Ps!blic C-omment on the unified Development Ordinance (U~ DO) At this time, the Chairman will open the floor to citizens wishing to address the Commission on the recently adopted Unified Development Ordinance. The citizen comments will be limited to three minutes in order to accommodate everyone who wishes to address the Commission and to allow adequate time for completion of the agenda items. The Commission will receive the information and it will be added to the public record. (A recording is made of the meeting; please give your name and address for the record.) 1. Hear Citizens. At this time, the Chairman will open the floor to citizens wishing to address the Commission on planning and zoning issues not already scheduled on tonight's agenda. Public hearing, discussion, and possible action on a Rezoning from C-3 Light Commercial to PDD Planned Development District for the Space Control Limited located at 3820 and 3910 Harvey Road. (03-282) Kelly Templin presented the Staff Report, explaining that the applicant desires to expand their business into the neighboring property at 3910 Harvey. He pointed out the uses in a PDD. Jessica Jimmerson, a local planning consultant representing the applicant, stated that the request is to rezone 2 pieces of property, one that is akeady developed under the old zoning ordinance and the second is proposed for expansion, pointing out that the proposed use is a low traffic generator as well as low noise and nuisance and is in compliance with the 30/60 plan, the PDD Policy, the UDO, the City's Comprehensive Plan, Strategic Plan and the Code of Ordinances. Chairman Shafer opened the public hearing. Kathy Eugster, 12 Vista Lane, spoke in opposition to the development, expressing concerns regarding flooding, stating that adding this development to the existing development that currently has become a nuisance with it's lighting and noise would only exacerbate the problems. • John Vilas, Chairman of the Harvey Hillsides Architectural Control Committee and residing at 15 Ranchero, concurred with the Stafl's recommendations. He added that the noise complaints voiced by Ms. Eugster should be directed to the adjacent business development. He . also clarified the hours of operation for the storage facility and said that he was unaware of any lighting problems, but would take steps to correct the problem if one does exist. Development Services Director Templin confirmed that this item would be required to go before the Design Review Board where all the issues of a PDD development would be addressed. Chairman Shafer closed the public hearing. Commissioner Trapani motioned to approve the rezoning. Commissioner White seconded the motion. The motion carried by a vote of 6-0. Public hearing, discussion, and possible action on a Variance Request to Section 8-G.6 of the Subdivision Regulations concerning minimum turnaround dimensions of cul-de-sacs; a Variance Request to Section 12-1.4 concerning street jogs; and, a Preliminary Plat for The Glade Section 12 consisting of 17 lots on 3.03 acres generally located off of Southwest Parkway across from Southwood Drive. Public hearing, discussion and possible action on a Replat for Belmont Place Section 2 Block 3 consisting of 2 lots on 25 acres located at 1604 Rock Prairie Road. (03-288) Graduate Civil Engineer Cotter presented the Staff Report, recommending approval with Staff • Review Comments. She pointed out that the College Station Medical Center is located on this property, adding that the applicant is dedicating 60 feet of right-of--way for the extension of Normand Drive as well as public utility easements for current and proposed expansions of the hospital. Public hearing, discussion, and possible action on a Replat for Sutton Place Block 1 Lots 1&2 on 3.958 acres located at the southern corner of the intersection of the Highway 6 southbound frontage road and Holleman Drive. (03-2b3) Graduate Civil Engineer Cotter presented the Staff Report, recommending approval of the Replat that ___ .consists of moving a lot line between two lots, and adding a common access and.parkang easement so the property may function as a single building plot. She added that the subject property is in compliance with the Land Use Plan and the Wolf Pen Creek Master Plan. Chairman Shafer opened the public hearing. Mike McClure, 9262 Brookwater Circle, spoke in favor of the item, stating that the lot lines were moved in conjunction with the akeady approved site plan. He confirmed that Holleman is the primary access to the subject property. Chairman Shafer closed the public hearing since there were no other remarks by anyone. Commissioner White motioned for approval of the Replat. Commissioner