At this time, the Chairman will open the floor to citizens wishing to address the Commission on planning and zoning issues not already scheduled on tonight's agenda. (JR -06- 00500186) Applicant: Jeff McDowell, Agent for Southwood West Staff Recommendations: Staff recommends approval of the Vacating and Final Plat as submitted. Item Summary: This item is for the consideration of a Vacating Plat of Lot 8R, Block Two and a Final Plat of Lots 8R & 9, Block Two of the Edelweiss Business Center. Lot 8R is being subdivided into Lots 8R & 9. Access to these Tots will be provided by existing private access easements. Comprehensive Plan Considerations: The Land Use Plan shows this area as Regional Retail. The property fronts on Wellborn Road (FM 2154) which is designated a major arterial on the City's Thoroughfare Plan. The property is zoned C -1, General Commercial, and is in compliance with the Unified Development Ordinance and Subdivision Regulations. In accordance with the rezoning, a 25 -foot landscape buffer is shown along the back of Lot 9, the common boundary with Edelweiss Estates, a residential subdivision. The Final Plat is in compliance with the Land Use Plan, which shows the property as Retail Regional. An 85' private access easement is located along the front of the property. Access from Wellborn Road was limited to every other lot by the Edelweiss Business Center Preliminary Plat. Budgetary & Financial Summary: This property is located in Sanitary Sewer Impact Fee Area 92 -01. Impact Fees will be due at time of building permit. Current fees for this area are $232.04 per living unit equivalent (LUE). Item Background: The Preliminary Plat was approved on 1997. The Final Plat was approved in 2003, and a subsequent Amending Pat was approved in 2004. Commission Action Options: The Commission has final authority over the final plat. This Phase consists of Block 7, Lots 19 -32, Block 8, Lots 1 -13 and Block 10, Lots 6 -7. The proposed lots are approximatley 0.16 of an acre and will have access onto residential streets. Comprehensive Plan Considerations: The subject property is shown on the Land Use Plan as Single Family Medium Density. Applicant: Randy French, owner Staff Recommendations: This plat meets the minimum subdivision requirements for a cluster development, however the Planning and Zoning Commission has the discretion to require up to 50% of the proposed open space be useable recreation space. Item Summary: This item for consideration is the Preliminary Plat for a Residential Cluster Development to be built in three phases. Cluster development allows lots to be smaller with a corresponding increase in open space. The total resulting density of the development must still conform to the underlying zoning district. Cluster Development is allowed in all zoning districts. Lot sizes of this subdivision average 6,400 s.f. (6.8 lots per acre) with a total site density of 4.09 units per acre. Comprehensive Plan Considerations: The Comprehensive Land Use Plan identifies this area as Single- family Medium Density. The site lies adjacent to the freeway of William D. Fitch Parkway and the minor arterial of Barron Road. A bike route is proposed along this segment of William D. Fitch Parkway, and a bike lane is proposed on this segment of Barron Road. A combined pedestrian and bike path is also proposed within the Greenway designation of this property. Parkland has been dedicated on the site totaling 6.86 acres including a portion with the designation of Floodplains and Streams on the Land Use Plan. The parkland dedication exceeds the minimum requirement of 1.6 acres on this development. The Preliminary Plat does comply with the approved Master Plan. Item Summary: This item is for consideration of a variance to Section 12 - K Blocks and Section 13 -C Lot Width of the Subdivision Regulations and consideration of a preliminary plat for Saddle Creek, a rural residential development. The applicant is requesting six variances to Section 12 -K.2 of the Subdivision Regulations relating to block length. The maximum block length allowed within a rural single - family development is 1,500 feet. The proposed block lengths vary in length between 1,597 feet and 2,194 feet, requiring variances between 97 feet and 694 feet. The applicant is also requesting seven variances to Section 13 -C Lot Width. The minimum lot width allowed for a rural residential development is 100 feet. The lot widths that do not meet this minimum vary in width between 84.35 feet and 96.80, requiring variances that range from 3.2 feet and 15.65 feet. Item Summary: The applicant has requested an amendment to the land use portion of the Comprehensive Plan for the property at the southeast comer of Texas Avenue and Sterling Street from High Density Residential to Regional Retail. The property is two platted residential lots that are developed as one single - family home. The Comprehensive Plan gives the following definition for Regional Retail: "Area permitting regional scale development of tax - generating