PROJECT IMPLEMENTATION AND DOCUMENTATION .... r A. Upon approval of the Arts Commission's recommendation by the City Manager or City Council, the City of Austin shall contract with the artist ( s) for services or for the purchase and installation of a specific artwork. In general, Art in Public Places Project contracts shall require the artist(s) to produce, deliver, and install a work of art for a guaranteed maximum cost and by a predetermined time which is in keeping with the construction project schedule. Depending on the nature of the project, performance by the artist may be contractually ensured through phased payment for work completed and/or professional liability coverage. The Coordinator shall work with the artist to determine the appropriate budget for each project to ensure that all necessary costs are met, and the Art in Public Places Panel shall approve the final budget. In addition, the artist may be asked to make a public presentation at an appropriate time and in an appropriate forum in the community where the work is to be sited. B. Prior to the construction of a work of art, the artist must obtain approval of the final design by both the Art in Public Places Panel and the Arts Commission. In the case of an artist who has 17 contracted with the City of Austin to produce a specific work of art, approval of the design prior to the signing of that contract shall be considered sufficient. If, however, the design changes substantially from that which was initially approved, the artist must return to the Panel for subsequent review. The Art in Public Places Panel and Coordinator shall have full authority to determine what constitutes a substantive change in the design. In the case of a design team approach, it shall be the primary responsibility of the artist and the project consultant to collaborate on the design of the artwork and its relationship with the site. The artist shall be required to bring the design, in its formative stages, back to the Art in Public Places Panel for review. This review shall appro- priately parallel the consultant's presentations of schematic, design development, and construction documents to the user and managing departments. The stage at which final approval of the design occurs will vary from project to project, and shall be specifically set out -in the artist's contractual agreement with the City of Austin. c. All pr~ject consultants expressing interest in an eligible construction or renovation project shall be advised of the Art in Public Places Program requirements and guidelines. The consultant selected and appropriate City representatives shall work closely with the Coordinator in the development of the artwork project and with the jury in the selec- tion of the artist/artwork. The consultant shall incorporate the requirements of the work of art into the construction documents, including time of delivery and installation. o. On site activity in connection with the installation of artwork shall be handled by the artist, the Art in Public Places Coordinator, and the appropriate City representatives within the departments having jurisdiction over the site and/or construction. E. The Art in Public Places Coordinator shall function as a liaison between the artist and the various City Departments involved in the completion of each artwork project. In instances where construc- tion matters cannot be resolved between the artist and the consultant, the project manager shall have final authority. 18 F. The Coordinator shall establish and maintain appro- priate records on each project, which shall include the contract with the artist, records of the Panel's and Commission's actions, interdepartmental agree- ments, all billings made in connection with the project and all correspondence related to the pro- ject. In addition, the Coordinator shall maintain records particular to the project to ensure adequate standards of documentation, registration, care, and installation of the artwork. XI . MAI NTENANCE OF WORKS OF ART A . The Art in Public Places Panel shall make an .annual review of the City's Public Art Collection for the purposes of a maintenance needs assessment. The Panel, through the Arts Commission, shall communicate those needs and the appropriate actions required to meet those needs to the various user departments. B . The works of art acquired through the Art in Public Places Ordinance become the property of the City . of Austin and are held in trust by the User Depart- ment. Therefore, the expenses associated with the routine .maintenance and operation of each artwork shall be · incurred by the user department and con- sidered to be part of the routine maintenance of the facility. Routine maintenance shall be under- stood to include such things as the periodic cleaning of a work and operational costs such as water in the case of a fountai~. Any substantive repair of the work, such as structural repair, shall be con- sidered to be an expense of the related Public Art Fund. Per the Ordinance, no maintenance or repair work shall be performed by the user department without the prior written consent of the Art in Public Places Coordinator. Additionally, the user department shall not move any work of art. from the site for which it was selected, nor remove it from display, without the prior written consent of the Arts Commission and in conformance with legal re- strictions regarding the source of funds for that work of art. c . so far as practical, in the event repair of the artwork is required, the City shall give the artist the opportunity to do that work for a reasonable fee. Disputes concerning what constitutes a rea- sonable fee shall