Zoning Board of Adjustment
June 22, 1976
MENIDERS PRESENT: Chairman Weiss; Members Runnels, Hughey,
Compton; Building Official Koehler.
MEMBERS ABSENT: Storts
VISITORS PRESENT: John Drisdale, Weldon Parkhill,
Joe Keeton, Zolan Wilkins, J.C. Culpepper,
Ernest Oamp, A.C. Vinzant, Marl Bailey.
1. Approval of the minutes of the meetings of February 24, 1976 and
June 8, 1976. Compton moved that the minutes be approved. The
motion was seconded by Runnels and unanimously approved.
2. Consideration of a re uest for variance from Mr. John Drisdale,
105 Moss Street. Mr. Koehler summarized Mr. Drisdale's application
and stated that there would be no problem with the easement access
and that other structures in the block were constructed with
similar setbacks.
Weiss moved that the variance be approved as requested. The
motion was seconded by Runnels and unanimously approved.
3. Consideration of a request for variance from Imo. Ernest Camp,
1809 Sabine Court. Mr. Camp summarized the facts presented in his
application and said that the added storage space would allow him
to remove a travel trailer which he parks in his drive. Mr. Nfurl
Bailey said that the proposed extension would not be objectionable
to him. Mr. Koehler said that the drainage easement was on the
adjacent lot and that this was a five-sided lot with no clear
distinction between rear and side lot lines.
Weiss moved that the variance be granted. The motion was
seconded by Hughey and unanimously approved.
L,.. Consideration of an appeal from Lexington Apartments and Motor
Inn, 300 Dominik Drive. Mr. Koehler explained that he had deter-
mined that the presence of cooking facilities in a unit made it an
apartment dwelling unit as opposed to a living unit for transient
guests, and that parking and parkland dedication requirements for
apartment dwelling units should apply.
Mr. Parkhill pointed out that the Lexington operations had been
classed as hotel-motel~by the courts for compliance with minimum
wage laws, that maid service and utensils are furnished in the
transient units and that the twenty one other Lexington operations
in fact operate as economy motels.
Mr. Wilkins said that the operation depends upon transient unit
operations to maintain a favorable rate of return for the units, that
they did not lease units, that they had an established dai.]_y rata aria
required reservations.
Weiss moved that the Board accept the appeal, classifying 24 units
as apartments and 24 units as motel units, each to be treated separately
for parking and parkland requirements, due to the fact that the project
is in a commercial zone, that a daily rent is established, that reser-
vations are required, that maid service is furnished and that the units
are not leased. The motion was seconded by Hughey and unanimously
approved.
