Phc~nc 979.764.357(1 / Fas 979.7G4.349G MEMORANDUM DATE: March 1, 2007 TO: Members of the Planning & Zoning Commission FROM: Crissy Hartl, Staff Planner SUBJECT: Use of the PDD Planned Development District The Planning & Zoning Commission requested to learn more about the use of PDD Planned Development District in the 2006-2007 Plan of Work. The information below serves as background information to Planned Development Districts and an introduction to future • discussions about the use of PDDs. As stated in the Unified Development Ordinance, the purpose of the Planned Development District is to promote and encourage innovative development that is sensitive to surrounding land uses and to the natural environment. The Planned Development District is intended to produce: 1. A maximum choice in the type of environment for working and living available to the public; 2. Open space and recreation areas; 3. A pattern of development which preserves trees, outstanding natural topography and geologic features, and prevents soil erosion; 4. A creative approach to the use of land and related physical development; 5. An efficient use of land resulting in smaller networks of utilities and streets, thereby lowering development costs; 6. An environment of stable character in harmony with surrounding development; and 7. Amore desirable environment than would be possible through strict application of other sections or districts in this UDO. The Planned Development District offers flexibility to development standards, such as variations to setbacks, density, and dimensional standards, where community benefits are provided. However, the PDD may not be used to guarantee specific site or building characteristics within the development, apply additional development standards to a single site, or vary from certain development standards unless community benefits outweigh the requested modifications. Item Summary: The applicant is proposing to convert four existing lots into two. The existing lots are 25-feet wide, and approximately 115 feet deep. The proposed lots will be 50 feet wide and 115 feet deep. In its current configuration, the lots are combined in a single building plot. Section 18 of the Subdivision Regulations requires that replats in residential areas previously platted prior to 1970 must have at least 8,500 square feet for each lot and the width must meet • or exceed the average lot width on the block. The plat requires a variance of 2,750 square feet to lot size and 8.85 feet to the lot width. The average lot width on this street is 58.85 feet. Of the 21 lots, 14 of these lots have a width of less than 50 feet. In considering a variance, the Planning and Zoning Commission should make the following findings: 1. That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; 2. That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; 3. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and 4. That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. Applicant: Robert Todd, Agent for Owner Staff Recommendations: Staff recommends approval of the rezoning from C-1 General Commercial to A-O Agricultural Open for the jurisdictional wetlands portion and R-4 Multi-Family for the remainder of the tract. Item Summary: This item is a rezoning in the Gateway Center from C-1, General Commercial to R-4, Multi-Family to continue the multi-family development in the area. The Comprehensive Plan was amended in January of 2007 by the City Council from Floodplain & Streams to Residential Attached for this property. During discussions, the City Council expressed concerns about the jurisdictional wetlands portion being developed. The applicant has proposed to rezone the wetlands portion of the subject property to A-O, Agricultural Open. Zoning the wetlands portion to A-O will prevent development in these areas. • The applicant states that they are requesting the rezoning in order to provide uniform development by continuing the construction of multi-family units. The Gateway Villas, which is considered amulti-family development, are located adjacent to the subject property to the west. Comprehensive Plan Considerations: The Land Use Plan reflects Residential Attached for the subject property. The majority of the property is located in the 100-year floodplain. Jurisdictional wetlands have been identified as well. To the north of the subject property is the City of Bryan which is also Burton Creek and 100-year floodway. To the east is undeveloped C-1, General Commercial and R-1, Single Family Residential, which are reflected as Floodplains and Streams on the Land Use Plan. To the south is C-1, General Commercial developed as a Home Depot. Between the subject property and Home Depot is a regional detention facility for the Gateway Development, which is reflected as Floodplains and Streams and Retail Regional on the Land Use Plan. To the west is R-4, Multi-Family developed as multi-family and reflected as Residential Attached and Floodplain and Streams on the Land Use Plan. The jurisdictional wetlands are located on both the northeast and northwest corners of the subject property. The zoning proposal is in compliance with City's Comprehensive Plan. Item Background: The subject property