be settled by a panel of three visual art professionals with knowledge of curatorial 19 concerns, to be appointed by the Arts Commission. If the artist declines to perform the needed repairs for such a fee, the City may solicit bids from qualified conservators and award a contract to the conservator presenting the lowest and most respon- sible bid, if the fee is in excess of Five Thousand Dollars ($5,000.00). XII. ELIGIBLE COSTS FOR ONE PERCENT MONIES A. All Art in Public Places contracts shall require the artist to design, produce, deliver and install a work of art for a guaranteed maximum cost. This cost may include the cost of the work itself and any associated costs which may be required by the City of Austin or inherently related to the imple- mentation of the project. Therefore the following costs are eligible expenditures for the 1% monies included in the total project commission: 1. The work of art itself, including but not limited to: a .:r Artist's design fee; b. Additional labor, materials, and contracted services required for the production and instal- lation of the work; c. Artist's operating expenses related to the project; d. Travel related to the project; e. Transportation of the work to the site; f. Installation of the work. 2. Identification plaques and labels. 3. Frames, mats, mountings, anchorages, containments, pedestals, or materials necessary for the installation, location or security of the work of art. . 4. Photographs or slides of the completed work for the purposes of routine documen- tation of the project. 20 5. Permits or fees necessary for the instal- lation of the work of art. 6. Legal costs directly related to the pro- ject. B. In addition to the actual costs associated with the Art in Public Places Project commission, the 1% monies are by Ordinance to be used for the selec- tion, acquisition, and maintenance of the works of art commissioned or purchased through the Art in Public Places Program. Therefore the following items are eligible expenditures of the 1% monies: 1. The project specific costs of the Art in Public Places Program associated with the selection and acquisition of artwork. 2. Jury honoraria expended for the purposes of selecting the artwork. 3. Payment for artists invited to submit proposals for a project. 4. Substantive structural repair and main- tenance of the works of art commissioned through the Art in Public Places Program. XIII. I NELIGIBLE COSTS FOR THE ONE PERCENT MONIES A . Directional elements such as supergraphics, signage, or color coding except where these elements are integral parts of the original works of art. B . Art objects which are mass produced of standard design such as playground equipment or fountains. c. Reproductions, by mechanical or other means, of original works of art, except in cases of film, video, photography, printmaking or other media arts. D. Decorative, ornamental, or functional elements which are designed by the building consultant as opposed to an artist commissioned for this purpose. E. Landscape architecture and landscape gardening except where these elements are designed by the 21 artist and are an integral part of the work of art by the artist. F. Services or utilities needed to routinely operate or maintain the artwork over time. G. Project Consultant's fees. H. Modifications in or improvements to building surfaces or structural elements of the building. I. General administrative costs of the Art in Public Places Program, those which are not directly related to a specific project. XIV. THESE GUIDELINES AND THE ART IN PUBLIC PLACES ORDINANCE ARE SUBJECT TO AN ANNUAL REVIEW DATING FROM THE PASSAGE OF THE ORDINANCE. 22 CITY OF AUSTIN ART IN PUBLIC PLACES COLLECTION ARTWORK DONATION GUIDELINES STATEMENT OF PURPOSE The City of Austin desires to establish a diverse Art in Public Places Collection of the highest quality . Although this collection will primarily be established through the City's Art in Public Places Program, it is anticipated that over time some works will be acquired through donations . The City of Austin wishes to encourage such donations to its Art in Public Places Collection , and hereby establishes a set of guidelines and procedures re garding proposed artwork donations. AR1WORK DONATION GUIDELINES It is the policy of the City of Austin to encourage the donation of works of art to its Art in Public Places Collection and all other City collections. In doing so, the City realizes its obligation to preserve the integrity of the overall collection by maintaining its high artistic standards . All donations of public artworks to the City of Austin shall be reviewed by the same standards and meet the same criteria applied to the public art commissions undertaken through the Art in Public Places Program . Therefore, any proposed donation of a work of art to the Art in Public Places Collection must be properly reviewed for artistic merit, context within the collection, site appropriateness, liability questions, and maintenance considerations. Any conditions associated with the proposed donation should be considered, as it is the policy of the City of Austin that generally works of art be acquired without legal or other restrictions as to future use and disposition. A legal instrument, acceptable to the City, transferring title of the work to the City of Austin shall be required in all cases. These guidelines also extend to works of art offered for long-term loan to the C ity of Austin . CRITERIA FOR EVALUATION • The artistic merit of the work of art, including consideration of the work's artistic, social, and/or historical significance. • The compatibility of the work of art within the