Call to Order - explanation of functions and

limitations of the Board.
Mr. Lane called the meeting to order and explained the functions and
limitations of the Board.
A~RNnA TTFM Nn. ~~ Consideration of a variance request to the front
setback requirements at 608 Pearce. Applicant is the City of College
Station, Community Development.
Staff Planner Kuenzel presented the staff report requesting a variance
to allow an addition to the living room and bedroom that would reduce
the front setback of the structure from 25 feet to 12 feet from the
front property line. Non-conformities of the lot include:
(1) the lot does not meet the minimum lot depth of 100 feet
required for an R-1 district;
(2) there is also a nonconforming accessory building in the
back yard that encroaches into the rear setback area;
and,
(3) the side setback of 7.5 feet is not met on the east
property line.

A special condition of the lot is that it does not 'meet the minimum
lot depth of 100 feet. This 85 foot lot would therefore only allow a
house 35 feet deep if all setbacks were met. In this particular
subdivision, Council waived the lot depth requirements, thence not
creating a non-conforming lot. The hardship of the applicant is that
the house provides inadequate and congested accommodations for a
family with eight members. There are no alternatives to the variance
request; no other location would comply with the setback requirements.
Twenty-eight property owners within 200 feet of the subject property
were notified with seven inquiries, one call in support of and one
call in opposition to the variance request.

• Housing Program Coordinator Randall Pitcock, approached the Board and
was sworn in by Chairman Henry. Mr. Pitcock informed the Board that
in order for the home owner to qualify for Community Development
financial aid, the home must meet particular housing quality standards
which would require the addition. If the addition to the bedroom and
living room was not possible, the City would be unable to assist the
property owner.
Ms. Yarbrough moved to authorize a variance from Section 15 Ordinance
16387 to the minimum setback (Table A) from the terms of this
ordinance as it will not be contrary to the public interest, due to
the following special conditions:
(1) the lot depth is only 85 feet;
(2) the non-conformities have been accepted by Council;
(3) there are several other non-conformities; and,
(4) the public response was favorable;
and because a strict enforcement of the provisions of the ordinance
would result in unnecessary hardship to this applicant being: no other
locations would apply, and such that the spirit of this ordinance
shall be observed and substantial justice done. Mr. Phinney seconded
the motion which passed unopposed (4 - 0).

• Staff Planner Kuenzel informed the Board that Al Roberts of Deux Chene
Apartments has requested that the Board reconsider his request for a
sign variance to allow a second free standing sign. He has changed
the location of the proposed sign and feels the relocation should be
considered by the Board.
Mr. DeOtte informed the Board that the applicant installed the sign
after the Board denied the. variance request and the applicant refused
to attend the two public meetings at which the variance was
considered. He suggested that the Board not schedule a meeting to
consider this single item. If the variance request is reconsidered,
it should be scheduled with at least one other item of consideration
on the agenda.

Adjustment. Mr. Phinney seconded the motion which passed (4 - 0).
