HomeMy WebLinkAbout1968-0553 - Ordinance - 01/04/1968ORDINANCE NO. 553 ORDINANCE CALLING BOND ELECTION; PROVIDING DETAILS RELATING THERETO; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT THE STATE OF TEXAS COUNTY OF BRAZOS The City Council of the City of College Station, Texas, convened in special session, open to the public, at the City Hall within said City on the 4th day of January, 1968, with the following members present, to-wit: D. A. Anderson Mayor B. J. Cooley Councilman O. M. Holt Councilman Robert R. Rhodes Councilman A. P 'Boyett Councilman Homer B. Adams Councilman and the following members absent, to-wit: A. L. Rosprim and Charles F. Richardson, when, among other business, the following was transacted: An ordinance was introduced which was read in full. Councilman A. P. Boyett made a motion that the ordinance be adopted. Councilman O. M. Holt seconded the motion for adoption of the ordinance. The motion, carrying with it the adoption of the ordinance, prevailed by the following vote: AYES: Mayor Anderson and Councilmen Cooley, Holt, Rhodes, Boyett, and Adams. NOES: None. The Mayor thereupon announced that the ordinance had been duly and lawfully adopted. The ordinance thus adopted follows: ORDINANCE CALLING BOND ELECTION; PROVIDING DETAILS RELATING THERETO; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, the City Council of the City of College Station, Texas, deems it necessary and desirable that an election be called and held within said City for the purpose of voting on the propositions of issuing city hall bonds, fire station -police headquarters building bonds and street rights -of -way and improvement bonds, all payable from ad valorem taxation, and all as hereinafter set forth; Therefore S Page 2 Ordinance No. 553 BE IT ORDAINED BY THE CITY COUNCIL F O THE CITY OF COLLEGE STATION: Section 1. That an election shall be held in and throughout the City of College Station, Texas, on the 3rd day of February, 1968, at which election the following propositions shall be submitted to the duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation, for their action there- upon, to -wit: PROPOSITION NO. ONE SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE AUTHO- RIZED TO ISSUE THE BONDS OF SAID CITY IN THE AMOUNT OF $200, 000, MATURING SERIALLY WITHIN 40 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT EXCEEDING 6% PER ANNUM, FOR THE PURPOSE OF CON- STRUCTING A PUBLIC BUILDING WITHIN SAID CITY, TO -WIT: A CITY HALL BUILDING, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFI- CIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? PROPOSITION NO. TWO SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE AUTHO- RIZED TO ISSUE THE BONDS OF SAID CITY IN THE AMOUNT OF $140, 000, MATURING SERIALLY WITHIN 40 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT EXCEEDING 6% PER ANNUM, FOR THE PURPOSE OF CON- STRUCTING ATUBLIC BUILDING WITHIN SAID CITY, TO -WIT: A FIRE STATION - POLICE HEADQUARTERS BUILDING, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? PROPOSITION NO. THREE SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE AUTHO- RIZED TO ISSUE THE BONDS OF SAID CITY IN THE AMOUNT OF $400, 000, MATURING SERIALLY WITHIN 40 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT EXCEEDING 6 PER ANNUM, FOR THE PURPOSE OF PUB; CHASING RIGHTS -OF -WAY FOR STATE HIGHWAY NO. 6 BY -PASS, INCLUDING TWO IN- TERCHANGES, AND FOR THE EXTENSION OF UNIVERSITY DRIVE FROM STATE HIGHWAY NO, 6 TO THE PROPOSED INTERCHANGE ON STATE HIGHWAY NO. 6 BY -PASS, ALL WITH - IN SAID CITY, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFICIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CRIsATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID FONDS AS IT MATURES? 01407 ?a � Page 3 Ordinance No. 553 PROPOSITION NO. FOUR SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, BE AUTHO- RIZED TO ISSUE THE BONDS OF SAID CITY IN THE AMOUNT OF $100, 000, MATURING SERIALLY WITHIN 40 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT EXCEEDING 6% PER ANNUM, FOR THE PURPOSE OF THE CONSTRUCTION AND IMPROVEMENT OF THE ROADS, BRIDGES, AND STREETS OF SAID CITY, TO -WIT: THE STREET KNOWN.`AS 11 29TH" STREET FROM THE PRESENT CITY LIMITS OF THE CITY OF COLLEGE STATION TO ASHBURN AVENUE AND THE "COUNTY ROAD" FROM GLADE STREET TO STATE HIGHWAY NO. 6, ALL WITHIN SAID CITY, AND THE PURCHASE OF THE NECESSARY RIGHTS -OF -WAY THEREFOR WITHIN SAID CITY, AND TO LEVY AN ANNUAL TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFI- CIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS IT MATURES? Section 2: That said election shall be held in accordance with the provisions of the Constitution and laws of the State of Texas, and only duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for tax- ation shall be qualified to vote. Section 3: That said election shall be held in the three election precincts of the City heretofore established and described by natural or artificial boundaries or survey lines by ordinance duly adopted by the City Council of said City and duly set out in its minutes, and at the respective polling places hereinafter designated. Judge l �b l Section 4: That it. is hereby determined by the City Council that voting in said election shall be by the use of paper ballots, and the ballots of said election shall con- form to the requirements of the Election Code of the State of Texas and, in addition, shall have printed thereon the following: PROPOSITION NO. ONE FOR } ) THE ISSUANCE OF $200, 000 CITY HALL BONDS AGAINST ) ) FOR ) u ) THE ISSUANCE OF $400, 000 RIGHTS -OF -WAY BONDS AGAINST ) ) 01409 1I Page 5 Ordinance No. 553 E The voter shall vote on each proposition by placing an "X" or other clear mark in the square beside the statement indicating the way he wishes to vote on such proposition. Absentee voting shall be conducted by a clerk for absentee voting, namely, Mrs. Florence Neelley, and the place at which absentee voting shall be conducted is designated as the City Hall in said City, which is also the absentee voting clerk's availing address to which ballot applications and ballots voted by mail may be sent. Said clerk shall keep her office open for at least eight (8) hours, that is, from 8 :00 a.m. to 5:00 p. m. on each day for absentee voting which is not a Saturday, Sunday, or an official state holiday. Section 5: That notice of said election shall be given by posting a copy of a notice containing a substantial copy of this ordinance at the City Hall and at a public place in each of the precincts within said City not less than fourteen (14) days prior to the date on which said election is to be held, and by publication of said notice on the same day in each of two (2) consecutive weeks in the Bryan Daily Eagle, a newspaper of general circulation within the City of College Station, the first of said publications to be made not later than fourteen (14) days prior to the date set for said election. Section 6: That this ordinance shall become effective and be in full force and effect upon and after its adoption. PASSED AND APPROVED this 4th day of January, 1968. _APPROVED: D. A.
