MEMBERS PRESENT: Chairman Birdwell and Members Sawtelle, Rife, Poston, Hollas and Alternate Members Alexander and Blackwelder. MEMBERS ABSENT: Alternate Member Ochoa. STAFF PRESENT: Senior Planner Kuenzel, Staff Planner Dunn, Planning Technician Thomas, and Assistant City Attorney Shively. The Zoning Board of Adjustment met to discuss cases that include nonconforming lot characteristics. Attached is a memorandum from Senior Planner Kuenzel and Staff Planner Dunn dated December 7, 1995 that was presented to the Board concerning vacant nonconforming lots, expansion of a conforming building on a nonconforming lot and creation of a second principal structure on a conforming lot. This • memorandum is a part of the official minutes of this workshop meeting. The Board agreed that in cases of vacant nonconforming lots and expansion of a conforming building on a nonconforming lot (items 1 and 2 in the staff memorandum) should not need Board action and handled at staff level. There is no need to change the Zoning Ordinance with respect to these two cases; however, the current policy should change to not require official Board action for these two scenarios as long as it is clear that the nonconformity is not increased. For example, if the nonconformity is parking and the applicant is doing something that does not increase the parking, the case should be handled at staff level and not require a public hearing and Board action. The Board also agreed that in cases of creation of a second principal structure on a conforming lot as outlined in item 3 in the staff memorandum, should require Board actionx ~Fer-ea , ~ eat The Board agreed to do exactly what is stated in the attached staff memorandum dated December 7, 1995.