context of the City's Art in Public Places Collection. • The suitability of the work of art for exhibition, especially as related to its proposed site. Consideration of the work's scale, form, content, color, and design with respect to its immediate and general social and physical environment shall be considered. • The installation, maintenance and storage requirements (including security and humidity control) of the work of art, as indicated by its materials and construction . • The potential liabilities associated with the public display of the work of art, including consideration of security, public access , and safety. • Any conditions imposed on the acquisition by the donor. .... DONATION REVIEW PROCEDURES ART IN PUBLIC PLACES COO RD INA TOR 1. The prospective donor contacts the Art in Public Places Coordinator by calling : (512) 397-1455, or writing : City of Austin, Parks and Recreation Department, Art in Public Places Program , P. 0. Box 1088 , Austin, TX, 78767 . 2 . The Art in Public Places Coordinator shall arrange for the donor and/or artist to make a presentation of the proposed artwork donation to the Art in Public Places Panel at a regular meeting. 3. The Art in Public Places Coordinator may assist the donor in finding an appropriate site and receiving department for the work of art, if necessary. ART IN PUBLIC PLACES PANEL 4 . The donor and/or artist makes a presentation to the Art in Public Places Panel using photographs , slides, model or maquette, documentation, and any other pertinent information related to considering acquisition of the work of art. It is also suggested that the artist's resume and portfolio be presented. 5. The Art in Public Places Panel shall review the proposed donation based on the aforementioned and any other pertinent criteria. 6. The Art in Public Places Panel must determine how any installation costs associated with the work of art and its proposed site are to be financed. 7. If the proposed donation is to commission a work of art, the Art in Public Places Panel and Art in Public Places Coordinator may assist the donor in designing an appropriate selection process, using the Art in Public Places Program Guidelines as a reference. 8. Once a final decision is reached regarding a proposed donation, the Art in Public Places Panel shall forward its recommendation to the Austin Arts Commission, in writing . RECEIVING DEPARTMENT DIRECTOR 9 . The Art in Public Places Coordinator shall contact the receiving City of Austin department Director. The receiving department Director shall review the Art in Public Places Panel recommendation and the proposed site . 10. The Director shall review the safety (liability) and maintenance (budget) issues related to the proposed donation. The Director and/or the Art in Public Places Coordinator may direct questions of liability and maintenance to the matter to the appropriate City of Austin authorities, such as the Risk Management Department or the City Attorney's Office (Scale drawings sealed by a licensed professional structural engineer may be required). 11. The receiving department Director shall forward his/her recommendation to the Austin Arts Commission, in writing. .. AUSTIN ARTS COMMISSION 12 . The Austin Arts Commission shall consider the recommendations of the Art in Public Places Panel and the receiving department Director regarding proposed donation . It is recommended that the donor or his agent be present to answer any question which may arise . OTHER AUSTIN BOARD OR COMMISSION 13 . The Austin Arts Commission shall forward its recommendation, in writing, to any other appropriate Board or Commission (i.e., the Austin Parks Board for donations to th e Parks and Recreation Department). It is recommended that the donor or his agent be present to answer any questions which may arise . AUSTIN ARTS COMMISSION 14 . Upon receipt of the other Board or Commission's recommendation, the Austin Arts Commission shall make its recommendation to City Council, in writing. AUSTIN CITY COUNCIL 15 . Austin City Council considers acceptance of the donation at a regular meeting. It is recommended that the donor or his agent be present to answer any questions which may arise. CITY ATTORNEY'S OFFICE 16 . All donations must be accompanied by a legal instrument of conveyance transferring title to the City of Austin in a form approved by the City Attorney's Office. This instrument should clearly define the rights and responsibilities of all parties involved. RECEIVING DEPARTMENT DIRECTOR 17 . The receiving department Director and/or the Art in Public Places Coordinator shall arrange for installation of the artwork . 18 . The receiving department Director and/or the Art in Public Places Coordinator may arrange a dedication ceremony, if appropriate. MAYOR 19. The artwork donation shall be acknowledged by a letter of appreciation from the Mayor. That Chapter 2, Administration, of the City Code, is hereby amended by amending Division 6, Municipal Arts Commission, by adding thereto a new Section 2-109, to be entitled Municipal Public Art Pro2rw, to hereafter read as follows. Sec. 2-109 Municipal Public Art Program. A. Purpose. The City of Corpus Christi accepts responsibility for expanding the opportunities for its citizens to experience art in public places. The City also recognizes the substantial economic benefits to be gained through the enhancement of tourism. A policy is therefore established to direct the inclusion of works of art in certain City Construction Projects or other City owned properties and to encourage the inclusion of works of art in private developments in the City of Corpus Christi. B. Definitions. "Art Selection