The Building and Standards Commission may seek advice from its attorney regarding a pending and contemplated litigation subject or attorney- client privileged information. After executive session discussion, any final action or vote taken will be in public. If litigation or attorney- client privileged information issues arise as to the posted subject matter of this Building and Standards Commissionmeeting, an execultive session will be held. City Hall Council Chambers MEMBERS PRESENT: Chairman Dan Sears, Vice Chairman George McLean, Commission Member Frank Cox, Alternates Larry Patton and Kevin Kuddes MEMBERS ABSENT: Member Glenn Thomas STAFF PRESENT: Building Official Lance Simms, Assistant City Attorney Angela Deluca, Action Center Representative Regina Kelley, Plans Examiner Carl Warren and Staff Assistant Stacey Ann Smith AGENDA ITEM NO. 1: Cali meeting to order. Chairman, Dan Sears, called the meeting to order. AGENDA ITEM NO. 2: Consideration, discussion and possible action of absence request from meeting. Consider request for absence for member Glenn Thomas. Dan Sears asked if anyone would like to make a motion. Larry Patton motioned to approve the absence. Frank Cox seconded the motion. The motion passed unanimously, (5 -0) AGENDA ITEM NO. 3: Hear visitors for items not on agenda. Dan Sears asked if anyone would like to speak on an item not on the agenda. No visitors chose to speak. AGENDA ITEM NO. 4: Consideration, discussion and possible action to approve minutes from the Building & Standards Commission meeting from March 24, 2003. 1 of 3 Building & Standards Commission December 9 2002 - Minutes George McLean motioned to approve the minutes. Larry Patton seconded the motion. The motion passed unanimously. (5 -0). AGENDA ITEM NO. 5: Presentation, discussion and possible action concerning a report by the Building Official concerning the condition of the structure located at 1201/1203 Georgia Street (Lot 7, Block 10, McCulloch Addition, College Station, Texas). Dan Sears asked staff to brief the Commission. Lance Simms, Building Official, took the floor. Lance reminded the Commission that this case involves a vacant duplex. He stated that the duplex is in good structural condition, but the windows are broken, the front door is open, and the back sliding glass doors are broken. The Commission declared the structure unsafe and ordered the owner to secure the structure from unauthorized entry within 30 days. This action was passed on March 24, 2003. The 30 day have passed and Lance reported that the duplex is still in substandard condition and open. According to Chapter Three, College Station Code of Ordinances, the Commission can order the City to perform the work required to abate the substandard conditions. If the City performs the work ordered by the Commission, a lien will be placed against the property to cover all cost associated with said work. Staff recommends that the Commission order the City to secure the structure against unauthorized entry. Lance asked that the Commission give the City 60 days to get the work done. Dan Sears asked if anyone had any questions. George McLean asked what the property was worth. Lance stated the tax office has the land market value at $9,000 and the improvements at $41,100. Dan Sears asked if anyone would like to make a motion. Larry Patton made a motion that the structure be secured by the City against unauthorized entry as provided for in Chapter 3, Section 1(G)9 within 60 days. Frank Cox seconded the motion. AGENDA ITEM NUMBER 5: Presentation, discussion, public hearing and possible action concerning a report by the Building Official concerning the condition of the structure located at 3019 Baron Cut -Off Road (Robert Stevenson League, tract 15, 1.4 acres, College Station, Texas). c� m 0 Ji a 0 11 Building and Standards Commission Staff Report Item: Public hearing, presentation and consideration of a structure located at 3019 Barron Cut -Off Road, College Station, Texas (R Stevenson, Tract 15, 1.4 Acres). Item background: The residential structure located at 3019 Barron Cut -Off Road is substandard and in violation of several provisions of the International Property Maintenance Code (see attached). An inspection of the premises revealed that there is probable cause to conclude that the structure is unsafe. A title report on the property indicates that the property owner is Wayland E. Terrell of Houston, Texas. The Brazos County tax appraisal office has the value of the structure listed as $830.00. College Station Code of Ordiances states, "Repairs shall be deemed feasible if the cost of repair, reconstruction, or improvement of a structure equals less than fifty percent (50 %) of the market value of the structure. In any case where fifty percent (50 %) or more of the value of a structure is damaged or deteriorated, it shall be ordered demolished or removed." Staff recommendation: Staff recommends that the Commission declare the structure unsafe. Furthermore, staff recommends that the Commission order the owner to demolish the structure and remove all debris within 30 days. 11 September 2003 The following is a list of code violations for the structure located at 3019 Barron Cut -Off Road (Robert Stevenson League, Tract 15, 1.4 Acres), College Station, Texas. These violations were documented as a result of an inspection performed on 11 September 2003. 1. Sanitary facilities (sinks, lavatories, tubs, and water closets) are not connected to an operational water source, in violation of the 2000 International Property Maintenance Code (IPMC). 2. Required plumbing fixtures are not connected to an operational water heater capable of providing adequate hot water, in violation of the 2000 IPMC. 3. Electrical outlets, fixtures, and receptacles are not properly connected to a source of electrical power, in violation of the 2000 IPMC. 4. Windows are damaged so that the building envelope is not weathertight, in violation of the 2000 IPMC. 5. The structure has not been maintained in a sanitary condition, in violation of the 2000 IPMC. 6. The structure does not have adequate heating facilities, in violation of the 2000 IPMC. 7. The cooking equipment is not connected to a power source, in violation of the 2000 IPMC. 8. Structural members have deteriorated and are not capable of safely supporting imposed loads, in violation of the 2000 IPMC 9. The structure does not have operable smoke detectors, in violation of the 2000 IPMC. Lance Simms Building Official a TL.T. Stevenson League, Tract 13.3, 3.15 Acres). Item background: The residential structure located at 3411 Barron Cut -Off Road is substandard and in violation of several provisions of the International Property Maintenance Code (see attached). An inspection of the premises revealed that the structure has totally collapsed and is unsafe under the terms of the City's adopted property maintenance code. A title report on the property indicates that the property owners are Mamie Lee Peterson and Natalie Brown Barnett. The Brazos County tax appraisal office has the value of the structure listed as $0.00.