Davis seconded the motion, which carried by a vote of 6-0. FOR: Trapani, Reynolds, Shafer, White, Williams, and Davis. Consideration, discussion and possible action on a Variance Request Section &J.2 of the Subdivision Regulations concerning block length and a Preliminary Plat for Castlegate Section 5 consisting of 102 lots on 32.33 acres located off Greens Prairie Road and Castlegate Drive. (03-291) Graduate Civil Engineer Cotter presented the StaffReport. In her opening remarks, Ms. Cotter stated that in accordance with the PDD-H zoning approved in November 2003, the applicant has submitted a preliminary plat for Section S of Castlegate Subdivision that will allow for the development of single family homes, common areas and a greenway area. She pointed out that approval of the preliminary plat requires prior approval of the variance. She added that the DRB (Design Review Board) approved the Concept Plan on November 14, 2003 and that it is in compliance with the Land Use Plan and the modified standards approved with the rezoning, including the modifications to the standard street widths, sidewalks, lot dimensions, and setbacks. Also, access would be taken from Castlegate Drive. Ms. Cotter recommended approval of the Replat contingent upon the approval of • the vanance and the Staff Review Comments. Public hearing, discussion and possible action on a Rezoning for the Frieda Louise Huff Estate from R-1 Single Family Residential to C-2 Commercial-Industrial, consisting of 5.297 acres located at 3477 F&B Road. (03-287) The applicant pulled this item from the agenda. 13. Consideration, discussion and possible action ~-on a Preliminary Plat for Westfield Village Phases 1-5 consisting of 2791ots on 75.651 acres generally located north of Graham Road and east of Victoria. (03-298) Graduate Civil Engineer Thomspon presented the Staff Report stating that a previous preliminary plat for this PDD-H subdivision was approved in January 2002, expired in March 2003 and is being resubmitted for approval. He pointed out the modifications that were approved through the previous • preliminary plats that are also included with the submission of this preliminary plat, explaining that in lieu of internal sidewalks, public access trails will be built throughout the project. Other benefits include preservation of oepn space in prominent locations, preservation of natural resources, connectivity of natural areas within the development and to those in surroundign areas, traffic calming and avoidance of cul-de-sacs. In closing, Mr. Thompson explained that the Commission would need to approve this item prior to the next two items on the agendas. Mr. Thompson clarified that the street extension is shown to be built on CSISD property. Commissioner Trapani motioned for approval of the Preliminary Plat which was seconded by Commissioner Davis. Consideration, discussion and possible action on a Final Plat for Westfield Village Phase 2 consisting of 20 tots on 4.2 acres generally located at Barron Road and Newport Lane. (03-237) Spencer -recommends approval; no trailways in this section; roadways and lots being constructed in this phase; Graduate Civil Engineer Thomppon presented the Staff Report, stating that all requirements have been met, including the PDD requirments by the City Council and the Planning and Zoning Commission. • i A mot on for approval was made by Commissioner Trapani and seconded by Commissioner Williams. Consideration, discussion and possible action on a Final Plat for Westfield Village Phase 3 consisitng of 621ots on 16.6 acres generally located at Barron Road and Victoria (future). (03- 238) Graduate Civil Engineer Thomspon also presented this item to the Commission, pointing out the existing walkways. Also, a portion of Victoria is being constructed to Barron Road, leaving a portion of Victoria until infill development is completed. Funds for widening Barron Road are not available at this time. Mike McClure, McClure Engineering added that additional walkways over and beyond the minimum required in a PDD will take place in the next phase and will be going all through the greenway. Commissioner Trapati motioned to approve the Final Plat which was seconded by Commissioner Davis and carriecd by a vote of 6-0. FOR: Trapani, Reynolds, Shafer, White, Williams, and Davis. AGAINST: None. ABSENT: Hall. 16. Public hearing, discussion and possible action on a request to amend the City's Comprehensive Plan for approximately 85 acres generally bound by the Highway 6 frontage road, Arrington Road and the South Oaks Subdivision. (03-240) • City Planner Kee presented this item to the Commission. She stated that the request was to amend the Land Use Plan