Panel" means a committee which may be established by the Commission on an ad hoc basis to assist the Commission in administering, procuring, or incorporating artwork with a particular City Construction Project. "Arterial Street" means streets identified as arterial in the master transportation plan. "City Construction Project" means any capital project paid for wholly or in part by funds appropriated by the City Council of Corpus Christi to construct or remodel a building, parking facility, park, arterial street, sidewalk, or any portion thereof. i "Construction cost" means the to tal City-funded portion of a City Construction Pro ject less Demolition costs. Eq uipment costs. and Real Propeny Acquisition costs . "Demolition costs" means payments for any work needed for the removal of buildings or other existing structures from City property . "Equipment costs" means payments for any equipment or furnishings that are portable and of standard manufacture. Equipment shall not mean items that are custom designed for , or that create a new use for , a facility, whether portable or affixed. "Real Property Acquisition costs" means payments made for the purchase of parcels of land, existing buildings or structures, and costs incurred by the City for appraisals or negotiations in connection with such purchase. "Visual Arts Committee" means a standing committee of the Commission which reviews the suitability of artwork, recommendations of Art Selection Panels, and monitors the continued implementation of the Commission's procedures, guidelines, and recommendations for the Municipal Public Art Program. The Visual Arts Committee shall report directly to and make recommendations to the Commission. "Works of Art" or "Artwork" shall m.~an any form of original, permanent creation of visual art which shall include, but not linu~d to: (a) Paintings of all media such as frescos and murals; (b) Sculptures, in any material or combination of materials, for ornamentation or commemoration such as statutes, monwnents, fountains, arches, bas-reliefs, mobiles, or kinetic, electronic,and neon sculptures; and ( c) Other forms such as inscriptions, stained glass, fiber works, carvings, mosaics, photography, drawings, collages, textile works, prints, or decorative or utilitarian crafts utilizing clay, fiber, wood, metal, glass, stone, plastic, and other materials. C . Funds for works of Art. 1. Allocations. All allocations for funds for City Construction Projects shall include an amount equal to one and one-quarter (1 1/4) percent of the Construction cost. to be used for the selection, acquisition, commissioning, and display of works of art and any other associated costs such as professional fees, community education, insurance, curatorial services , identification, docwnentation and publicity. If the source of funding, applicable law governing any particular project, or the expenditure of such funds precludes art as permissible expenditure, the amount of ii funds so restric ted shall be excluded from the C onstruction c ost. as defined herein. in determinin g th e amount to be allocated as pro v ided herein. City C onstruction Pro j ec ts w ith a Co nstruc t ion c ost o f le s s th an fi fty thousand dollars ($50 .000 ) shall be excepted. and no allocation s hall be made on such projects. Concurrent with the a ppropriation to fund a rel ated C ity C onstruction Project. the C ity C ouncil shall a ppropriate th e funds as specified herein and request the Municipal Arts Commission to appoint an art selection panel for the project. Separate accounts shall be established whenever funds are required to be used at a designated Ci ty Construction Proj ect. Except for the following City Construction Projects approved by voter referendum on April 5, 1986 , namely the Police Station and Municipal Court Facility, Airpon Terminal Interior: Treatment of Ceilings and Lighting and Renovations of Restrooms , Relocation of Fire Station # 1, Development of unimproved Parkland, and the Recreation Center, which shall be subject to the allocations for public art , all future appropriations for the City's Construction Projects previously authorized by bond referendum prior to the effective date of this ordinance shall be exempt from the allocation for public art. L Grant Applications. From the effective date of this ordinance, applications for capital projects to granting authorities shall include, amounts for works of art as specified herein, insofar as permissible by the granting authority. D. Uses of funds. ~- Funds allocated in accordance with this ordinance may be used for the selection, acquisition, purchase, commissioning, placement, installation, exhibition or display of works of art. The works of art shall be permanent, may be integral to the architecture, or may be placed in , on, or about a City Construction Project or other City property . To the extent practical , artist selection should be concurrent with selection of the architect or designer, to ensure integration of the artwork into the project architecture. In the event that a particular City Construction Project is deemed inappropriate for the placement of artwork by the Municipal Art Commission, if not otherwise prohibited by law, the funds appropriated for artwork shall be used at other more appropriate public sites . E. Municipal Arts Commission Responsibilities. L Pro~am Administration. The Commission shall be responsible for advising the City Manager and the City Council on all aspects of the administration of the Municipal Public A.rt Program, including establishing policies and guidelines, designating sites , determining project budgets, selecting artists and commissioning artworks, reviewing the design, execution and placement of works of art and the removal of works of art from the City collection. iii The Co mmiss io n shall also d irect appropriate cmzen invol vement in the selection process . Such activities may include . but ar e nor lim ited to exhi bitions. workshops. artist res idencies . dedications. and other programs designed to in sure public acceptance and enjo yment of the artworks. ~ Art Sele ction Panels-When requested by the City C o uncil the Commission shall appoint . .