ORDINANCE NO. 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, REPEALING AND TERMINATING THE FRANCHISE AGREEMENT WITH, ORDINANCE NO. 2011 -3352 WITH CCAA, LLC DB /A BCS STOP AND GO POTTIES FOR THE COLLECTION OF DEMOLITION AND CONSTRUCTION DEBRIS FROM RESIDENTIAL SITES, OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BE REPEALED AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of College Station, by ordinance, provides exclusively all solid waste collection and disposal services for solid waste generated from within the corporate limits of the City of College Station; and WHEREAS, the City of College Station may, by ordinances and charter, grant franchises to other entities for the use of public streets, alleys, and thoroughfares within the corporate limits of the City of College Station and for the collection and disposal of solid waste generated from within the corporate limits of the City of College Station; and WHEREAS, the City may enter into a new franchise agreement with CCAA, LLC for the collection of demolition and construction debris; and WHEREAS, the City will repeal and terminate, Franchise Agreement Ordinance No. 2011- 3352, with CCAA, LLC d/b /a BCS Stop `N Go Potties, as according to the Franchise Agreement and City Charter agreement; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That the City Council hereby repeals and terminates Franchise Agreement Ordinance No. 2011 -3352 with CCAA, LLC d/b /a BCS Stop N' Go Potties according to Article XXVI of the Franchise Agreement and Article XI of the City Charter. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way affect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 3: That this Ordinance becomes effective immediately upon passage by the City Council. ADOPTED this 25' day of 04460- , 2012.
