AN ORDINANCE RELEASING A BLANKET EASEMENT FOR THE INSTALLATION OF UNDERGROUND
ELECTRICAL SERVICE, HERETOFORE GRANTED TO THE CITY, IN, ON AND ACROSS ONE
CERTAIN TRACT OR PARCEL OF LAND WITHIN THE CITY LIMITS, AND DESCRIBED MORE
PARTICULARLY HEREIN, AND AUTHORIZING THE MAYOR TO EXECUTE A RELEASE AND
RECORD SAME IN THE DEED RECORDS OF BRAZOS COUNTY, TEXAS.
WHEREAS, on or about July 1, 1980 , the Oakwood Apartments, Ltd., a
Texas Limited Partnership acting by and through Kenneth W. Schick, did
convey unto the City of College Station a "blanket easement" on,
across, and through all and every part of that one certain lot, tract
or parcel of land, more particularly described in the attached
Exhibit "A" which is incorporated herein for the purpose of descrip-
tion, said easement for the purpose of installing underground
electrical service; and
WHEREAS, the said limited partnership and Kenneth W. Schick, has now made a
subsequent conveyance of defined easements being 15 feet in width,
for the completed and existing underground electrical system, and
same being for the completed and existing underground electrical
system, and same being and constituting the only rights and interests
needed or desired by the City for the operation and maintenance of
said electrical system;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
1. That all of the rights, title and interest of the City in and to
the tract of land described upon the attached Exhibit "A ", is hereby
released and quitclaimed unto the said Oakwaood Apartments, Ltd. and
Kenneth W. Schick, Trustee, but only to the extent that such right,
title and interest exists by virtue of that one certain easement
heretofore executed on July 1, 1980, and recorded in Vol. 456, Page
704, of the Deed Records of Brazos County, Texas. EXCEPTING herefrom
all other rights, easements, privileges and appurtenances now held by
the Grantor hereof in and to the tract of land described, and in
particular, by way of enumeration without limitation, excepting from
this conveyance, all rights, easements, privileges, and appurtenances
granted to the City by virtue of the above - described easement conveyance,
recorded in Vol. 478, Page 621 of the Deed Records of Brazos County, Texas.
2. That the Mayor of the City of College Station is hereby
authorized to execute a release of such easement, and to record same
in the deed records of Brazos County, Texas, the cost of such recording
to be paid by the Grantee thereof.

EXHIBIT "A"
Being all of that one certain lot, tract or parcel of land lying and
being situated in the Crawford Burnett League, Abstract 7, Brazos
County, Texas, and being a portion of the 29.622 acre tract conveyed to
Kenneth Schick by E. Kelly Parker, Trustee by Deed Recorded in Volume 436,
Page 558 of the Deed Records of Brazos County, Texas and being more parti-
cularly described by metes and bounds as follows:
BEGINNING at an iron rod found marking the north corner of the
aforementioned 29.622 acre tract, also being the west corner of that
tract conveyed to College Station X617, Ltd., a limited partnership by
deed recorded in Volume 331, Page 625 of the Deed Records of Brazos
County, Texas; also lying in the southeast right -of -way line of
Nevada Street;
THENCE S 46 0 00'43" E along the common line between the College Station #17,
Ltd., tract and the said 29.622 acre tract for a distance of 847.85 feet
to an iron pipe found for corner, said corner also being the south corner
of the of the College Station #17, Ltd., tract and the east corner of the
29.622 acre tract and also lying in the northwest right -of -way line of
Southwest Parkway;
THENCE S 57 0 14'10" W along the northwest right -of -way line of Southwest
Parkway for a distance of 638.26 feet to an iron rod set for corner;
THENCE N 46 0 00'43" W across said 29.622 acre tract for a distance of
716.02 feet to an iron rod set for corner, said corner lying on the
northwest line of the said 29.622 acre tract;
THENCE N 45 0 19'10" E along the northwest line of the 29.622 acre tract
for a distance of 621.44 feet to the PLACE OF BEGINNING and containing
11.15 acres (485,796 square feet) of land, more or less.
