AN ORDINANCE MAKING CERTAIN AFFIRMATIVE FINDINGS AND VACATING
AND ABANDONING A 1,788 SQUARE FOOT PORTION OF A 20-FOOT WIDE PUBLIC
UTILITY EASEMENT, SAID PORTION LYING OVER, ACROSS AND UPON LOT 35,
BLOCK 4, OF WILLIAMS CREEK LAKE ESTATES SUBDIVISION PHASE 4,
ACCORDING TO THE PLAT RECORDED IN VOLUME 17508, PAGE 181 OF THE
OFFICIAL PUBLIC RECORDS OF BRAZOS COUNTY, TEXAS.
WHEREAS, the City of College Station, Texas, has received an application for the vacation and
abandonment of a 1,788 square foot portion of a 20-foot wide public utility easement, said portion
lying over, across and upon Lot 35, Block 4, of Williams Creek Lake Estates Subdivision Phase 4,
according to the plat recorded in Volume 17508, Page 181, of the Official Public Records of Brazos
County, Texas, as described in Exhibit "A", attached hereto (such portion hereinafter referred to
as the "Public Utility Easement"); and
WHEREAS, in order for the Public Utility Easement to be vacated and abandoned by the City
Council of the City of College Station, Texas, the City Council must make certain affirmative
findings; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That after opening and closing a public hearing, the City Council finds the
following pertaining to the vacating and abandoning of the Public Utility Easement
described in Exhibit "A" attached hereto and made a part of this ordinance for all
purposes.
1. Abandonment of the Public Utility Easement will not result in property that
does not have access to public roadways or utilities.
2. There is no public need or use for the Public Utility Easement.
3. There is no anticipated future public need or use for the Public Utility
Easement.
4. Abandonment of the Public Utility Easement will not impact access for all
public utilities to serve current and future customers.
PART 2: That the Public Utility Easement as described in Exhibit "A" be abandoned and
vacated by the City.

ABSTRACT 9, IN COLLEGE STATION, BRAZOS COUNTY, TEXAS, BEING OVER, ACROSS AND UPON LOT 35, BLOCK 4 OF WILLIAMS CREEK
LAKE ESTATES SUBDIVISION, PHASE 4, PLAT FILED IN VOLUME 17508, PAGE 181 OF THE OFFICIAL PUBLIC RECORDS OF BRAZOS COUNTY,
TEXAS (OPRBCT); SAID PORTION OF A 20' WIDE PUBLIC UTILITY EASEMENT BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS:
COMMENCING at a 1/2 inch iron rod with a blue plastic cap stamped "KERR SURVEYING" found in the southwest line of Williams Creek
Drive (100' wide right-of-way, 17508/181 OPRBCT) and being the east corner of Lot 36, Block 4, of said Williams Creek Lake Estates
Subdivision and also being the north corner of said Lot 35;
THENCE, with the common line of said Lot 35 and said Lot 36, 5 41° 41' 47" W, for a distance of 35.00 feet to the POINT OF BEGINNING
hereof;
THENCE, across said Lot 35 for the following two (3) courses and distances:
1) 5 47° 39' 36" E, for a distance of 10.00 feet to a point for corner, from which the City of College Station Monument C594-257
bears 5 57° 37' 41" E, a distance of 8,953.74 feet;
2) 5 41° 41' 47" W, for a distance of 178.70 feet to a point for corner;
3) N 48° 19' 35" W, for a distance of 10.00 feet to a point for corner on the common line of said Lot 36 and said Lot 35, from
which a 1/2 inch iron rod with a blue plastic cap stamped "KERR SURVEYING" found on the northeast line of Lot 34, Block 4
of Williams Creek Lake Estates, Phase 2A, plat filed in Volume 17169, Page 115 (OPRBCT), for the south corner of said Lot 36
and the west corner of said Lot 35 bears 5 41° 41' 47" W, a distance of 10.00 feet;
THENCE, with the common line of said Lot 36 and said Lot 35, N 41° 41' 47" E, for a distance of 178.82 feet to the POINT OF BEGINNING
hereof and containing 1,788 square feet, more or less.
Surveyed on the ground February 2024 under my supervision. See plat prepared February 2024 for other information. The bearing
basis for this survey is based on the Texas State Plane Coordinate System of 1983 (NAD83), Central Zone, Grid North as established
from GPS observation using the Leica Smartnet NAD83 (NA2011) Epoch 2010 Multi -year C0R5 Solution 2 (MYC52). Distances described
herein are grid distances. To obtain surface distances (not surface areas) multiply by a combined scale factor of 1.00009502113816
