MEMBERS PRESENT: Acting Chairman Sawtelle, Members Rife and Hollas and Alternate
Members Ochoa and Alexander.
MEMBERS ABSENT: Chairman Birdwell, Member Poston and Alternate Member
Blackwelder.
STAFF PRESENT: Staff Planner Dunn, Planning Technician Thomas and Assistant City
Attorney Shively.
AGENDA ITEM NO. 1: Call to order.
Acting Chairman Sawtelle called the meeting to order.
• AGENDA ITEM N0.2: Consideration of a height variance request to allow the use of
three temporary drilling rigs on the Tegas A&M University campus (West campus, North
campus and South Easterwood). The three proposed oil wells are TAMU #1, TAMU #2
and TAMU #3.
Staff Planner Dunn presented the staff report and handed out updated information from the
Federal Aviation Administration (FAA). He informed the Board that the height variance request
for TAMU #2 has been withdrawn by the applicant. According to the Airport Zone Map, the two
remaining drilling rigs are located in a zone which allows a maximum height of 470' above mean
sea level (AMSL). The intended height of TAMU #1 is 520' AMSL and therefore will require a
height variance of 50'. The intended height of TAMU #3 is 483' AMSL and therefore will require
a height variance of 13'. In general, height variances shall be allowed where it is found that a
literal application or enforcement of the regulations will result in unnecessary hardship and that
relief granted will not be contrary to the public interest, will not create a hazard to air navigation,
will do substantial justice and will be in accordance with the spirit of the ordinance.
Mr. Sawtelle opened the public hearing.
Representative of the applicant Ernest Bruchez of Bruchez and Goss attorneys located at 3131
Briarcrest, Suite 200 approached the Board and was sworn in by Mr. Sawtelle. He apologized for
the withdrawal of TAMU #2; however, the FAA is overrun with aeronautical study applications
and was not able to complete it in time for the meeting. Mr. Bruchez stated that they agree with
the conditions outlined in the FAA acknowledgments for TAMU # 1 and #3.
Associate Director of Aviation at Easterwood Airport Richard Arnold approached the Board and
was sworn in by Mr. Sawtelle. He informed the Board that only TAMU #1 will effect the
• operations of the airport and minor operational changes can be made to address the approaches to
the airport. Mr. Arnold offered to answer questions pertaining to the height variance requests.
Mr. Sawtelle closed the public hearing.
Mr. Ochoa moved to grant the height variance requests for the temporary drilling rigs of TAMU
• Oil Well #1 in the amount of 50' and TAMU Oil Well #3 in the amount of 13' subject to the
conditions outlined in the Federal Aviation Administration's Aeronautical Study #95-ASW-0886-
OE (TAMU #1) and #95-ASW-0831-OE (TAMU #3). Mr. Rife seconded the motion which
passed unopposed (5 - 0).
AGENDA ITEM N0.3: Other business.
There was no other business.
AGENDA ITEM NO. 4: Adjourn.
Mr. Ochoa moved to adjourn the meeting of the Airport Zoning Board of Adjustment. Ms. Rife
seconded the motion which passed unopposed (5 - 0).
