Call meeting to order. Acting Chairperson Collins called the meeting to order at 6:00 p.m. 2. Agenda Items 2.1. Consideration, discussion, and possible action to approve meeting minutes: • August 5, 2025 Board Member Martinez moved to approve the meeting minutes from August 5, 2025, Board Member Hacker seconded the motion, the motion passed 4-0. 2.2. Public Hearing, presentation, discussion, and possible action regarding a front setback variance to the Unified Development Ordinance Section 5.2.A. ‘Dimensional Standards for Non-Clustered and Clustered Developments’, for the property located at Southwood Valley Phase 8A, Block 29, Lot 32 generally located at 3011 Bluestem Drive. The subject property is zoned GS General Suburban. Case #AWV2025-000027 Senior Planner Howell presented the item to the Board and stated that the applicant is requesting a 25-foot reduction to the minimum 25-foot front setback. Staff recommended denial of the request due to the fact that it does not meet the specified criteria. Specifically: 1. There are no extraordinary conditions affecting the land depriving the owner of its use. 2. The granting of a variance is not necessary for the enjoyment of a substantial property right. 3. The hardship is a result of the applicant’s own actions. September 2, 2025 Zoning Board of Adjustments Minutes Page 2 of 4 4. The application of the UDO would not effectively prohibit or unreasonably restrict the utilization of the property. 5. The granting of a variance would result in a detriment to public health, safety & welfare, or injurious to other property, or to the City in administering this UDO. Board Member Martinez asked if the home currently has a garage. Senior Planner Howell confirmed that the home does not currently have a garage. Board Member Martinez asked if the homeowners were notified that they would need a license to encroach if the variance was granted. Senior Planner Howell confirmed that the homeowners were notified that a license to encroach would be required if the variance was granted. Board Member Hutchins asked if the house was originally built with a garage. Senior Planner Howell clarified that records are not clear if the house was originally built with a garage, stating that the house has been in this configuration since at least 2007. Caleb Bartel, Applicant, Reach Design and Construction, was available to address and answer questions from the Board. Acting Chairperson Collins opened the public hearing. Nadia Riplinger, Occupant, 3011 Bluestem Drive, College Station, was available to address the Board. Acting Chairperson Collins closed the public hearing. There was general discussion amongst the Board regarding clearly defined regulations and criteria within the UDO. Board Member Martinez motioned to deny the variance as it will be contrary to the public interest, and that the approval was within the Zoning Board of Adjustment’s jurisdiction, Board Member Hacker seconded the motion, the motion to deny passed 4-0, the variance was denied. 2.3 Public Hearing, presentation, discussion, and possible action regarding a height variance to the Airport Zoning Ordinance for the property located at Tauber, Block 1, Lot 4 Thru 9 & Associated BPP being 1.28 Acres generally located at 550 Cross Street. The property is zoned NG-1 Core Northgate. Case #AWV2025-000094 Staff Planner Schrum presented the item to the Board and stated that the applicant is requesting a 177.4-foot height variance for the use of a temporary helper crane. September 2, 2025 Zoning Board of Adjustments Minutes Page 3 of 4 Staff recommended approval of the request due to the fact that it meets the specified criteria. Specifically: 1. A literal application or enforcement of the regulation would result in practical difficulty or unnecessary hardship. 2. The granting of the relief would result in substantial justice being done. 3. The granting of the relief would not be contrary to the public interest. 4. The granting of the relief would be in accordance with the spirit of the regulation. Acting Chairperson Collins opened the public hearing. No visitors spoke. Acting Chairperson Collins closed the public hearing. Board Member Martinez motioned to approve the variance as it will not be contrary to the public interest, the fact that the Federal Aviation Administration (FAA) and Texas A&M University did not have concerns, and that the approval was within the Zoning Board of Adjustment’s jurisdiction, Board Member Hutchins seconded the motion, the motion passed 4-0. 2.4 Public Hearing, presentation, discussion, and possible action regarding a height variance to the Airport Zoning Ordinance for the property located at 100 Church Ave Subdivision Block 1, Lot 1 generally located at 100 Church Avenue. The property is zoned NG-1 Core Northgate. Case #AWV2025-000092 Administrator Macias presented the item to the Board and stated that the applicant is requesting a 96-foot height variance for the use of a temporary helper crane. Staff recommended approval of the request due to the fact that it meets the specified criteria. Specifically: 1. A literal application or enforcement of the regulation would result in practical difficulty or unnecessary hardship. 2. The granting of the relief would result in substantial justice being done. 3. The granting of the relief would not be contrary to the public interest. 4. The granting of the relief would be in accordance with the spirit of the regulation. Any deliberation shall be limited to a proposal to place the subject on an agenda for a subsequent meeting. There was no discussion on future agenda items. 4.Adjourn.
