City Hall Council Chambers MEMBERS PRESENT: Chairman Dan Sears, Vice Chairman George McLean, Commission Members Frank Cox, Mike Lane and Shawn Slocum MEMBERS ABSENT: None STAFF PRESENT: Building Official Lance Simms, Assistant City Attorney Angela Deluca, Action Center Representative Regina Kelley, and Staff Assistant Stacey Ann Smith AGENDA ITEM NO.1: Call meeting to order. Chairman, Dan Sears, called the meeting to order. AGENDA ITEM NO.2: Consideration, discussion and possible action of absence request from meeting. There were none. AGENDA ITEM NO.3: Hear visitors for items not on agenda. Dan Sears asked if anyone would like to speak on an item not on the agenda. No visitors chose to speak. Consideration, discussion and possible action to approve minutes from the Building & Standards Commission meeting from September 29, 2003. Shawn Slocum motioned to approve the minutes. AGENDA ITEM NO.4: George McLean seconded the motion. The motion passed unanimously. (5-0). 10f4 Building & Standards Commission October 27 2003 - Minutes AGENDA ITEM NO.5: Presentation, discussion, public hearing and possible action concerning a report by the Building Official concerning the condition of a mobile home located at 3209 Barron Gut-Off Road (Robert Stevenson League, tract 46, 9.5 acres, College Station, Texas). Dan Sears asked staff to brief the Commission. Lance Simms, Building Official, took the floor. Lance stated that the structure at 3209 Barron Cut-Off Road is a vacant manufactured home. He said that the structure appears to be structurally sound, however, the doors were open and some of the windows were broken. Lance showed pictures of the manufactured home to the Commission that indicated the current condition of the structure and the fact that it was not secured. Lance reviewed a list of code violations as listed in the staff report. Due to the conditions listed in the staff report, Lance recommended that the Commission declare the structure unsafe. Lance also recommended that the Commission order the owner to secure the structure against unauthorized entry within~Odays. The reasons for the recommendation were as follows: (1) The structureissubstanqard and unfit for human habitation and a hazard to the public health, safety and welfare; and (2) The structure is unoccupied and unsecured from urGluthorize9 entry to the extent that it could be entered or use by vagrants or other uninvited persons as a place of harborage or could be entered or used by children. Dan Sears opened the public hearing and asked if anyone would like to speak in favor of the request. No one came forward. Dan Sears asked if anyone would like to speak in opposition to the request. No one came forward. Dan Sears closed the public hearing and asked if anyone would like to make a motion. George McLean made a motion that the structure be declared unsafe and ordered the structure secured within 30 days. Shawn Slocum seconded the motion. The motion passed unanimously, (5-0) AGENDA ITEM NO.6: Presentation, discussion, public hearing and possible action concerning a report by the Building Official concerning the condition of a wood framed residential structure located at 3205 Barron Cut-Off Road (Robert Stevenson League, tract 46, 9.5 acres, College Station, Texas). Dan Sears asked staff to brief the Commission. 20f4 Building & Standards Commission October 27 2003 - Minutes Lance Simms, Building, Official, took the floor. Lance stated that this structure is located on the same tract as the manufactured home discussed on the previous agenda item. He stated that an inspection conducted on 11 September 2003 and the results on the inspection revealed that the wood-framed, single family structure is substandard and in violation of several provisions of the International Property Maintenance Code. Lance said that the structure is vacant and the doors and windows are damaged or missing, allowing public access. He stated that a title report on the property indicated that the property owners are John Wesley Lott and Ancie Lee Lott of College Station, Texas. Lance reviewed a list of code violations with the Commission. Lance went on to show pictures of the property indicating the condition of the structure. Lance stated that, under the terms of the ordinance, the structure was beyond repair and needed to be demolished. Due to the conditions outlined in the staff report, Lance recommended thatthe Commission declare the structure unsafe. Lance also recommended that the Commission order the owner to demolish the structure and remove all the debris within 30 days for the following reasons: (1 )The structure is substandard, structurally unsound and unfit for human habitation (2)The structure is a hazard to the public health, safety and welfare (3)The structure is unoccupied and unsecured from unauthorized entry to the extent that it could be entered or used by vagrants or other uninvited persons as a place of harborage or could be entered or used by children. Mike Lane made a motion that the structure be declared unsafe and ordered demolished within 30 days and all the debris removed. George McLean seconded the motion. The motion passed unanimously, (5-0) AGENDA ITEM NO.7: Consideration, discussion and possible action on future agenda items There were none.
