The Building and Standards Commission may seek advice from its attorney regarding a pending and
contemplated litigation subject or attorney- client privileged information. After executive session discussion,

arise as to the posted subject matter of this Building and Standards Commissionmeeting, an execultive session
will be held.

AGENDA ITEM NO. 1: Call meeting to order.
Chairman, Dan Sears, called the meeting to order.
AGENDA ITEM NO.2: Consideration, discussion and possible action of
request for absence for Vice Chairman George

Dan Sears asked if anyone would like to make a motion.
Larry Patton motioned to approve the absence.
Frank Cox seconded the motion.
The motion passed unanimously, (4 -0)

AGENDA ITEM NO. 4: Consideration, discussion and possible action to
approve minutes from the Building & Standards
Commission meeting from February 17, 2003.
Frank Cox motioned to approve the minutes.
Kevin Kuddes seconded the motion.
The motion passed unanimously, (4 -0).
AGENDA ITEM NO. 5: Public hearing, presentation, discussion and possible
action concerning the condition of the structure located
at 1201/1203 Georgia Street (Lot 7, Block 10,
McCulloch Addition, College Station, Texas).
Dan Sears asked staff to brief the Commission.
Lance Simms, Building Official, took the floor. Lance reminded the Commission
that this item was tabled at the last meeting due to a notification issue. He stated
that the owner had been re- notified and he was ready to present the case again.
Lance said that the case involved a brick veneer duplex that has numerous broken
and /or missing windows and doors. He said that it appears
in and out of the structure. Lance showed pictures o the Commissio d tailing
the extent of the damage to the structure. Lance stated that, structurally
speaking, the duplex seems to be code compliant. However, the broken and /or
damaged windows and doors are a problem. Lance recommended that the
structure be declared unsafe. Furthermore, he recommended that the
Commission order the owner to secure the structure against unauthorized entry
within 30 days for the following reasons:
1. The structure is substandard and unfit for human habitation and a hazard to
the public health, safety and welfare; and
2. The structure is unoccupied and secured from unauthorized entry to the
extent that it could be entered or used by vagrants or other uninvited
persons as a place of harborage or could be entered or used by children.
Dan Sears asked the City Attorney Angela Deluca to come forward and answer
some questions for the Commission. Angela helped the Commission understand
how the motion needed to be stated.
Dan Sears asked if anyone would like to speak in favor of the item. No one came
forward to speak.
Dan Sears asked if anyone would like to speak in opposition to the item. No one
came forward to speak.
Dan Sears closed the public hearing.

Frank Cox made a motion that the structure be declared substandard and unfit for
human habitation and a hazard to the public health, safety and welfare.
Kevin Kuddes seconded the motion.
The motion passed unanimously, (4 -0)
Frank Cox made a second motion stating that the structure is unoccupied and
unsecured from unauthorized entry to the extent that it could be entered or used
by vagrants or other uninvited persons as a place of harborage or could be
entered or used by children.
Kevin Kuddes seconded the motion.
The motion passed unanimously, (4 -0)
Kevin Kuddes made a motion ordering the owner to secure the structure within 30
days based on the previous approved motions and due to the structure being
unsafe.
Larry Patton seconded the motion.
The motion passed unanimously, (4 -0)

Staff Report
Item: Consideration, discussion, and possible action concerning a report and
recommendation from the Building Official concerning the structure located at 1201/1203
Georgia Street (Lot 7, Block 10, McCulloch Addition, Brazos County, Texas).
Item Summary: This case involves a vacant duplex that is open to the public due to
numerous broken windows and doors. Due to these conditions and the fact that the
structure is in a general state of disrepair, the Commission declared the structure unsafe
and ordered the owner to secure the structure from unauthorized entry within 30 days.
This action was taken at the Commission's meeting on 24 March 2003. To date, the
owner has failed to comply with the Commission's order. According to Chapter Three,
College Station Code of Ordinances, the Commission can order the City to perform the
work required to abate the substandard condition(s). If the City performs the work
ordered by the Commission, a lien will be placed against the property to cover all cost
associated with said work.
Staff recommendation: Staff recommends that the Commission order the City to secure
the structure against unauthorized entry as provided for in Chapter 3, Section 1(G) 9,
College Station Code of Ordinances.

FINDINGS AND ORDER
BE IT REMEMBERED THAT ON May 19, 2003, The City of College Station's
Building and Standards Commission conducted a public hearing regarding the structure
located at 1201/1203 Georgia Street, College Station, Texas.
After considering the evidence presented, the Commission finds that the structure
referenced above:
is an unsafe structure due to the following violations:
Having found the structure to be unsafe, the Commission also determined that the
structure:

is dilapidated, substandard, or unfit for human habitation and a hazard to the
public health, safety and welfare.
regardless of its structural condition, is unoccupied by its owners, lessees, or other
invitees and is unsecured from unauthorized entry to the extent that it could be
entered or used by vagrants or other uninvited persons as a place of harborage or
could be entered or used by children.

is boarded up, fenced, or otherwise secured in any manner, but constitutes a
danger to the public even though secured from entry.
l is boarded up, fenced, or otherwise secured in any manner, but the means used to
secure the building are inadequate to prevent unauthorized entry or use of the
building from unauthorized entry to the extent that it could be entered or used by
vagrants or other uninvited persons as a place of harborage or could be entered or
used by children.
IT IS THEREFORE ORDERED THAT THE CITY OF COLLEGE STATION SHALL:
vacate the structure within days.
/ secure the structure from unauthorized entry within 60 days.
repair, remove, or demolish the structure within 30 days
repair, remove, or demolish the structure within days because the owner,
mortgagee or lienholder has established at the hearing that the work cannot
reasonably be performed within thirty (30) days.
repair, remove, or demolish the structure within 90 days because the owner,
lienholder, or mortgagee has submitted a detailed plan and time schedule for the
work at the hearing and has established at the hearing that the work cannot
reasonably be completed within 90 days because of the scope and complexity of
the work.

lienholder, or mortgagee shall submit progress reports to the Commission on a
weekly basis to demonstrate compliance with the time schedules established for
commencement and performance of the work.
