At this time, the Chairman will open the floor to citizens wishing to address the Commission on planning and zoning issues not already scheduled on tonight's agenda. The citizen presentations will be limited to three minutes in order to accommodate everyone who wishes to address the Commission and to allow adequate time for completion of the agenda items. The Commission will receive the information, ask city staff to look into the matter, or will place the matter on a future agenda for discussion. Non- housekeeping items in this section include restrictions on political and non-commercial signs and provisions for the removal of signs when the associated building is demolished. Additionally, staff received direction at the 14 December 2005 Joint City Council/P&Z Commission meeting regarding community spirit signs and signage for neighborhood groups. Draft ordinance language will be available at the March 2"d meeting for your review and consideration. Following is a summary of proposed changes by category: Non-commercial and political signs: Language was added to Section 7.4.Q limiting the size of non-commercial signage to 50 square feet, clarifying that signs may not be placed in any public Right of Way, and providing a time limit for political signs. The proposed changes will allow non-commercial signs related to an event to be placed up to 90 days prior to the event and require sign removal within 10 days after the event. Sign removal: Section 7.4.X was amended to require signs to be removed if the associated building is demolished. A number of sites have redeveloped in the City white maintaining their grandfathered freestanding sign status by not removing the existing sign. This provision will require sites that are completely demolished to remove any freestanding signs. When new signage is installed, it will be required to comply with the provisions of the Unified Development Ordinance. • Community Spirit Signs: Proposed language will amend Section 7.5.E to allow • "Community Spirit" signs if authorized by contract with the City or a Council resolution. Applicant: Ken Tatt, agent for the owner, BDC Properties Staff Recommendations: Staff recommends approval of the final plat. Item Summary: This item is for consideration of a Final Plat for Rosa's Subdivision Lots 1 and 2. The property is located along University Drive East across from Tarrow. This plat is in preparation for commercial development on the property. Lot 1 is proposed for a restaurant. No site plans have been submitted for Lot 2. Comprehensive Plan Considerations: The Comprehensive Land Use Plan identifies this area as Retail Regional. The property has 261 feet of frontage on University Drive East, a major arterial on the City's Thoroughfare Plan. • This plat is in the University Drive Small Area Plan, and is subject to the requirements of the University Overlay District. Access has been granted via access easements to the east and west of the property. The lots will not have direct access to University Drive East, in compliance with TxDOT and the City's access management policies. This plat meets the requirements for both the preliminary and final plat and is in compliance with all minimum subdivision requirements. This plat meets all the requirements of a preliminary and a final plat. Item Background: This property was annexed into the City in 1956 and subsequently zoned R-1. In the early 1970s it was rezoned to C-1. The property has never been platted. Currently, there is a site plan under review for Lot 1 of this property for a restaurant. The property to the east is currently under development as the University Town Center. Applicant: Sendera Wellborn, Ltd. - M.L. Schehin, Property Owner Staff Recommendations: Staff recommends approval of the preliminary plat if the variance request is granted by the Commission. Item Summary: This item is for consideration of a variance request to the Subdivision Regulations for block length, and a preliminary plat for Sendera Subdivision. The proposed lots range in size from 1.35 acres to 8.8 acres. Section 12-K.2 of the Subdivision Regulations states that the block length shall not exceed 1,500 feet in rural residential subdivisions. In blocks over 800 feet in length, the Planning & Zoning Commission may require access ways to facilitate pedestrian • traffic movement. The proposed block in the subdivision is 1,953 feet in length, requiring a variance of 453 feet. The applicants' justification for the variance is attached. The Subdivision Regulations Section 5-A state that "The Commission may authorize a variance from the regulations when, in their opinion, undue hardship will result from requiring strict compliance. In granting a variance, the Commission shall prescribe only conditions that it deems not prejudicial to the public interest. In making the findings hereinbefore required, the Commission shall take into account the nature of the proposed use of the land involved, the existing use of the land in the vicinity, the number of persons who will reside or work in the proposed subdivision, the possibility that a nuisance will be created, and the probable effect of such variance upon traffic conditions and upon public health, convenience, and welfare of the vicinity. No variance may be granted unless the Commission finds: 5-A.1 That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; 5-A.2 That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; 5-A.3 That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and • • 5-A.4 That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter." Comprehensive Plan Considerations: The Land Use Plan shows most of the land in the ETJ to be developed at a rural density (very low density residential development with agricultural and support uses). The City does not control land use in the county, but does share platting authority. FM 2154 is designated as a Major Arterial on the City's Thoroughfare Plan. Item Background: The subject property was brought into the ETJ in 1995. To the north adjacent to the subject property is Bentwood Estates which was platted in 2003 and developed as rural residential lots. Across FM 2154 from the subject property is Duck Haven Estates that was platted and developed in 2004 as rural residential lots as well. The Subdivision consists of 231ots, which is less than the maxirnurn of 30 lots allowed on a single cul-de-sac in rural residential subdivisions. A.4 That the granting of the variance will not have the efj"ect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. The surrounding land will still be able to develop in any manner acceptable to the City of College Station. The granting of this variance will not prevent the orderly subdivision of other land. The land to the north and west of this property is already developed, and the undeveloped tracts to the east of this development each have enough frontage on FM 2154 to have multiple access points to FM 2154. •
