AN ORDINANCE AMENDING CHAPTER 12, "UNIFIED DEVELOPMENT ORDINANCE,"
SECTION 4.2, "OFFICIAL ZONING MAP," OF THE CODE OF ORDINANCES OF THE
CITY OF COLLEGE STATION, TEXAS, BY CHANGING THE ZONING DISTRICT
BOUNDARIES AFFECTING CERTAIN PROPERTIES AS DESCRIBED BELOW;
DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That Chapter 12, "Unified Development Ordinance," Section 4.2, "Official Zoning
Map," of the Code of Ordinances of the City of College Station, Texas, be amended
as set out in Exhibit "A ", attached hereto and made a part of this ordinance for all
purposes.
PART 2: That any person, firm, or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty -five Dollars ($25.00) nor more than Two
Thousand Dollars ($2,000.00). Each day such violation shall continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.

That Chapter 12, "Unified Development Ordinance," Section 4.2, "Official Zoning Map," of the
Code of Ordinances of the City of College Station, Texas, is hereby amended as follows:
The following property is rezoned from PDD, Planned Development to PDD, Planned
Development for the purpose of amending the previously adopted Concept Plan for Spring Creek
Townhomes Phases 2 and 3 as originally shown in City Ordinance 2602, adopted January 91h,
2003:
9.706 ACRES BEING ALL THAT TRACT OR PARCEL OF LAND LYING AND
BEING SITUATED IN BRAZOS COUNTY, TEXAS, AND BEING SITUATED IN
THE ROBERT STEVENSON SURVEY, A -54, AND BEING A PART OF THE SAME
62.18 ACRE TRACT OF LAND DESCRIBED IN A DEED TO SPRING CREEK CS
DEVELOPMENT, LTD., AS RECORDED IN VOLUME 4712, PAGE 260, OF THE
BRAZOS COUNTY OFFICIAL RECORDS (B.C.O.R.), AND BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS IN EXHIBIT "B ",
SHOWN GRAPHICALLY IN EXHIBIT "C ", AND DETAILED IN A CONCEPT PLAN
IN EXHIBIT "D ".

OUT OF THE ROBERT STEVENSON SURVEY, A -54
COLLEGE STATION
BRAZOS COUNTY, TEXAS
All that tract or parcel of land lying and being situated in Brazos County, Texas, and being situated in the
Robert Stevenson Survey, A -54, and being a part of the same 62.18 acre tract of land described in a deed
to Spring Creek CS Development, Ltd., as recorded in Volume 4712, Page 260, of the Brazos County
Official Records(B.C.O.R.), and being more particularly described by metes and bounds as follows with
all control referred to the 1983 Texas State Plane Coordinate System, Lambert Projection, Central Zone:
BEGINNING at a 1/2" iron rod with cap marked "Kling" found for the west comer of this tract, also
being the north comer of the Decatur Drive(80' R.O.W.), as recorded in Volume 7800, Page 13, of the
B.C.O.R., also being a point on the south line of Spring Creek Gardens, Phase 1, as recorded in Volume
6663, Page 31, of the B.C.O.R., also being South 41°35'05" West, 2019.84 feet from the north corner of
said 62.18 acre tract, also being in the northwest line of said 62.18 acre tract, and having a Texas State
Plane Coordinate Value of X= 3,574,937.90 (E), Y = 10,191,281.54 (N), from which College Station
Monument #138 bears S 88 °40'44" E, 3938.35 feet;
THENCE North 41 °35'21" East, a distance of 865.04 feet along the common line between this tract and
said Spring Creek Gardens to a 5/8" iron rod found for the north comer of this tract, also being a point in
the south line of said Spring Creek Gardens, also being the west comer of the Spring Creek Townhomes
Phase I, Amending Plat, as recorded in Volume 6708, Page 41;
THENCE along the common line between this tract and said Spring Creek Townhomes tract for the
following calls:
South 48 °25'07" East, a distance of 120.00 feet to a 5/8" iron rod found for comer;
South 41 °34'53" West, a distance of 32.63 feet to a 5/8" iron rod found for comer;
South 48 °25'07" East, a distance of 50.00 feet to a 518" iron rod found for comer;
South 46 °07'35" East, a distance of 526.99 feet to a 5/8" iron rod with cap set for the east comer of this
tract, also being a point in the southwest line of said Spring Creek Townhomes, also being in the northeast
right -of -way line of said Decatur Drive;
THENCE along the common line between this tract and said right -of -way line of Decatur Drive for the
following calls:
South 63 °27'23" West, a distance of 512.63 feet to a 5/8" iron rod set for a point of curvature, from which
a 1/2" iron rod with cap marked "Kling" found for reference, bearing South 70 °18'45" West, at a distance
of 127.61 feet;
Around a curve to the right having a delta angle of 68 °31' 19 ", an are distance of 639.82 feet, a radius of
535.00 feet, and a chord of North 82 °17'31" West, a distance of 602.37 feet to a 1/2" iron rod with cap
marked "Kling" found for a point of tangency;