developments such as retail centers, service commercial, restaurants, etc. These uses are generally dependant on good access to highways and major arterials. Post Oak Mall is an example of this use." The property is located within the Richards Subdivision, a residential neighborhood established in the late 1940s, prior to being annexed into the City in 1969. Richards Subdivision is made up of four residential streets, Richards, Sterling, Lassie and Crest. All of the property in the subdivision is zoned R -1 Single- Family Residential. This area has seen a lot of recent single - family infill development and neighborhood revitalization. Based on the information available through the Brazos County Appraisal District, the majority of the homes in close vicinity to the subject property are owner occupied. Because of these reasons, staff does not believe that amending the Comprehensive Plan for this property furthers the City Council's goal to promote neighborhood integrity. The property has approximately 80 feet of frontage on Texas Avenue, a major arterial on the Thoroughfare Plan, and approximately 185 feet of frontage on Sterling Street, a residential street. There are four lots in the Richards subdivision with frontage on Texas Avenue; three of them (including the subject property) are developed as single - family homes. The southeast corner of Richards Street and Texas Avenue is zoned R -1, but was developed as a dentist's office through a Conditional Use Permit in the 1980s after several zoning requests for office use were denied. Because it was developed under a Conditional Use Permit, no other non- residential use is permitted on the property. The property to the east is developed as a single - family home. The property to the west and across Texas Avenue is zoned C -1 General Commercial and is developed as Outback Steakhouse. The property to the south is zoned C -1 General Commercial and is developed as an equipment rental business. The properties to the north, across Sterling Street, are developed as single - family homes that face the subject property. Neighborhood Protection Standards contained in the Unified Development Ordinance provide buffer and height limitations to properties located adjacent to the subject property, but do not provide protection for the single - family homes located across Sterling Street that face the subject property. Sterling Street meets the minimum pavement width for a residential street (27 feet), however, the right - of - way width is only 30 feet wide (current standards require 50 feet). While the pavement width is adequate to carry residential traffic, the property lines and structures, including existing single - family homes, are much closer to the street than those that meet current standards. Staff also has a concern about future commercial development on this property with its limited frontage on Texas Avenue. While City policy is not to locate commercial driveways on residential streets, the minimal lot width on Texas Avenue will not permit driveway access to Texas Avenue and the commercial access would have to come from the residential street. Item Background: The property was annexed into the City limits in 1969 as a residential subdivision and zoned R -1 Single- Family Residential at that time. There have been numerous re- subdivisions in the Richards Subdivision that have spurred revitalization of the neighborhood. Commission Action Options: The Commission acts as a recommending body on the question of Comprehensive Plan amendment, which will be ultimately decided by City Council. The Commission options are: 1. Comprehensive Plan Considerations: The Land Use Plan currently shows the property as Single - Family Residential High Density. The applicant has requested to amend the Comprehensive Plan to designate this property as Regional Retail. If the Comprehensive Plan is amended to reflect Regional Retail then the rezoning request may be considered. While C -1 General Commercial zoning is generally acceptable in areas designated as Regional Retail, the property has limited access and is within an established single - family neighborhood. The property has approximately 80 feet of frontage on Texas Avenue, a major arterial on the Thoroughfare Plan, and approximately 185 feet of frontage on Sterling Street, a residential street. The right -of -way width for Sterling does not meet the current standards of 50 feet (existing right -of -way width is 30 feet). While the pavement width is adequate to carry residential traffic, the property lines and structures, including existing single - family homes, are much closer to the street than those that meet current standards. Staff also has a concern about future commercial development on this property with its limited frontage on Texas Avenue. While City policy is not to locate commercial driveways on residential streets, the minimal lot width on Texas Avenue will not permit driveway access to Texas Avenue and the commercial access would have to come from the residential street.