for 9.22 acres located at and in the vicinity of 4506 State Highway 6 South. Ms. Kee continued by explaining that the subject property was annexed in 1983 under an A-O rezoning. She pointed out the existing uses and access points and explained that the water lines will be extended for development. The current Land Use Plan designation for the subject property is Medium Density Single Family and is intended to provide for single-family detached residential developments while the proposed Land Use Plan designation is for Retail Regional and is intended to provide for regional-scale development of tax-generating developments. These are generally dependent on good access to highways and major arterials. Ms. Kee explained that land use planning cannot be conducted on an individual parcel in isolation and that the appropriate land use designation is partially determined by its relationship to the surrounding area. She stated that while the application was submitted for a specific parcel, the Staff analysis covers an 84.7-acre area that includes surrounding properties. Ms. Kee explained the 4 factors Staff used to determine the recommendation that is presented for consideration. Ms. Kee clarified for Commissioners Davis and White where fixture State Highway 40 will line up with the subject property and that the acreage would also be considered regional retail. Chairman Shafer asked about the existing homes. Ms. Kee stated that residents were notified of the possible changes and are in support of it. Don Jones, 804 Berry Creek, a representative for the applicant, stated that he hasn't received any • responses from his attempts to reach the adjacent property owners. Item Summary: This item is for the consideration of a Master Preliminary Plat for the Crowley Tract, located at Greens Prairie Road and SH 6 South. Item Summary: This preliminary plat consists of 17 lots on 3.03 acres zoned R-1 Single Family Residential. The property is surrounded by developed single family to the west, north, and east, and Southwest Parkway to the south. The preliminary plat is in preparation of a single family infill development. Although setbacks are shown on the preliminary plat, approval of the plat does not • confirm these distances. The UDO at this time allows for a different front setback depending on the configuration of a home's parking. Such a setback may be allowed, and will be determined at the time of building permit. Previously two variances were being requested, one to Section 8-G.6 of the Subdivision Regulations conceming minimum turnaround dimensions of cul-de- sacs, and the other variance request was to Section 12-1.4 concerning street jogs. Since the first submittal these two requests have been retracted and are no longer needed. A neighborhood meeting was held on the evening of December 11, 2003 by the applicants to present their ideas to the adjacent Mile Drive neighborhood. At the meeting the residents specifically mentioned several uses that they would like excluded from the PDD that are included in this application, including: dry cleaners/laundry, restaurants, utilities, and wireless telecommunication towers. The neighbors also expressed an interest in a maximum height of 2 stories for any development on the site. Item Summary: In 1988 this property was rezoned from A-P to C-3 after an agreement was reached between the residents of Mile Drive and the owners of the subject property. The agreement included a greenbelt reserve and an adjacent access easement to serve as a 70-foot setback from the residential • property for future structures on this site, and C-3, a less intense commercial district. Mini-storage warehouse was a permitted use at the time this agreement • was reached. With the adoption of the UDO mini-storage warehouses were removed from the C-3 zoning district. The applicant is requesting rezoning in order to develop the property as a mini- storage warehouse. Mini-storage warehouse (Storage, Self-Service) is a permitted use in C-1, C-2, and M-2. While these districts allow mini-storage warehouses, they also allow many other uses that are not appropriate in this location which has limited access and abuts an established single family neighborhood. The purpose of the Planned Development District is to promote and encourage innovative development that is sensitive to surrounding land uses and to the natural environment. The PDD can be used to produce an environment in harmony with surrounding development. Staff sees the purpose of a PDD in this location as restoring an agreement between the owners of the subject property and the adjacent Mile Drive neighborhood, and limiting uses next to an established neighborhood that may