\n Selection Panels to ut ilize professionals in the visual arts and design fields as part of the artwork selection process to ensure artwork of the highest quality. Each panel shall have voting and non-voting members as prescribed by the guidelines and rules of the Commission. The Art Selection Panels shall include members of the Commission and others . It is within the sole discretion of the Commission to select persons to be appointed to an art selection panel. .1. Maintenance -The Commission shall require that any recommended work of art needed extraordinary operation or maintenance costs be accompanied with a fiscal note, detailing such extraordinary costs. Maintenance of the artwork under the various City department's care shall be the responsibility of those departments , provided that, all repairs and maintenance of artworks by City departments or any other person or agency shall have the prior consultation with the Commission. Such repair and maintenance shall ~Q!Ilply with any contractual obligations which may have been entered into upon th'e. acquisition of those artworks. The Commission shall, at least annually, conduct a survey of the entire City-owned artwork collection. Such survey shall be submitted to the City Council and shall include a review of the condition of each artwork in the collection and shall contain -----~ recommendations for the care and maintenance of the artworks, along with the estimated cost thereof. Annually, the City Council shall make available such sums for the maintenance of the City collections as it deems appropriate. ~ Gifts and Donations. The Commission shall have further responsibility for reviewing and recommending for approval any artworks proposed to be donated to the City. The Commission shall establish such policies and guidelines as may be appropriate to facilitate and encourage the donation of works of art of high quality to the City. 5... S!yk.. The public art program is not intended to support exclusively works of art of any particular school , style , taste or medium. The Commission shall ensure that, over time , the City collection shall represent a broad range of artistic styles , taste and media. i v SECTION 2. PURPOSE: These · policies and guidelines are adopted by the Corpus Christi Municipal Arts Commission for the purpose of establishing procedures for implementing Ordinance No. 19663, passed by the City Council of Corpus Christi and signed into law March l 0, 1987. II. INTENT: The stated intent of the Ordinance is for Corpus Christi to accept "responsibility for expanding the opportunities for its citizens to experience art in public places" and to "recognize the substantial economic benefits to be gained through the provision of cultural amenities." The City will accomplish these goals through: A. The placement of works of art of a varie~ 9-L~tyles and media 8. An equitable distribution of commissions of works of art among artists, local , regional and national. C. Collaboration between artists and architects/landscape architects/engineers. D. Enhancement of the creative environment for artists in Corpus Christi. E. Selection of artists based upon qualifications. III. DEFINITIONS: A . Arts Selection Panel: an ad hoc committee appointed by the Municipal Arts Commission. 8. Visual Arts Committee: a standing committee of the Municipal Arts Commission. C. Works of art: For the purposes of these guidelines, all forms of original visual art are eligible for consideration. 1 IV. ALLOCATION OF FUNDS: A. Procedures : 1. The Muni ci oal ,.:\rts C ommission shall review a ll capital projects and a ppropriations to identi fy e ligible projects and to confirm that monies have been allocated to the Permanent Art Trust F und o r to the appropriate project account. .., All City depamnents and agencies shall be responsible for including a request for 1-14 % for art allocation in all grant requests for capital improvements, unless specifically excluded from pertinent grant program guidelines. B. Inclusions: In addition to the acquisition of works of art, up to twenty percent (20%) of the p ublic art monies may be spent for the following purposes : I . Project administration and staffing. 2. Artist selection, design fees and selection panel honoraria. ··· ... n ·. 3. Architect's fees incurred as a result of the art project. 4. Community education programs , dedications and publicity. 5. Identifying plaques. 6. Insurance. 7. Curatorial services. C. Ineligible Costs 1. Directional elements such as supergraphics, signage, or color coding except where these elements are integral parts of the original work of art. 2. "Art objects " which are mass produced of standard design such as playground equipment, fountains , or statuary objects . 3. Reproductions , by mechanical or other means, of original works of art, except in cases of film , video , photography, printmaking or other media arts . 4. Be responsible for appropriating funds for works of art . 2. Have final approval of contracts with selected artists . B. The Corpus Christi Municipal Arts Commission shall: 1. Have overall responsibility for the program, including policy and project oversight. 