Signs 7.4 E.Exempt Signs The followingsignsareexempt fromtherequirementsofthisUDO: 1.Signsthatarenoteasilyidentifiedfrombeyondtheboundariesofthelotorparcel onwhichtheyarelocatedorfromanypublicthoroughfareortraveledright-of-way, asdeterminedbytheAdministrator.Suchsignsarenotexemptfromthesafety regulationscontainedhereinand inCityBuildingandElectricalCodes; 2.Officialnoticespostedbygovernmentofficialsintheperformanceoftheirduties: governmentsignscontrollingtraffic,regulatingpublicconduct,identifyingstreets, orwarningofdanger.Bulletinboardsoridentificationsignsaccessoryto governmentbuildingsorotherbuildingsaresubjecttotheprovisionsofthisUDO; 3.SignsutilizedbyapublicPrimary&SecondaryEducationalFacility,exceptthat suchsignsshalladheretothe limitationsofSection7.4.DProhibitedSigns. 4.Temporarysignserectedbyprivatepropertyownersforthepurposeofwarningof adangerousdefect,condition,orotherhazardtothepublic; 5.Non-commercialsignsonprivatepropertyorworksofartthatinnowayidentifyor advertiseaproductorbusiness,orbytheirlocationandplacementimpedetraffic safety,exceptasstated inSection7.4.R, Non-CommercialandPoliticalSigns; 6.Temporarydecorationsordisplays,iftheyareclearlyincidentaltoandare customarilyandcommonlyassociatedwithanynational,local,orreligious celebration; 7.Temporaryorpermanentsignserectedbypublicutilitiesorconstructioncompanies towarnofthelocationofpipelines,electricalconduits,orotherdangersor conditions inpublicrights-of-way; 8.Non-CommercialSignscarriedbyapersonandnotsetoraffixedtotheground, thatinnowayidentifyoradvertiseaproductorbusiness,orbytheirlocationand placement impedetrafficsafety; 9.CommercialSignscarriedbyapersonandnotsetonoraffixedtotheground, providedthatthesign istemporary,on-premise,andnotusedbythepersononthe premisesformorethanthree(3)consecutivedays,morethanfour(4)timesper calendaryear; 10.Outdooradvertisingdisplaysignsforsponsorsofcharitableeventsheldonpublic properties.Thesesignsmaybedisplayedforthedurationoftheeventornotmore thanthreedayswithapprovaloftheCityManager; 11.Flagsusedaspoliticalsymbols;and 12.SpecialDistrictIdentificationSigns,asdefinedbyArticle11.2Terms,thatinno wayadvertiseaproductorabusiness,orbytheirlocationandplacementimpede trafficsafety.SpecialDistrictIdentificationSignsmustbeapprovedbythe appropriateBoardorCommittee. 13.On-premiseand/oroff-premisesignswheretherehasbeenaresolutionadoptedby theCityofCollegeStationoranexecutedcontractwiththeCityofCollegeStation andthedisplayofthesignsarefordesignatedlocations,aspecifiedtimeperiod, and; PromotesapositiveimageoftheCityofCollegeStationfortheattractionof a. businessortourism; Depictanaccomplishmentofan individualorgroup;or b. Createsapositivecommunityspirit. c. 14.Temporarysignserectedforaneighborhoodeventsponsoredbyaneighborhood  groupthat isregisteredwiththeCityofCollegeStation,providedthatthesignage is: Locatedwithintheperimeteroftheneighborhood; a. Providesthenameoftheassociationsponsoringtheeventonthesign; b. Ingoodrepair; c. Allowedupto fourteen(14)dayspriortotheevent;and d. Removedwithintwenty-four(24)hoursoftheevent. e. 15.Home TourEventsigns,asdefinedbyArticle11.2Terms,witha limitoftwo(2) eventspercalendaryear.Suchsignageshall: Be ingoodrepair; a. Displaythenameofthegroupsponsoringtheevent(ifapplicable); b. Bealloweduptoten(10)consecutivedaysperevent; c. Beremovedwithintwenty-four(24)hoursoftheendoftheevent; d. Complywiththe following if locatedwithinaright-of-way: e. Locatedoutsidethevisibilitytriangleof intersectionsas it isdefined in 1) Section7.1.CoftheUnified DevelopmentOrdinance. PermittedbytheStateDepartmentofHighwaysandPublic 2) Transportation if locatedonanystatehighwayorroadway. Beconstructedofdurablematerialandnosignshallbegreater insize 3) than3’x3’.  