experience cut-through traffic as a result of development of this property. Comprehensive Plan Considerations: The Land Use Plan currently designates this property for single family development. The Land Use Plan must be • amended in order for the proposed rezoning to be approved. Retail Neighborhood or an Office designation may be appropriate for this area. Texas Avenue is a major arterial and the East Bypass is designated as a Freeway on the Thoroughfare Plan. The convenience store at the corner of Texas Avenue South and Deacon/ Frontage Road is zoned C-3, the property to the north is zoned R-1 and developed as single family residential, and the property to the northeast is zoned A-P and is undeveloped. Applicant: Boyd Moses, Clark Moses Entertainment Staff Recommendation: Unless the public hearing brings to light any new information indicating potential negative impacts, Staff recommends approval. While parking continues to be an issue at this shopping center, the other uses in the center have peak hours that differ from the proposed nightclub. Item Summary: The applicant is requesting a Conditional Use Permit in order to open a nightclub in a portion of the old Fuddrucker's lease space in the Brazos Square Shopping Center on Texas Avenue. The proposal includes a 3,900 square foot nightclub with recorded music and karoke. The proposed hours of operation are from 5:00 p.m. to 2:00 a.m., Monday through Saturday, with • anticipated peak hours from 11:30 p.m. until 2:00 a.m. The property currently has 178 parking spaces on site. According to the UDO, the required number of spaces for a shopping center of this size, if developed today, would be 250 parking spaces. Additionally, approximately 45 parking spaces will be lost with the widening of Texas Avenue that is scheduled to commence early this summer. Generally, shopping centers are permitted to have a maximum of 25% of intense uses, including restaurants, coffee shops, nightclubs, and theatres, without additional parking being provided. Currently, 39.5% of the uses in this center are considered intense uses (including the Fuddrucker's lease space). In 1983 Brazos Square shopping center was given permission to open additional intense uses without additional parking.. Because the intense uses were permitted to open, and the use in the old Fuddrucker's lease space has not been abandoned, an intense use, including another restaurant, is permitted to re-open in this lease space without the provision of additional parking. The parking deficiencies and the amount of intense use in the shopping center are grandfathered. Comprehensive Plan Considerations: The Land Use Plan designates this area as Retail Regional and Texas Avenue is a major arterial on the Thoroughfare Plan. The property is zoned C-1 General Commercial and is surrounded by C-1 to the north and south, R-4 developed as an apartment complex to the west, and Texas Avenue to the east. . Item Background: The property is currently platted. The Brazos Square Shopping Center was developed in the early 1980's. Analysis: The Planning and Zoning Commission may recommend to the City Council to approve an application fora conditional use permit where it reasonably determines that there will be no significant negative impact upon residents of surrounding property or upon the general public. The Planning and Zoning Commission may recommend to the City Council to impose additional reasonable restrictions or conditions to carry out the spirit and intent of the UDO and to mitigate adverse effects of the proposed use. This request is necessary in order to develop the new Class "A" City business park (Spring Creek Corporate Campus) in accordance with the master plan which was reviewed by the Planning and Zoning Commission and approved by the City Council. The overall goal of the Spring Creek Corporate Campus is to provide a quality • environment for businesses to locate in College Station. All developments in the park will be required to have "forest preserves" with a 50 foot preserve along Pebble Creek Parkway and Lakeway Drive and a 100 foot preserve along State Highway 6 and smaller preserves along the sides and rear of all sites. This will create a "Woodlands" effect for the development. The proposed roadways are in conformance with the adopted Thoroughfare Plan and the Rock Prairie Small Area Plan. Additional roadways would not provide access to other tracts, as there is significant floodplain on either side of this property that has been dedicated as greenways. Where a street would normally be provided at the 800 foot block length a public access easement has been shown that will provide pedestrian access to the greenways trail system.
