limitations of the Board.
Vice Chairperson Baker called the meeting to order and explained the
functions and limitations of the Board.

Mr. Lane moved to approve the minutes of the meeting on May 7, 1991 as
written. Mr. Cronan seconded the motion which passed unopposed (4-0).
(Mr. DeOtte arrived after the approval of the minutes.)
Ar;FxnA TTFM Nn_ ~~ Consideration of a variance request to the side
setback and to separation requirements at 1111 Neal Pickett.
Application is in the name of Pam Hensley.
Staff Planner Kuenzel presented the staff report requesting a variance
to allow the location of an accessory structure on the side of the
house. In November of 1981 at 1114 Neal Pickett, the ZBA approved a
request that allowed a carport 1 foot off of the side property line.
The applicants in that case had a creek that ran through their back
yard almost immediately behind the house. This variance request
included a Building Code violation that has been resolved because a
Structural Standard's Board variance was granted. The Building Code
requires a separation of 15 feet between buildings. The Board must
decide whether a drainage pattern that has developed through the
middle of the applicant's rear yard constitutes a special condition.
Alternatives are to locate the building in the rear yard to comply
with all setbacks or install a building less than 100 square feet.
Pam Hensley approached the Board and was sworn in by Vice Chairperson
Baker. She stated that her back yard was narrow with a drainage way
• across the center. Many of the yards in the neighborhood are slanted
and cause drainage congestion in many of the yards. The proposed
location for the temporary building is well screened by trees and
shrubs and will not be obtrusive from the street. She requested a
building of 160 square feet stating that anything less would not
accommodate her needs.
• Mr. DeOtte questioned staff as to broadening the special exceptions
section of the ordinance to include temporary structures instead of
having to grant a permanent variance. Since a variance runs with the
property, it could cause a problems in the future with objectional
uses encroaching into required setbacks.
Assistant City Attorney Coates informed the Board that the special
exceptions section could not be revised due to limitations of the
Board and regulations of state statues. However, the Board could
condition the variance so that the temporary building remains in one
particular location.
Mr. Gaston stated that he was familiar with the drainage problems in
this area and that it would not be in the public interest to place the
building in the existing drainage way and obstruct the flow.
Vegetation such as trees and grass should not be removed due to
erosion control. He agreed with the applicant that the proposed
location of the building was justified due to the special condition of
an existing drainage way. Mr. Gaston moved to authorize a variance
from Section 15 Ordinance 1638 to the side yard (Section 8.7) from the
terms of this ordinance as it will not be contrary to the public
interest, due to the following special conditions: provides for the
drainage of stormwater by not impeding the natural flow on the
property and because a strict enforcement of the provisions of the
ordinance would result in unnecessary hardship to this applicant
being: other locations of the building would cause flooding or tree
• removal and such that the spirit of this ordinance shall be observed
and substantial justice done subject to the following limitations:
limited to a temporary detached storage building only not to exceed
160 square feet. Mr. DeOtte seconded the motion which passed
unopposed (5-0).