BufferRequirements 7.6 A.Purpose Thepurposeofbufferrequirements,whichgenerallyincludeabufferyard,plantings,and a fenceorwall, istoprovideavisualbarrierbetweendifferentzoningdistrictsandtohelp mitigateanynegativeimpactsofadjacentlandusesondevelopedordeveloping properties.Abuffershouldvisiblyseparateoneusefromanotherandshieldorblock noise,glares,orothernuisances. B.Applicability 1.Perimeterbuffersshallbeprovidedonbuildingplotsabuttingdeveloped(platted) ordeveloping(intheprocessofplatting)sitesinaccordancewiththestandardsof thisSection,asoutlinedinSection7.6.F,MinimumBufferStandards.Thefollowing shallprovidebuffers: Vacantsitesthatdevelop; a. Existingsiteswhenadditions,expansions,and/orredevelopmentsequalorare b. greaterthan25%oftheexisting improvements; Existingsiteswhencumulativeadditions,expansions,and/orredevelopments c. total25%ormoreoftheexisting improvements; Existingsiteswhenachangeofuseintensifiesthedevelopmentintermsof d. elementssuchastraffic,processes,noise,waterorairpollution,etc.; Existingsiteswithlawfullyestablishednon-conforminguseswhentheuseis e. expanded;and Sexually-orientedbusinesses. f. 2.ExceptionstothetermsofthisSectionwillbemadewhen: Theadjacentdevelopeduse isnon-conforming; a. Theadjacentdevelopeduse isagricultural; b. TheLandUsePlandesignatestheareaas Redevelopment; c. ThepropertyiszonedP-MUDandthebufferrequirementwasdetermined d. throughtherezoningprocess; ThedevelopinguseisapublicPrimaryorSecondaryEducationalFacility e. containingabuildingwithaGroup“E”occupancyasdefinedinthe InternationalBuildingCode;or Properties in NG and RDD districts. f.  Non-ResidentialArchitecturalStandards 7.9 A.Applicability ThedesignstandardsofthisSectionshallapplytodevelopment,redevelopment,and façadechangestoallnon-residentialbuildingslocatedinanyzoningdistrictwiththe exceptionoftheM-1,M-2,R&D,NG-1,NG-2,andNG-3districts.Allbuildingsshallbe subjecttothefollowingstandards.Thisappliestosingletenantbuildings,multipletenant buildings,andanygroupingofattachedorstandalonebuildingsandassociatedpadsites. UsesexemptedfromthisSection:Churches;publicPrimary&SecondaryEducational Facilities;MunicipalIndustrialfacilities;andprivateutilitybuildingsthatarescreened frompublicorprivaterights-of-wayandadjacentproperties.  OutdoorLightingStandards 7.10 Itisrecognizedthatnodesigncaneliminateallambientlightfrombeingreflectedor otherwisebeingvisiblefromanygivendevelopment;however,thefollowingrequirements shallbefollowedtothefullestextentpossibleinordertolimitnuisancesassociatedwith lightingandresultingglare. A.Applicability All lightingwithindevelopmentsshallmeettherequirementsofthisSection,withthe exceptionthatsingle-familyresidential,duplexes,publicPrimary&SecondaryEducational Facilitiescontainingabuildingwitha Group “E”occupancyasdefined intheInternational BuildingCode,athletic fields,and lightingnotvisiblefromtheperimeterofadevelopment areexempted. B.SiteLightingDesignRequirements 1.Fixture(luminaire) The lightsourceshallnotprojectbelowanopaquehousing. No fixtureshalldirectly project lighthorizontally. 2.LightSource(lamp) Onlyincandescent,florescent,metalhalide,mercuryvapor,orcolorcorrectedhigh- pressuresodiummaybeused.Thesametypemustbeusedforthesameor similartypesoflightingonanyonesitethroughoutanymaster-planned development. 3.Mounting Fixturesshallbemountedinsuchamannerthattheprojectedconeoflightdoes notcrossanyproperty line. C.SpecificLightingRequirements 1.Façadeandflagpolelightingmustbedirectedonlytowardthefaçadeorflagand shallnotinterferewiththenight-visibilityonnearbythoroughfaresorshinedirectly atanyadjacentresidentialuse. 2.Alllightingfixturesincorporatedintonon-enclosedstructures(i.e.,gaspump canopies,carwashes,etc.)shallbefullyrecessedintotheundersideofsuch structures.
