At this time, the Chairman will open the floor to citizens wishing to address the Commission on the recently adopted Unified Development Ordinance. PI3eZ Agenda April 15, 2004 Page 2 of 2 `~ ~~ COLLEGE STATION CITY OF COLLEGE STATION DEVELOPMENT SERVICES 1101 Texas Avenue South, PO Box 9960 College Station, Texas 77842 Phone 979.764.3570 /Fax 979.764.3496 MEMORANDUM • • April 8, 2004 TO: Planning & Zoning Commission FROM: Lauren Harrell, Planning Intern SUBJECT: Supplemental Standards for driving ranges In response to concerns raised by the Planning and Zoning Commission about negative impacts of driving ranges on neighboring residential properties, staff has completed a survey of communities and their regulations on such uses. Many communities surveyed permit driving ranges and/or golf courses adjacent to or within residential areas with a special use permit and additional site plan review. A few communities outlined additional standards with which these facilities must comply. Additionally, we have reviewed a manual on driving range design published by Sportexe, a sports construction company. Based on the additional regulations within other communities, standards established in the driving range manual, and regulations currently in place within the UDO, staff recommends that driving ranges are listed in Section 6.2.C of the UDO, the Use Table, as a permitted use with supplemental standards (P*) in the A-O, C-1, C-2, and P-MUD zoning districts. The following supplemental standards would apply: o All driving ranges shall be a minimum of 10 acres and have a field size of 275 yards or greater. o For the purposes of buffering, when driving ranges are located adjacent to residentially-zoned property, they are considered a commercial use and require a fifteen-foot buffer yard and a wall per Section 7.6.F of the UDO, Minimum Buffer Standards. • o All balls must remain on the property through proper orientation of the tee boxes, adequate buffering or screening, and barrier nets as deemed appropriate by the Administrator. o No building, structure, or outdoor activity shall be located nearer to any residentially zoned property than a distance of one hundred feet. o All ground-level lighting of the landing area shall be directed away from adjacent properties and screening shall be provided with plantings, berms, or other means as deemed appropriate by the Administrator. In addition to the alteration of the Specific Use Standards, staff suggests adding parking standards for driving ranges in Section 7.2.H of the UDO, Number of Off-Street Parking Spaces Required. Provided no other amenities than the driving range are present on the site, one parking space per tee station will be adequate. Additional conditions that may have negative impacts upon adjacent residential areas include building height (2-tier tee lines), parking, lighting, and public address systems. AGENDA ITEM NO. 3: Discussion pf Subcommittee Reports. • East Side Thoroughfare Plan and Land Use Update. City Planner Kee reported that the East Side Small Area Plan was approved by the City Counal at their meeting held on March 25, 2004. AGENDA, ITEM N0.4: Discussion and possible action on a proposed connectivity index and pedesMan access ways in residential subdivisions. This item was removed from the agenda in order to modify the posting. Commissioner Davis requested that Parkland Dedication and Greenways Dedication Fees in the ET] be an item for discussion as well as the connectivity issue and how to better facilitate that. Chairman Shafer asked if the new Greenways Program Manager could meet with them to discuss these issues. City Planner Kee added that a parks representative should also be present at that meeting. Chairman Shafer requested aerial photos with the packet items. Commissioner Davis asked about receiving it via a-mail. Graduate Civil Engineer Thompson pointed out that the Commissioners could access the photos on the City's website through the GIS program. Staff will add a copy of the aerial photos to the packets. Creating a website for the Commission to access the packet information was briefly discussed. Commissioner Hall stated that the issue regarding the resignation of Development Services Department Director Kelly Templin should have some serious thought put into it and the concerns voiced by all the members of the Commission should be forwarded to and considered by the City Council. Commissioner Trapani asked how the Blue Ribbon Panel affects the Commission. Assistant City Attorney Nemcik stated that the Commission should adhere to the posted agenda. Chairman Shafer stated that the Commission is discussing a future agenda item. Commissioner Hall stated that he would like to have this item placed on a future agenda in order to discuss the Blue Ribbon Panel and the direction of the Development Services Department. • AGENDA ITEM NO. 7: Adjourn Commissioner Trapani motioned to adjourn the meeting. AGENDA ITEM NO. ,i: Hear Citizens. • Veronica Morgan, reported on the many comments made before the City Council Meeting on March 25, 2004 by a number of members of the development community regarding concerns about the Development Services Department and the resignation of the Director, Kelly Templin. She stated that consistency within the department is needed. She recommended a study by an independent 3ro party, outside the Blue Ribbon Committee, to discover the problems within that department. Brett McCully, 3009 Adrienne, echoed the comments made by Ms. Morgan, stating that there are larger issues at play and that an independent group should be charged at looking at the pattern regarding such sudden turnovers in personnel. Public hearing, discussion, and possible action on a Conditional Use Permit for the Wright Stealth Telecommunications Tower consisting of approxlmatly 3.175 acxes located on the north side of Krenek Tap Road lust east of Dartmouth Drive. (04-62) Staff Planner Reeves presented die Staff Report. In her opening remarks, Ms. Reeves stated that the applicant is requesting a Conditional Use Permit for a stealth telecommunications tower designed as an 80' flag pole. She added that Staff does not support the request, pointing out that the Land Use Plan designates this area as Single Family Medium Density. Currently, the subject property is zoned as R-4 Muiti- Famlly and developed as a single family residence, while the majority of the sunrounding properties remain undeveloped. Letters of opposition were noted and the Telecommunications Act of 1966 were given to the Commission for further information, guidelines and review. There was a brief discussion regarding the distance requirements. Chairman Shafer opened the public hearing. Mike Crain, the Sprint PCS representative, made a presentation, requesting approval of the Conditional Use Permit. A lengthy