MEMBERS ABSENT: Chairman Rife. STAFF PRESENT: Senior Planner McCully, Staff Planner Battle, Development Coordinator Volk, Receptionist Debbie Jenkins and Assistant City Attorney Reynolds. AGENDA ITEM NO. 1: Call to order -explanation of functions of the Board. Acting Chairman Blackwelder called the meeting to order at 6:30 p.m. and explained the functions of the Board. AGENDA ITEM N0.2: Consideration of a variance request to the minimum setback requirements at 201 Chimney Hill Circle, lot 48 of the Chimney Hill Subdivision, to allow the construction of a new home. Applicants are Scott and Linda Bair. Staff Planner Battle presented the staff report with the following variance request information: Setbacks Required: 25' front setback Setbacks Proposed: 18' front setback Staff Planner Battle explained that the subject property is located within an R-1 Single Family Residential district. The surrounding R-1 lots contain existing single family houses. The NW property line is also the City Limits line. A single family neighborhood in Bryan exists across this line. A small portion of the NE property line is adjacent to vacant A-P property. The proposed new home will be at the end of a cul-de-sac. He also stated that there is a 20' drainage easement, 30' electric easement and a 40' utility easement with high voltage lines. There were 15 property owners notified with 1 inquiry. Mr. Hollas asked about the easements. Staff Planner Battle replied that the owner could not build in the easement. He explained that with a 20' easement the house could fit but with the 40' easement it cannot. Mr.Blackwelder asked about the confusion and Mr. Battle suggested that the applicant answer that question. Chairman Blackwelder opened the public hearing. Applicant Scott Bair approached the Board and was sworn in by Chairman Blackwelder. He asked to approach the board so that he could show them a copy of the plat. He explained that the plat shows only a 20' easement. Mr. Blackwelder asked how the error was discovered. Mr. Bair explained that his builder was clearing the lot and removing some trees when the utility lines were discovered. Mr. Taggart spoke of options such as reconfiguring the house. Mr. Bau explained that the deed restrictions of that subdivision require a minimum 2200 sq. ft. house and the lot is too narrow for reconfiguration to work. • Mr. Blackwelder swore in Shannon Schunicht who stated that he is a philosopher by nature and that it makes sense to approve this variance. No one else spoke in favor and there was no one present to speak in opposition. Mr. Blackwelder closed the public hearing. Mr. Taggart made to motion to authorize a variance to the minimum setback from the terms of this ordinance as it will not be contrary to the public interest due to the following special conditions: at the end of the cul-de-sac, the street setback variance will be undetectable to the passerby and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being: Inability to construct a house which will meet the subdivision restrictions, ultimately denying the owner any reasonable use of his property and such that the spirit of the ordinance shall be observed and substantial justice done subject to the following limitation of an 18' setback. Mr. Alexander second the motion. Mr. Hollas made an amendment to the motion to add: "due to a survey error, and an easement larger than stated, the shape and dimension of the lot and the subdivision restrictions regarding minimum house size." The amended motion was seconded by David Alexander, passing with a vote of 4 - 0. AGENDA ITEM N0.3: Other business. There was no other business. • AGENDA ITEM N0.4: Adjourn. Mr. Alexander moved to adjourn the meeting of the Zoning Board of Adjustment. Mr. Hollas seconded the motion which passed unopposed (4 - 0).
