MINUTES u Airport Zoning Board of Adjustment CITY OF COLLEGE STATION, TEXAS September 6, 1994 4:00 P.M. • MEMBERS PRESENT: Members Hollas and Poston and Alternate Members Ochoa and Blackwelder. MEMBERS ABSENT: Chairman Birdwell, Members Sawtelle and Rife and Alternate Member Alexander. STAFF PRESENT: Planning Technician Thomas, Staff Planner Kuenzel, Staff Planner Dunn, and Assistant City Attorney Shively. AGENDA ITEM NO. 1: Call to order -explanation of functions of the Board. Acting Chairman Hollas called the meeting to order and explained the functions and limitations of the Board. AGENDA ITEM NO. 2: Consideration of a height variance request fora temporary drilling rig for the Jones-Cashion Unit Well No. 1 located in the southwest quadrant of the intersection of F.M. 60 and F.M. 2818 intersection, approximately one mile from same intersection. Staff Planner Dunn presented the staff report for a temporary drilling rig located outside the City limits. According to the Airport Zone Map, the drilling rig is located in a zone which allows a maximum of 470' above mean sea level. The intended height of the rig is 521' above mean sea level and therefore will require a height variance of 51'. The City's Zoning Board of Adjustment also acts as the Airport Zoning Board of Adjustment (AZBA). The AZBA was authorized by ordinance to hear and decide specific variances to height limits. The major consideration in the determination of whether to grant a height variance is the impact that the proposed height of the structure will have on airport operations. In general, height variances shall be allowed where it is found that a literal application or enforcement of the regulations will result in unnecessary hardship and that relief granted will not be contrary to the public interest, will not create a hazard to air navigation, will do substantial justice and will be in accordance with the spirit of the ordinance. This variance request is accompanied by a determination from the Federal Aviation Administration as to the effect of the proposal on the operation of air navigation facilities and the safe use of airspace. The FAA has approved the height request subject to certain conditions as found in the FAA acknowledgment. Mr. Hollas opened the public hearing. • Attorney Ernest Bruchez representing Union Pacific Resources Company approached the Board and was sworn in by Mr. Hollas. He explained that in this case there are few alternatives to a variance request. The physical location of the rig is controlled by the Texas Railroad Commission. If the surface location was changed and if the surface location was available, the cost of relocating this particular rig would be approximately $250,000. The temporary drilling rig will be in place for 30 to 45 days. Richard W. Arnold, the Associate Director of Aviation at Easterwood Airport, approached the Board and was sworn in by Mr. Hollas. He stated that he has no objection to the variance request with the condition that the Easterwood Field Airport Manager and the College Station Airport S Traffic Control Tower manager receive a 48 hour notice prior to installation of the temporary drilling rig. The increased height of the drilling rig will effect approaches to the airport but not operations. Mr. Bruchez stated that he did not have a problem with the 48 hour notice to Easterwood Airport; however, because of scheduling and notices, the four month time limit placed on the operation by the FAA should be allowed. If additional drilling is needed after the specified January 31, 1994 deadline, the Union Pacific Resources Company will come back to the Zoning Board for additional approval. Mr. Hollas closed the public hearing Dr. Ochoa moved to grant a height variance request to allow a temporary drilling rig for the Jones-Cashion Unit Well No. 1 located in the southwest quadrant of the intersection of F.M. 60 and F.M. 2818 intersection, approximately one mile from same intersection with the condition that the FAA, the Easterwood Field Airport Manager and the College Station Airport Traffic Control Tower manager receive a 48 hour notice prior to the drilling rig being erected. Mr. Blackwelder seconded the motion which passed unopposed (4 - 0). AGENDA ITEM NO. 3: Other business. Planning Technician Thomas informed the Board that for the next several months the Board will meet in the City Hall Training Room instead of the Council Room. AGENDA ITEM NO. 6: Adjourn. • Mr. Hollas moved to adjourn the meeting of the Zoning Board of Adjustment. Ms. Poston seconded the motion which passed unopposed (4 - 0).
