AN ORDINANCE REZONING A 24.81 ACRE TRACT FROM AGRICULTURAL /OPEN DISTRICT A -0 TO
GENERAL COMMERCIAL DISTRICT C -1 (TRACT NO. 1) AND A 63.61 ACRE TRACT FROM
AGRICULTURAL /OPEN DISTRICT A -0 TO TOWNHOUSE DISTRICT R -3 (TRACT NO. 2), BOTH
TRACTS BEING A PORTION OF ALL THOSE TRACTS CONVEYED TO EDWARD UVACEK, JR. AND
WIFE, BEATRICE UVACEK, BY CLARICE R. ROYDER AND ADDIE M. ROYDER BY DEED RECORDED
IN VOLUME 321, PAGE 664 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS AND BEING
MORE FULLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS:
WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M.
on Thursday, June 26, 1980 on the question of rezoning certain areas within the
City Limits;
AND, WHEREAS, the City Council has determined the following:
To rezone or change the classification of a 24.81 acre tract (Tract No. 1) and
a 63.61 acre tract (Tract No. 2) both tracts being a portion of all those tracts
conveyed to Edward Uvacek, Jr. and wife, Beatrice Uvacek, by Clarice R. Royder
and Addie M. Royder by deed recorded in Volume 321, page 664 of the Deed Records
of Brazos County, Texas and being more fully described by metes and bounds as
follows:
TRACT NO. 1
A 24.81 acre tract or parcel of land lying and being situated in the Robert
Stevenson Survey, Abstract No. 54 and the Thomas Caruthers Survey, Abstract No. 9,
Brazos County, Texas and being a portion of a 60.213 acre tract, listed and
described as Tract One in a deed from Frances Bilsing and Neal Dancer to Edward
Uvacek, Jr., and wife, Beatrice Uvacek, and recorded in Volume 274, page 383
of the Deed Records of Brazos County, Texas:
BEGINNING at a railroad cross -tie found marking the west corner of the aforesaid
60.213 acre tract, said corner also lying in the northeast right -of -way line
of State Highway 6;
THENCE N 45 0 47'52" E along and old fence line for a distance of 231.39 feet to
a 1 inch iron pipe for angle point.
THENCE N 44 0 47'11" E continuing along an old fence line for a distance of
800.00 feet to a point for corner;
THENCE S 29 0 26'56" E for a distance of 203.14 feet to the beginning of a curve
to the left;
THENCE southeasterly along said curve to the left for an arc distance of 167.55
feet to the end of said curve, (Curve data: central angle = 16 ° 00'00 ", radius =
600.00 feet, tangent = 84.33 feet, the chord bears S 37 0 26'56" E for a distance of
167.01 feet);
THENCE S 45 0 26'56" E for a distance of 150.11 feet to a point for corner;
THENCE S 44 0 33'05" W for a distance of 127.57 feet to the beginning of a curve to
the right;

THENCE southwesterly along said curve to the right for an arc distance of 111.70
feet to a point for corner; (Curve data: central angle = 8 0 00'00 ", radius =
800.00 feet, tangent = 55.94 feet, the chord bears S 48 0 33'05" W for a distance
of 111.61 feet)
THENCE S 37 0 26'56" E -- for a distance of 190.81 feet to the beginning of a curve
to the right;
THENCE southeasterly along the said curve to the right for an arc distance of
167.81 feet to the end of said curve; (Curve data: central angle = 16 ° 01'29 ",
radius = 600.00 feet, tangent = 84.46 feet, the chord bears S 29 0 26'11" E for
a distance of 167.26 feet);
THENCE S 21 0 25'27" E for a distance of 280.69 feet to a point for corner;
THENCE S 27 0 03'09" W for a distance of 80.00 feet to a point lying in the south-
east line of the aforesaid 60.213 acre tract for corner;
THENCE S 44 0 46'24" W along the said southeast line of the 60.213 acre tract for
a distance of 776.36 feet to a point lying in the northeast right -of -way line of
State Highway 6 for corner;
THENCE N 29 0 26'56" W along the northeast right -of -way line of State Highway 6 for
a distance of 1184.33 feet to the PLACE OF BEGINNING and containing 24.81 acres of
land, more or less, from Agricultural /Open District A -0 to General Commercial
District C -1.
TRACT NO. 2
A 63.61 acre tract or parcel of land lying and being situated in the Thomas
Caruthers Survey, Abstract No. 9 and being a portion of a 60.213 acre tract,
listed and described as Tract One and a portion of a 4.507 acre tract listed as
Tract Two in a deed from Frances Bailey Bilsing and Neal Dancer to Edward Uvacek,
Jr., and wife, Beatrice Uvacek and recorded in Volume 274, page 383 of the Deed
Records of Brazos County, Texas; said 73.50 acre tract also being a part of all
those tracts conveyed to Edward Uvacek, Jr., and wife, Beatrice Uvacek, by
Clarice R. Royder and Addie M. Royder by deed recorded in Volume 321, page 664
of the Deed Records of Brazos County, Texas and being more fully described by
metes and bounds as follows:
COMMENCINGat a railroad cross -tie found marking the west corner of the aforesaid
60.213 acre tract, said corner also lying in the northeast right -of -way line of
State Highway 6;
THENCE N 45 0 47'52" E along an old fence line for a distance of 231.39 feet to a
found 1 inch iron pipe for angle point;

distance of 1128.68 feet to the PLACE OF BEGINNING and containing 63.61 acres
of land, more or less, from Agricultural /Open District A -0 to Townhouse District
R -3.
And, it is ordained that said change shall become effective immediately.