discussion ensued regarding various issues • and concerns. Mr. Crain explained that the equipment will be hidden from view and that the site will be landscaped, exceeding the ordinance by several 100 points, and also indude a brick wall, making It aesthetic to the surrounding area. Other sites P&Z Minutes April i, 2004 Page 2 of 5 were considered and rejected due to environmental issues and the terrain. Mr. Crain explained that the tower must be west of the bypasss to reach the areas requiring • service. The property owner, Arthur Wright, who resides at 1008 Holt, spoke in favor of the Conditional Use Permit, stating that it is subjective and that he believes there are many people to be served in this area by the tower. Tim Stewart, managing partner of Waterwood Townhomes, located next door to the site, expressed concern over the height of the flagpole, comparing it to the height of telephone poles and the area trees. He believes the tower would have a negative impact on the area and is not in character with the surrounding properties. Chairman Shafer closed the public hearing. Commissioner Williams motioned to deny the Conditional Use Permit. Commissioner Trapani seconded the motion, stating that the proposal doesn't fit in with the scheme of what the city is trying to accomplish on Krenek Tap Road and suggested seeking an alternative. Commissioner Williams concurred. Commissioner Hall interjected that a flagpole currently doesn't make sense in this area. Chairman Shafer concurred, stating that he appreciates the need but would prefer to see how the area develops out before doing something like this on that particular site. Chairman Shafer called the question. The motion to deny carried by a vote of 5-0-i. FOR: Shafer, Trapani, Williams, Hall, and Reynolds. AGAINST: None. • ABSTAINED: Davis. ABSENT: White 7. Public hearing, discussion and possible actlon to consider an amendment to the Zoning Ordinance by dty initiated rezoning applying an overlay zone imposing additional requirements to properties along Krenek Tap Road for a depth of 750'. (04-41) City Planner Key presented the Staff Report. She explained that the Commission took action last month to impose the overlay and that consideration tonight is for zoning in order to apply the overlay district. Ms. Kee displayed a photo outline of the area that would be affected. She reminded the Commission of the design regulations and items discussed at their previous meeting where they voted to add language to the UDO (Unified Development Ordinance) that will allow flexibility for existing structures when being enlarged or modified. In addition, the DRB (Design Review Board) would be allowed to approve materials other than the standard if doing so would allow the new construction to be more compatible with existing materials. At least 25% of the fagade facing Krenek should contain materials meeting the standard. Commissioner Davis darified the fencing requirements. Chairman Shafer opened the public hearing. Tim Stewart, Waterwood Townhomes developer, expressed some concerns about the proposed design criteria. Ms. Kee clarified the criteria, explaining that his • development would not be affected by the ordinance amendment since his development is an interior property and approved under the previous ordinance. Chairman Shafer closed the public hearing. Commissioner Trapani motioned to approve the amendment, which was seconded by Commissioner Davis. The motioned carried 6-0. These changes are considered generally administrative in nature. He presented a series of slides of the 7 areas to be considered as well as the proposed • action to be taken. He reported that all property owners were notified by mail of the proposed amendments. A brief discussion followed. Chairman Shafer opened the public hearing. David White, a property owner in the area, made a few comments, speaking in favor of the city's proposal. Chairman Shafer closed the public hearing. Commissioner Trapani motioned to approve the amendments. Commissioner Reynolds seconded the motion which carried by a vote of 6-0. FOR: Shafer, Trapani, Reynolds, Hall, Davis, and Williams. Commissioner Hall asked Staff to forward a statement and recommendation to the City Counal for an independent consultant to look into the resignation of • Development Services Director Kelly Templin and the consistent high rate of staff turnover in that department. He stated that he hopes the City Coundl will recognize that reducing the staff turnover and decreasing tension is important for the future of the City and the development services department. Chairman Shafer concur ed. He stated that the recommendation by Veronica Morgan and Brett McCully was reasonable and he agreed that an independent study should be conducted. Commissioner Trapani was of the same mind. All others were in unison with the statements made. They agreed unanimously to place this item on a future agenda for further discussion. 10. Adjourn. Commissioner Williams motioned to adjourn the meeting, which was seconded by Commissioner Trapani. The motion carried 6-0, FOR: Shafer, Trapani, Reynolds, Hail, Davis, and Williams. AGAINST: None. (04-82) Applicant: Phyllis Hobson, Nantucket, Ltd., property owner Staff Recommendations: Staff recommends approval of the rezoning. Item Summary: The applicant is requesting rezoning in order to develop the property as single-family residential. The property was zoned PDD-H in 1997. The PDD expired in 2003 and the zoning reverted back to A-O Agricultural-Open. Staff sees the purpose of this PDD reinstating the previously approved land uses in the PDD-H. • Changes from the previously approved PDD-H zoning include a street connection to Nantucket Drive. Requested PDD Uses: Single Family Residential lots (similar to South Hampton Phase 1), buffers, and landscape reserves. The proposal includes 43 single family lots with an average lot size of just over 1 /4 acre. If the PDD zoning is approved, the lot configuration and street layout will go before the Design Review Board for approval. Comprehensive Plan Considerations: The request is in compliance with the Land Use Plan, which designates this property as Single-Family Residential Medium Density. Nantucket Drive is shown as a minor collector on the Thoroughfare Plan. The property is surrounded by R-1 to the southwest, developed Nantucket in the ETJ to the south, developed South Hampton Phase 1 to the east, and developed A-O across Nantucket Drive to the northwest. Item Background: The property was annexed into the City in 1996 and zoned • A-O Agricultural Open at that time. In 1997 the City Council gave direction for City staff to initiate rezoning of the properly to PDD-H. An amendment to the PDD ordinance was approved in August 2001 that placed an expiration date of R:WTLTRIPZLTRIPRODIPZ20041P0009416.
