AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF HARRINGTON AVENUE,
GILCHRIST AVENUE, GROVE STREET AND NAGLE STREET IN THE CITY OF COLLEGE
STATION, TEXAS, WITHIN THE LIMITS BELOW DEFINED, PERFORMED BY B&W
CONSTRUCTION COMPANY; AUTHORIZING AND DIRECTING THE ISSUANCE OF SPECIAL
ASSESSMENT CERTIFICATES IN CONNECTION THEREWITH; DECLARING AN EMERGENCY;
AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE UPON ITS PASSAGE,
BE IT ORDAINED by the City Council of the City of College Station, Texas:
Section I. That the works of improving the following streets or portions thereof in the City
of College Station, to wit:
All that certain portion of Harrington Avenue described as follows
Commencing at the intersection of Harrington Avenue and Walton Drive thence in a southeasterly
direction along Harrington Avenue until same intersects Francis Drive; and
All that certain portion of Gilchrist Avenue described as follows:
Commencing at the intersection of Gilchrist Avenue and Walton Drive thence in a northeasterly
direction along Gilchrist Avenue until same intersects Munson Avenue; and
All that certain portion of Grove Street described as follows:
Commencing at the intersection of Grove Street and Highland Street thence in a southwesterly
direction along Grove Street until same intersects F. M. 2154; and
All that certain portion of Nagle Street described as follows:
Commencing at the intersection of Nagle Street and University Drive thence in a northwesterly
direction along Nagle Street until same intersects Inlow Boulevard;
by placing improvements to Harrington Avenue, Gilchrist Avenue and Grove Street consisting
of six (6) inch compact crushed linestome base with a one (1) inch asphalt plant mix with
concrete curbs to a width, measured from back to back of 28 feet, as provided in said plans
and specifications; and placing improvements to Nagle Street consisting of a six (6) inch compact
crushed limestone base with a one (1) inch asphalt plant mix with concrete curbs to a width,
measured from back to back of 37 feet, as provided in said plans and specifications and the said
work having been performed and completed in accordance with the provisions and terms of
the contract and the plans and specifications therein contained dated July 22, 1969, between
the City of College Station and B&W Construction Company, the city engineer of said City
having measured, examined and caused to be tested the finished improvements by the means
and in the manner provided by the terms of such contract and the plans and specifications
therein contained, and the said city engineer having found that such improvements have been
constructed and completed in full compliance with such contract and the plans and specifications
therein contained, and having approved and accepted said improvements and work and having
heretofore issued his certificate of final acceptance, and having so certified to the City Council
of the City of College Station, Texas, and having recommended that such City Council accept
and receive said work and improvements as constructed by B&W Construction Company, and
the said work and improvements having been found by the Mayor and said City Council of the
City of College Station, to have been performed and completed in full compliance with the
terms of said contract and plans and specifications, the same are hereby, now accepted and
approved by the City Council of the City of College Station, Texas,

Section II. That the Mayor and City Secretary of said City are hereby authorized and directed
to issue to the City of College Station special assessment certificates evidencing the assess-
ments against property improved abutting upon said streets within the limits above defined
and against the real and true owner or owners thereof; said assessment certificates to be
executed in the name of the City of College Station by the Mayor and City Secretary thereof
and impressed with the seal of the City and dated as to the day thereof, and such officers
are hereby authorized and directed to execute said certificates in their official capacities
on behalf of said City and deliver same to the City of College Station, Texas.
Section III. That it is necessary to immediately complete the improvements upon the
hereinabove streets in said City and to complete the assessments levied for a portion of the
cost of said improvements upon and against the properties abutting upon said streets and the
owners thereof, creates a public emergency and this ordinance should be passed on this day
and shall take effect as an emergency measure and be in full force from and after its passage
and it is so ordained.
