Zoning Board of Adjustment

MEMBERS PRESENT: Chairperson Baker, Members Gaston, Sawtelle, De Otte and
Alternate Member Davis.
MEMBERS ABSENT: Member Birdwell and Alternate Members Phinney, De Loach
and Mc Kean.
STAFF PRESENT: Staff Planner Kuenzel and Planning Technician Thomas.
AGENDA ITEM NO. 1: Call to order -explanation of functions of the Board.
• Chairperson Baker called the meeting to order and explained the functions and limitations
of the Board.
AGENDA ITEM NO. 2: Approval of minutes from the meeting of July 21, 1992.
Mr. Sawtelle moved to approve the minutes from the meeting of July 21, 1992 as written.
Mr. Gaston seconded the motion which passed unopposed (5 - 0).
AGENDA ITEM NO. 3: Consideration of a rear setback variance request by Guy and
Elizabeth Pry to allow for an addition to the existing dwelling at 802 Hawthorn Street
Staff Planner Kuenzel presented the staff report for a rear setback variance request of 6'.
The applicants propose a 19' rear setback instead of the required 25'. The applicants argue
that the curve m the road has placed their buildable area back further. The aerial shows
that this house is not in alignment with the adjacent property to the south. In addition to
the argument on the application, the Board may consider the fact that the rear lot line of
this house abuts the side lot line of the adjoining lot. The house on that lot faces Thomas
and is located further to the south. The applicants feel that the inadequate size of the
dining area is a hardship. There is room available on either side of the home to expand.
The survey reflects a 15' side setback by deed restrictions; however, the City enforces 7.5'
side setbacks. Sixteen surrounding property owners were notified with two calls in favor of
the request and one inquiry.
Applicant Guy E. Pry approached the Board and was sworn in by Chairperson Baker. He
stated that his home was purchased in June of 1992 with plans to add on to the home.
There is no longer space on the north side because of the sanitary sewer line easement that
• was dedicated to the City in 1989 by the previous owner. The south side only allows for a
small addition that would be adjacent to a bedroom near the front of the house and not the
dining room. To use this space, a complete redesign of the residence would be required.

Mr. Gaston questioned staff as to the possibility of abandoning the rear alleyway.
Staff Planner Kuenzel stated that an abandonment request would have to be approved by
City Council in a public hearing and require a $250 application fee.
Mr. Gaston moved to authorize a variance from section 15, ordinance number 1638, to the
rear setback requirements from the terms of this ordinance as it will not be contrary to the
public interest due to the following special conditions: (1) an unused city alley right of way
provides additional space between houses; and (2) a city utility easement reduces the
buildable lot area; and because a strict enforcement of the provisions of the ordinance would
result in unnecessary hardship to this applicant being restricted buildable lot area prevents
expansion; and such that the spirit of this ordinance shall be observed and substantial justice
done subject to the following limitations: expansion is limited to plan resented in the public
hearing. Mr. De Otte seconded the motion which passed unopposed (p5 - 0).

Otte seconded the motion which passed unopposed (5 - 0).