2. Annually review the overall program . 3 . Act on recommendations of th~·-Vi'Suat Arts Conunittee, regarding the allocation of monies within projects, and composition of the art selection panels. 4. Confirm the art selection panel's choice of artist or artwork. 5. Reserve the right to establish whatever eligibility and/or residency requirements it deems appropriate. C. The Visual Arts Committee of the Municipal Arts Commission shall: 1. Review each project and recommend a budget for art. 2. Recommend art selection panel members and generally oversee the panel's work. 3. Recommend the method of selection for each project. 4. Develop for most projects a concise written charge to the art selection panel , discussing the objectives and parameters of the project and what is expected for the art, providing thereby a context within which the selection process may occur without limiting the art or artists the panel may consider. 3 ' Take appropriate steps to ensure that local and regional mists are given due considerauon in every project. 6. Review and make a recommendation to the Commission on the basis of the selection panei 's recommendation . 7. Recommend public an policy and procedure to the Municipal Arts Commission. 0. The Art Selection Panel shall: l. Be composed of: a. Voting members: (1) Two representatives from the neighborhood for which the work will primarily serve. Neighborhood may be defined as resident or user, member of neighborhood organization. Friends, Auxiliary or cognizant Board. The respective cognizant Board or organization will be asked to submit recommendations to the Municipal Arts Commission for these appointments to the Art Selection Panel. (2) Two visual art professionals (artist, curator, collector, designer, etc.) (3) Member of the Municipal Mrcomrnission, who will vote only in the case of a tie. b. Non-voting members: ( 1) The project design architect or, if not available, another qualified design architect. (2) One departmental representative (the City department head or his/her designee from where the work will be sited), or in the case of non-City institution on City property, a director or an administrative head. 2. Be chaired by the Municipal Arts Commission member and facilitated by Staff Administrator. 3. Meet as often as necessary in open session. 4. Return to the Municipal Arts Coinnmsion for review and approval should any significant change occur in the scope, color, material, design or siting of the work. subsequent to preliminary design approvru. 5. Be responsible for all phases of the design and execution of the work. including installation, unless otherwise stipulated in the contract. 6. Make a public presentation, if requested, at an appropriate time and appropriate forum in the community where the work will be placed. VI. SELECTION OF ARTISTS: A. Eligibility requirements for each project will be established by the Visual Arts Committee. 1. Artists will be selected on the basis of their qualifications , as demonstrated by past work, appropriateness of the proposal to the particular project, and its probability of successful completion. 2. Limited competition: Artists will be invited by the Selection panel to submit a proposal. C . Criteria for selection of artists or works of art: 1. Quality: Of highest priority is the inherent quality of the work. 2. Media: All visual art forms may be considered, subject to any limitations set by the selection panel or the Municipal Arts Commission. 3. Style: Artworks of all schools, style and tastes should be considered for the City collection. r,-· 4. Nature: The art should appropriate in scale, material, form, and content for both the immediate and general, social and physical environment into which it is to be placed . 5. Permanence: Due consideration will be given to structural and surface integrity, permanence, and protection against theft, vandalism, weathering, excessive maintenance, and repair costs. 6. Elements of design: The artist and the selection panel will take into account that public art may have considerations other than the aesthetic, including that it may serve to _establish focal points, terminate areas, modify, enhance or define specific spaces, or establish identity. 7. Public Liability: Each work will be examined for unsafe conditions or factors that may bear on public liability. 8. Diversity: The overall program will strive for diversity of style, scale, media, artists and geographic distribution of the works of art throughout the City . 6 VII. To insulate the deaccessioning process from fluctuations in taste-whether on the pan of the Corpus Christi Municipal Arts Commission, the City Council, or on the pan of the public. _ II. POLICY STATEMENT: --. ,..,_. The Corpus Christi Municipal Arts Commission desires to have a diverse art collection of the highest quality. The processes of acquiring works and disposing of them should reflect that desire. To that end, at least once in every five years, every artwork in the Corpus Christi collection will be evaluated for the part that it plays in that collection. Because the Corpus Christi Municipal Arts Commission has the responsibility for conserving the City collection, and because the disposal of artworks may have serious implications for the artists, deaccessioning should be a deliberate and seldom-used procedure. It is the policy of the Corpus Christi Municipal Arts Commission not to dispose of works simply because they are not currently in fashion and not to dispose of works whose worth might not yet be recognized. In any event, no work of art will be deaccessioned within five years after acquisition. III. DEFINITIONS: A. ACQUISITION: The inclusion of an artWork in the permanent collection of Corpus Christi, whether the acquisition be by commissioning, purchase, donation. or any other means. B. DEACCESSIONING : The indefinite removal of an artwork from permanent 8 display, whether it is dispos ed of or not. C. Consistent with the goals of the Corpus Christi Municipal Art Commission, and its various programs. acquisitions should be directed toward works of art of the highest quality . B. The acquisition of an artwork by the City of Corpus Christi implies a commitment to its preservation, protection and display for the public benefit. C. Acquisition of an artwork by the City of Corpus Christi should imply its permanency within the City's collection. as long as it retains its physical integrity, identity, and authenticity, and as long as it remains useful to the purposes of the people of Corpus Christi. D. In general, works of art should be acquired without legal or ethical restrictions as to future use and disposition, except with, _ _respect to copyrights and certain clearly defined residual rights that are part of contracts ~th artists. E. The acquisition procedures should insure that the interest of all concerned parties are represented, including the public, the arts community, and the receiving department. F. A legal instrument of conveyance, transferring title of the artwork and clearly defining the rights and responsibilities of all parties, should accompany all acquisitions. Complete records of accession should be made and maintained for all arrworks acquired. V. DEACCESSIONING POLICY: A. At least once in every five-year period, the entire Corpus Christi collection should be evaluated, whether by the Commission, or by an independent agent. B. Conditions: A work of art may be considered for deaccessioning if one or more conditions such as the following apply: l. It is of clearly inferior quality. 2. The Visual Arts Committee of the Corpus Christi Municipal Art Commission may initiate deaccessioning by a majority vote of its members. D. Deaccessioning Procedures : 1. Deaccessioning Procedures shall be before the Visual Arts Committee of the Corpus Christi Municipal Arts Commission, or before a j ury appointed by the Visual Arts Committee. a. Proceedings shall be open to the public and shall be publicized. b . Art ists whose work is being considered for deaccessioning will be 1 0 notified by reasonable means and shall be invited to speak. c. The displaying deparunem will be notiried by reasonable means and s hall be invited to speak . ..., \1unicipal .-\rt Commission staff shall prepare a report. including: a. Reasons for the suggested deaccessioning. b. Opinion of the legal department. c. Acquisition method and cost. d. Public and department feedback on the work. g. Suggested and alternate courses of action. E. Counes of Action The Visual Arts Committee may recommend any of the following courses of action as a result of a deaccessioning review. The committee shall not be limited to these courses of action, but may suggest new methods as may be demanded by a panicular set of circumstances. 1. Relocate the work of art. (This method shall be given highest priority.) ··-· ,.,_. 2. Sell or trade the work of art. a. Seek bona-fide appraisal and advertise sale. b. Seek competitive bids. c. Dispose of the work through City surplus property procedures. 3. Remove the work from display (store the work). F. Proceeds l. Fifteen percent ( 15%) of the appreciated value of the work will be given to the artist who created the work, provided: a. that was a condition of the agreement with the anist, b. the artist can be located by reasonable means, and c. the work was sold (as opposed to other means of disposal). 2. To maintain high artistic standards in the Corpus Christi art collection. II. POLICY: When gifts or donations are proposed for the commissioning or placement of works of art with any City department, the proposal will be reviewed by the Corpus Christi Municipal Arts Commission for artistic merit, context in the City collection, site appropriateness, and City liability, including maintenance. A donation shall include artworks placed on long-term loan. · -,,-. III. DEFINITIONS: A . DONOR is any person , group of persons, or organizations, which proposes to donate artworks or money for the commissioning of artworks to the City of Corpus Christi. B. VISUAL ARTS COMMITrEE is a standing committee of the Corpus Christi Municipal Arts Commission which reviews the suitability of visual arts proposals and advises the Municipal Arts Commission on their acceptance. C. REVIEW COMMITTEE is an ad-hoc committee appointed by the Municipal Arts Commission. D. RECEIVING DEPARTMENT is a City department owrung or managing a potential site for the placement of donated work of art. IV. RESPONSIBILITIES: After the potential donor discusses with the Visual Arts Committee the general nature of the gifts and acceptance procedures established by this policy, the following responsibilities apply: 12 .-.\. Design a selection process, working with the donor, when the donation is to commission work of art. C. The donor shall: 1. Investigate potential sites for placement of the work of art with the Review Committee. rr-· 2. Provide information as necessary to assist the Receiving Department in developing cost estimates for the installation and maintenance, and data on the technical feasibility of placing the work of art at a particular site. D. The Municipal Arts Commission administrator shall: 1. Provide information on City procedures for the acceptance of gifts. 2. Provide staff support for meetings and the selection process. 