ZONING BOARD OF ADJUSTMENT
November 22, 1977

MEMBERS ABSENT: Janet Storts, Tom Comstock
Agenda Item No. 1 -- Approval of the minutes of the meeting of October 1$, 1977:
Hughey moved that the minutes be approved. The motion was seconded by
Henry Hawley and unanimously approved.
Agenda Item No. 2 -- Consideration of a request for variance from Tony Jones
Construction Company at 30$-310 Amherst:
Bill Koehler explained that the building had been built over the front set-
back line on a cul-de-sac lot and that it had not been discovered by either
the City inspector or the builder until the structure was ready for occupancy.
He pointed out that the structural modifications to the building would involve
living room and kitchen areas and would thta.s require a rebuilding of at least
half of the structure. He said that there would be no interference with
utilities, that all other site requirements were met and that the building
line encroachment is not discernable except by surveyors measurements and
effects no other property.
Henry Hawley moved that the variance be granted as requested, in that all
~, requirements for variance were met. The motion was seconded by John Hughey
and unanimously approved.
Agenda Item No. 3 -- Consideration of a request for variance from H & S Tires
at 509 University Drive:
Bill Koehler explained that the request was to replace a sign on an existing
base which had been in disuse for ever one year, showed other non-conformities
in the area and stated that the height limit would have to be varied in order
for the sign to be visible to traffic on University Drive. Mr. Lonnie Scasta
said that the business had operated without the sign and found that credit
card business required a product identification. He estimated that the
proposed sign would be about the same size and height as the "ARCO" sign in the
next block.
Larry Ringer pointed out that continued variances could perpetuate nonconform-
ity throughout the area and that it might be appropriate to limit height or
size while allowing the existing base to be used. John Hughey remarked that
no strong case of hardship had been shown and that it was the intent of the
City to bring about eventual conformity with size and height requirements.
Henry Hawley pointed out that hardship could arise from non-conformity of
competitors in sight of the business. Sandra Runnels pointed out that this
might be overcome with a roof sign which is not practically limited in size or
height.

The chair moved that the variances be granted as requested. The motion
was seconded by John Hughey and failed by the following note:
