HomeMy WebLinkAbout10/29/1958 - Regular Minutes - City CouncilMINUTES OF RECESSED MEETING October 29, 1958 Members present: Mayor Langford; Councilmen Anderson, Boyett, Landiss, McCall, Orr, Sorrels; City 'Engineer Benson; City Manager Boswell; City Attorney Dillon. Visitors present: Dr. F. L. Thomas and Mr. J. V. Perry. Purpose of meeting was to petition the Board of Water Engineers that an allocation of 9,000 acre feet of water per annum be set for the city of College Station, etc., and adopt a policy on street construction. It was moved by Councilman Orr, seconded by Councilman Landiss, that the city request that a petition be filed with the Board of Water Engineers that an allocation of 9,000 acre feet of water per annum be set aside for the city of College Station for municipal purposes from any water impounded in a reservoir by construction of a.dam on the Navasota River at some point in the approximate area from the mouth of the river to the 31st parallel of latitude, and that the mayor of the city of College Station be authorized to execute a petition to the Board of Water Engineers for this purpose. AYES: ALL, NOES: NONE. On motion by Councilman Anderson, seconded by Councilman Orr, the fol- lowing policy of street construction was adopted: CITY OF COLLEGE STATION POLICY ON STREET CONSTRUCTION Adopted October 29, 1958 1. The city council will establish an order of priority for street construction. Order of priority will be based on recommendations submitted to the council by the city manager and the city engineer by January 1, 1959. 2. The city council will establish lengths of street sections for all street construction. Lengths will be based on recommendations submitted to the council by the city manager and the city engineer. Lengths of street sections may be one or two blocks or six or more blocks. The principal factor in determining such lengths will be the question of drainage. Another condition will be that of an operable unit to keep con- struction costs as low as possible. 3. For the period between the date of adoption of this policy and January 1, 1959, the council will consider petitions from property owners for street construction. Streets with curbs and gutters may be required where right-of-way widths make such necessary in order to provide adequate drainage (for example: a 27 -foot street in a 30 -foot right-of-way), or to provide ample traffic lanes (in primary streets of 37 -foot width). Base of such streets will be six inches thick finished with one inch of asphalt surface. Storm water inlets and storm drains may be constructed as required. The cost of construction to property owners for this type of street will be $3.00 per front foot. 5. As a public necessity (because of problems of drainage, etc.) streets with curbs and gutters may be constructed by the city under the powers vested in it without the consent of owners of property abutting on a street section. All owners of property in such cases will be required to pay the assess- ment of $3.00 per front foot. (The council goes on record as being opposed to exercising this power except when necessary for the protection of property or for the general welfare of the city). 6. Under any construction program in a given street section, curbs and gutters may be constructed when the council is petitioned by 70 percent of the front foot property owners; dependent, however, upon availability of funds and the order of priority established. The cost to the property owner will be $3.00 per front foot. 7. Should property owners living on a given street or length of street section desire, and the owners of 70 percent of the front feet of property abutting on the street or length of street section petition the council to do so, the city may surface the street or length of street section with a one -inch hot -mix asphalt surface twenty to twenty-four feet wide, the exact width to be determined by the council. Prior to the application of the asphalt surface the existing base coarse may be scarified, additional base materials added, and/or the street shaped and compacted. Side ditches will be necessary for this type of construction. The cost to property owners of such street or length of street section will be 75 cents per front foot. 8. As a public necessity, streets with one inch of hot -mix asphalt surface may be constructed by the city under the powers vested in it without the consent of property owners. Owners of property abutting such streets will be required to pay an assess- ment of 75 cents per front foot. 9. Property owners who have constructed curbs and gutters in compliance with city specifications and grades will be allowed a credit of $1.00 per front foot toward the $3.00 per front foot assessment. 10. When it becomes necessary for the city to finance any assessment made for street construction, an interest rate of eight percent per annum will be charged against such assessment. No street construction shall be started until all financial arrangements of both property owners and the city have been completed, and all neces- sary legal papers and procedures have been approved by the city council. 12. Upon adoption of this policy the mayor is directed to address a letter to the citizens of College Station containing the following information relative to street construction. ' a. A statement setting .forth the reasons why so much time has elapsed in the development of this policy. b. Explain that the tax increase pays only for the city's part of any construction. c. Outline methods of financing available to property owners and legal procedure which city must follow prior to the beginning of any con- struction. d. Outline the procedure to be followed by property owners prior to the beginning of any construction, 1. Petition 2. Complete financial arrangements. 13. Legal requirements make it necessary that the city take the following steps before approving the construction of a street; a. Compile a list of all property owners on the street. b. Compile a complete description of all property on the street. c, Show total cost to be assessed against each piece of property. d. Advertise a public hearing (three times) at least ten days prior to the hearing. e. Hold public hearing. f. Pass a special assessment ordinance. g. Complete all financial arrangements. h. Advertise for bids, i. Award contract. (The council respectfully suggests that considerable time and effort can be saved when 100 percent of property owners have completed fin- ancial arrangements for the costs of any street improvements in which they participate.
