Consideration, discussion, and possible action to approve meeting minutes: • August 5, 2025 Board Member Martinez moved to approve the meeting minutes from August 5, 2025, Board Member Hacker seconded the motion, the motion passed 4-0. 2.2. Public Hearing, presentation, discussion, and possible action regarding a front setback variance to the Unified Development Ordinance Section 5.2.A. ‘Dimensional Standards for Non-Clustered and Clustered Developments’, for the property located at Southwood Valley Phase 8A, Block 29, Lot 32 generally located at 3011 Bluestem Drive. The subject property is zoned GS General Suburban. Case #AWV2025-000027 Senior Planner Howell presented the item to the Board and stated that the applicant is requesting a 25-foot reduction to the minimum 25-foot front setback. Staff recommended denial of the request due to the fact that it does not meet the specified criteria. Specifically: 1. There are no extraordinary conditions affecting the land depriving the owner of its use. 2. The granting of a variance is not necessary for the enjoyment of a substantial property right. 3. The application of the UDO would not effectively prohibit or unreasonably restrict the utilization of the property. 5. Board Member Martinez asked if the home currently has a garage. Senior Planner Howell confirmed that the home does not currently have a garage. Board Member Martinez asked if the homeowners were notified that they would need a license to encroach if the variance was granted. Senior Planner Howell confirmed that the homeowners were notified that a license to encroach would be required if the variance was granted. Board Member Hutchins asked if the house was originally built with a garage. Senior Planner Howell clarified that records are not clear if the house was originally built with a garage, stating that the house has been in this configuration since at least 2007. Caleb Bartel, Applicant, Reach Design and Construction, was available to address and answer questions from the Board. Acting Chairperson Collins opened the public hearing. Nadia Riplinger, Occupant, 3011 Bluestem Drive, College Station, was available to address the Board. Acting Chairperson Collins closed the public hearing. There was general discussion amongst the Board regarding clearly defined regulations and criteria within the UDO. Board Member Martinez motioned to deny the variance as it will be contrary to the public interest, and that the approval was within the Zoning Board of Adjustment’s jurisdiction, Board Member Hacker seconded the motion, the motion to deny passed 4-0, the variance was denied. 2.3 Public Hearing, presentation, discussion, and possible action regarding a height variance to the Airport Zoning Ordinance for the property located at Tauber, Block 1, Lot 4 Thru 9 & Associated BPP being 1.28 Acres generally located at 550 Cross Street. The property is zoned NG-1 Core Northgate. Case #AWV2025-000094 Staff Planner Schrum presented the item to the Board and stated that the applicant is requesting a 177.4-foot height variance for the use of a temporary helper crane. Board Member Martinez motioned to approve the variance as it will not be contrary to the public interest, the fact that the Federal Aviation Administration (FAA) and Texas A&M University did not have concerns, and that the approval was within the Zoning Board of Adjustment’s jurisdiction, Board Member Hutchins seconded the motion, the motion passed 4-0. 2.4 Public Hearing, presentation, discussion, and possible action regarding a height variance to the Airport Zoning Ordinance for the property located at 100 Church Ave Subdivision Block 1, Lot 1 generally located at 100 Church Avenue. The property is zoned NG-1 Core Northgate. Case #AWV2025-000092 Administrator Macias presented the item to the Board and stated that the applicant is requesting a 96-foot height variance for the use of a temporary helper crane. Staff recommended approval of the request due to the fact that it meets the specified criteria. Specifically: 1. A literal application or enforcement of the regulation would result in practical difficulty or unnecessary hardship. 2. The granting of the relief would result in substantial justice being done. 3. The granting of the relief would not be contrary to the public interest. 4. The granting of the relief would be in accordance with the spirit of the regulation. To install the utility poles that will sit 53 feet high, the applicant shows that the crane is no taller than 150’, resulting in it being 471 and 474 feet Above Mean Sea Level (AMSL) on the two sites. Per the Airport Zoning Ordinance for Easterwood Airport, the maximum height limitation for this area varies as it is on a gradient. With respect to the encroachments identified through the FAA documentation, the applicant is requesting height variances for the mobile crane of 56 and 63 feet, respectively, for the sites to the south and north of SH-47. ORDINANCE INTENT: The purpose of the Airport Zoning Ordinance is to establish clear and unambiguous regulations for the protection of the lives and property of users, owners, and occupants of and in the vicinity of Easterwood Field Airport and for the protection of airport operations. RECOMMENDATION: Staff recommends approval of the variance request. A literal application or enforcement of the regulation would result in practical difficulty or unnecessary hardship. 2. The granting of the relief would result in substantial justice being done. 3. The granting of the relief would not be contrary to the public interest. 4. The granting of the relief would be in accordance with the spirit of the regulation. The board may impose any reasonable conditions on the variance that it considers necessary to accomplish the purpose of airport zoning. The variance request is to allow for an increase in maximum height for a mobile crane installing two utility poles just off SH-47. The height variance requests of 56 feet for EX6 and 63 feet for EX7 will enable the use of the crane for the work required to install the proposed utility poles. The overall utility pole heights will sit at a maximum of 374’ Above Mean Sea Level (AMSL) and 377’ Above Mean Sea Level, or 53’ Above Ground Level (AGL). The crane will need to sit at a maximum of 471’ AMSL for EX6, and 474’ AMSL for EX7, or 150’ Above Page 8 of 38 Zoning Board of Adjustment Page 3 of 3 October 7, 2025 Ground Level. The FAA has determined that there is no hazard to air navigation present for either location, and it has also determined that there is no hazard to Air Navigation for temporary structures for the crane. In consultation with the EAM team, the TAMU System has no objections to the granting of a variance for the use of the mobile crane. Allowing the height encroachment for the crane would result in substantial justice being done. The relief would not be contrary to the public interest, as it has been deemed acceptable by the FAA, Easterwood Airport, and the TAMU System, with additional safety precautions and communication processes between the applicant and airport required. The relief would be in accordance with the spirit of the regulation to allow development while protecting lives, property, and airport operations. STAFF RECOMMENDATION After reviewing the request and the related criteria, the information provided by the FAA, EAM, and TAMUS staff recommends approval of the request. The granting of the variance would result in substantial justice being done without being contrary to the public interest, and the spirit of the regulation remains. ATTACHMENTS 1. Any changes in coordinates, heights and frequencies or use of greater power, except those frequencies specified in the Colo Void Clause Coalition; Antenna System Co-Location; Voluntary Best Practices, will void this determination. Any future construction or alteration, including increase to heights, power or the addition of other transmitters, requires separate notice to the FAA. Based on this aeronautical study, the structure would not constitute a substantial adverse effect on aeronautical operations or procedures because it will be temporary. The temporary structure would not be considered a hazard to air navigation provided all of the conditions specified in this determination are strictly met. As a condition to this Determination, the structure is to be marked/lighted in accordance with FAA Advisory circular 70/7460-1 M Change 1, Obstruction Marking and Lighting, flags/red lights-Chapters 3(Marked),4,5(Red),14(Temporary),&15. Any failure or malfunction that lasts more than thirty (30) minutes and affects a top light or flashing obstruction light, regardless of its position, should be reported immediately to (877) 487-6867 so a Notice to Airmen (NOTAM) can be issued. As soon as the normal operation is restored, notify the same number. As a condition to this determination, the temporary structure must be lowered to the ground when not in use and during the hours between sunset and sunrise. It is required that the FAA be notified 3 business days prior to the temporary structure being erected and again when the structure is removed from the site. Notification is necessary so that aeronautical procedures can be temporarily modified to accommodate the structure.
