ZONING BOARD OF ADJUSTMENT
July 19, 1977
MEMBERS PRESEN'T': Chairmaa Weiss, Members Storts, Hughey
Ringer, Building Official Koehler
MEMBERS ABSENT: Comstock, Runnels
1. Approval of the minutes of the meeting of April 19, 1977: Hughey
moved that the minutes be approved as read. The motion was seconded
by Storts and unanimously approved.
2. Consideration of a request for variance from Ken Martin at 107
Dominik Drive: Koehler explained that the variance involved allowing
a spectacular sign to be placed less than 15 feet above ground and that
the sign conformed in all other respects to the ordinance requirements.
Mr. Martin said that the sign would be ~0 ft, from the street and 13 ft.
eight inches above ground. He said that the height of the building was
a limit, creating an unusual circumstance, that the existing sign was
not effective after dark creating hardships, and that it would be in
the public interest to allow the sign to be low enough to be masked
from residential areas by the building.
Mr. Wes Harper examined the plans and photographs and stated that it was
not objectionable to him.
Chairman Weiss moved that the variance be granted. The motion was
seconded by Hughey and unanimously approved.
3. Consideration of a request for variance from Dennis Jerke at
307 Glade Street: Koehler explained that the request was to constrct a
carport within 3 feet of a side property line. Mr. Jerke said that the
size of the lot and location of the existing house precluded any other
location and constituted an unusual circumstance, that he would otherwise
be unable to provide cover for his automobile creating a hardship, and
that the distance to the structure on the adjacent lot would be 15 feet
and would not be detrimental to the public interest. Weiss and Storts
expressed reservations about the loss to the adjacent neighbor of use-
able property and the effect on future owners.
Chairman Weiss moved that the variance be approved, explaining that his
motion was made as required by procedure but that he could not find
unusual circumstances in that the lot was created and the house built with
knowledge of existing ordinance requirements. The motion was seconded by
Ringer and failed by the following note:
For: None
Against: Weiss, Storts, Hughey, Ringer
4. Other Business: There was no other business.
5. Adjourn: Hughey moved that the meeting be adjourned. The
motion was seconded by Ringer and unanimously approved.