3. Prepare documents for the acceptance of the gift, as necessary. E. The Review Committee shall: l. Be composed of: a. Two representatives from the neighborhood for which the work will primarily serve. Neighborhood may be defined as resident or user, member of neighborhood organization, Friends, Auxiliary or cognizant Board. The respective cognizant board or organization will be asked to submit recommendations of the Municipal Arts Commission for these appoinnnents to the Art Selection Panel. b. Advise the Visual Arts Committee on the suitability of the work of art and its proposed site. 5. Develop a prospectus and serve as the jury in selecting an artist, in the case of donations for commissioning of works of art. F . The Receiving Department shall: 1. Designate a staff person to participate in the identification of a site for the proposed work and to develop cost estimates for installation and maintenance and data on technical feasibility, as necessary . This person may also be a member of the Review Committee if so designated by the Municipal Arts Commission. 2. Notify the Municipal Arts Commission of a potential gift or donation and advise if a neighborhood organization, cognizant Board, or other City department should be involved in the -process of acceptance of a work of art. 3. Review and approve the final gift proposal. 4. Supervise the placement of the artwork. G. The Corpus Christi City Council shall have the final authority to accept or reject donated works of an on behalf of the City upon recommendation of the Municipal Arts Commission . 1. The City shall accept works of art only when accompanied by a legal instrument of conveyance, enumerating the conditions of the gift, if any. 2. In general, gifts should be accepted without restrictions as to future use or disposition. V. PROCEDURE: A. The donor notifies the Corpus Christi Municipal Arts Commission of the desire to donate an artwork to the City. B. The donor and Municipal Arts Commission administrator meet to discuss the nature of the gift and acceptance procedures. 14 C. Th e Municipal Arts Co mmission appoints a Rev ie w Co mminee. D. Th e Re\'i ew Co mm inee and the Do no r inves tig ate potent ial sit es and recommend a suitable site for placement of the anwork to the V isual Arts Comminee and advise the Comminee o n the suitability o f the anwork fo r acceptance. E. The Visual Ans Comminee reviews the anwork or proposal and the suggested site for suitability , and recommends acceptance or re j ection o f the proposal to the Municipal Arts Commission . F . If the Committee recommends acceptance , they first direct staff to contact the Receiving Department to obtain approval for installation of artwork. G. The Municipal Arts Commission, at its regular monthly meeting, will vote to recommend acceptance or rejection of the work by a majority vote of its members , and transmit that recommendation to the City Counc il. H. The City Council shall accept or reject the work. I. If the work is accepted : 1. Municipal Arts Commiss!9n ,;_~ will prepare an instrument of transfer of title . 2. The Receiving Department will oversee the installation of the work. 3. Inclusion of an artwork in the Corpus Christi collection will imply its permanency within the collection and its long term care and maintenance . VI. EXEMPTIONS: A. 1bis policy shall not apply to City-owned or City-operated Museums but shall apply to all other City departments , agencies , boards or commissions. B. 1bis policy shall not apply to works of art located in administrative offices , lounges or other spaces used infrequently by the public . OBJECTIVE: A. To insure regular maintenance to City-owned anworks. B. To provide for the regular inspection of City anworks. C. To establish a regular procedure for effecting necessary repairs to City artworks. II. POLICY: A. Artworks within the Corpus Christi Collection shall be maintained in the best possible condition. B. Artworks within the Corpus Christi Collection shall be examined for condition and location regularly . C. When City artworks require maintenance or repairs, the Corpus Christi Municipal Arts Commission shali' pr8Vide for such, within its own means, or through the department that houses the work of art. III. RESPONSIBILITIES: A. Artist 1. Within the terms of the contract. the artist shall guarantee and maintain the work of art against all defects of material or workmanship for a period of one year following the installation. 2. Within the terms of the contract, the artist shall provide the Corpus Christi Municipal Arts Commission with drawings of the installation and with detailed instructions regarding routine maintenance of the artwork. 3. Within the terms of the contract. all repairs and restorations which are made during the lifetime of the artist shall have the mutual agreement of the City and the artist and, to the extent practical, the artist shall be given the opponunity to accomplish such repairs at a reasonable fee. B. Agency: 1. The Municipal Arts Commission or the City or Corpus Christi holds that the freedom to create is an integral pan of the constitutional guarantee to the freedom of speech. The freedom of choice in selecting subject matter and media is a necessary safeguard for the freedom of artistic expression and the flowering of unfettered artistic creation. This freedom to create without fear of censorship shall be protected. --. ~- The Municipal Arts Commission further believes that citizens shall have the right of access to and the right to free inquiry into the arts in their community. Citizens shall have the equally important right of forming their own opinions about the arts.