was annexed into the City of College Station in 1971 and platted in 1981. In 1995, the subject property was rezoned from R-1, Single Family to C-B, Commercial Business. With the adoption of the Unified Development Ordinance in June of 2003, several zoning districts were combined. C-B Commercial Business zoning district became C-1 General Commercial, which is the current zoning. In January of 2007, the Comprehensive U 38 • Plan was amended from Floodplains and Streams to Residential Attached for the development of this property. Item Summary: The applicant is proposing to rezone approximately 16 acres of the Animate Habitat property to C-2, Commercial Industrial. The property is surrounded by Floodplain to the south, and additional Industrial/Research and Development to the north. All adjacent property is undeveloped and zoned A-O, Agricultural Open. The applicant previously requested a M-2, Heavy Industrial classification at the February 1, 2007, Planning and Zoning Commission meeting. The applicant withdrew this item from the February 8 City Council meeting, and after considering the concerns raised by the Commission, the applicant is now requesting C-2. The Non-Residential Architectural Standards are applicable in this zoning district, and the uses allowed in C-2 are considerably less intense than those allowed in M-2, Heavy Industrial. Item Summary: The applicant is proposing to plat a single lot for residential development. The existing tract is less than five acres, which is required for platting in A-O, Agricultural Open. Typically, A-OR zoning districts are intended for developments of a minimum of 50 acres that are to be subdivided into single-family tracts no smaller than one acre. However in this case, this is how the subject property and all of the surrounding properties were annexed and everything has developed out around it. Item Summary: The property owner is requesting to plat the subject property to construct a single family home. Staff recommended approval for a number of multi-family rezonings in this area which resulted in the development of The Exchange, Fox Run Condos, and Melrose Apartments. The properties meet the City's development policies for the location of multi-family due to its proximity to the University and its frontage on Jones Butler, FM 2154, Luther West, and Holleman Drive East, all identified on the City's Thoroughfare Plan, however the Comprehensive Land Use Plan has never been amended to reflect these changes to the development pattern in this area. No existing development will become noncompliant because of the changes. • Staff is proposing to reflect the existing PDD zoning districts at the Rattler convenience center and the Canyon Creek Townhome development as Planned Development because of the unique requirements for open space or buffering required in the ordinances that were adopted for these properties. Fitch Parkway from A-O Agricultural Open to PDD Planned Development District. - Applicant: Jane Kee, Agent for the owner Staff Recommendations: Staff recommends approval of the rezoning request. Uses Proposed: Residential housing not to exceed 9 dwelling units per acre. Item Summary: As stated by the applicant, the proposed Planned Development District is "to provide residential housing that does not exceed the density of the high density single family land use classification, but that provides an alternate type of housing choice within the market." The PDD District is the only available district that provides for the meritorious modifications of the regulations that allows for the developer to develop a mix of attached and detached residential housing while maintaining a density standard of 9 dwelling units per acre. The subject property is surrounded by developed single family residential to the north and west, Fire Station No. 5 to the east, and both developed and undeveloped single family residential to • the south. Comprehensive Plan Considerations: The property is currently designated as Single Family Residential Medium Density on the City's Comprehensive Land Use Plan although an application for Planned Development is pending. The Thoroughfare Plan identifies William D. Fitch Parkway as a Major Arterial in this area. Item Background: A majority of the tract was annexed in 1983 and the remaining portion was annexed in 1995. The tracts were subsequently zoned A-O Agricultural-Open after annexation. The property is currently unplatted. • Related Advisory Board Recommendations: If the PDD rezoning is approved, the Design Review Board and Parks Board will be responsible for the review of the concept plan. Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval of rezoning as submitted; 2. Recommend denial; 3. Table indefinitely; or, 4. Defer action to a specified date. INFRASTRUCTURE AND FACILITIES a2 • Water: There is an existing water main on the south side of William D Fitch Parkway and a water main near the southeast property comer. Sewer: There is an existing sewer main along the eastern boundary of the property. Streets: Access will be from William D Fitch Parkway which is classified as a Major Arterial on the City's Thoroughfare Plan. Off-site Easements: None known to be required at this time.
