MEMBERS PRESENT: Acting Chairman Gilmore, Members Gentry, Thompson, Henry (came in late) and Alternate Member Garrett MEMBERS ABSENT: Chairman Ruesink, Alternate Member Baker and Council Liaison Birdwell STAFF PRESENT: Planning Assistant Johnson, Assistant City Attorney Banks and Planning Technician Volk AQBNDA I?B1~! N0. l: Call to order - explanation of functions and lisitations of the Board. Mr. Gilmore opened the meeting and explained the functions and limitations of the Board. A(iBNDA ITBM N0. 2: Apgroval of ninntes - aeeting of April 4, 1989. Mr. Thompson made a motion to approve the minutes as submitted. Mr. Gentry seconded • the motion which carried unanimously (4-0). AGBNDA ITBM NO. 3: Hear visitors. Mrs. Sonja Horvath of $09 Fairview mentioned a parking problem on Fairview during games when cars are allowed to park on both sides of this very narrow street. She stated it took her over 45 minutes to get home recently. Mr. Gilmore advised her that this Board does not handle street problems, but staff would refer her concerns to the Engineering division and the Assistant City Manager's office on Wednesday. AtiBNDA I?B!! N0. 4: Consideration of a request for a variance to the rear setback for the addition of a garage with living quarters on the second floor. Applicant/owner is Clair J. Nixon. Mrs. Johnson gave a brief staff report and slide presentation to re-acquaint the Board with the applicant, the specific site and the neighborhood in general, and reminded them they had heard this identical request in January of this year at which time they granted a variance to the side setback (1') and the rear setback (10'). She explained that when construction of the subject garage began, it became apparent to the applicant that the rear progerty line was not where he had believed previously, but much closer to the proposed garage, and thus he was informed that although the location of the garage will not change, the amount of the variance will, and he would have to appear before the Board again before he could get s building permit for the garage. {Mr. Henry arrived shortly after • Mrs. Johnson began her report.) Mr. Gilmore stated after there were no questions offered by the Board that since the i Board is already very familiar with this case, the applicant, and the reasons for the request, he would entertain a motion. Mr. Thompson made a motion to authorize a variance to the minimum setback from the terms of this ordinance as it will not be contrary to the public interest, due to the following special conditions: Vehicular access to the residence is required from the rear and other existing properties utilize the rear entrance concept with no other access to the parking area, and because a strict enforcement of the provisions of the ordinance would result in unnecessary hardship to this applicant being: inability to rebuild a garage which would better suit their needs, and such that the spirit of this ordinance shall be observed and substantial justice done subject to the following limitations: That the rear setback be reduced to 5' and the side setback be reduced to 1'. The motion was seconded by Mr. Henry and carried unanimously (5-0). At38NDA IlBM NO. 5: Other business. There was no other business. AaBNDA IlBM NO. 6: Adjourn.
