City Hall Council Chambers MEMBERS PRESENT: Chairman Dan Sears, Commission Members Frank Cox, Mike Lane, Shawn Slocum, Alternate Kevin Kuddes MEMBERS ABSENT: Vice Chairman George McLean STAFF PRESENT: Building Official Lance Simms, Assistant City Attorney Angela Deluca, Action Center Representative Regina Kelley, Fire Marshal Jon Mies and Staff Assistant Stacey Ann Smith AGENDA ITEM NO.1: Call meeting to order. Chairman, Dan Sears, called the meeting to order. Consideration, discussion and possible action of absence request from meeting. AGENDA ITEM NO.2: There were none. AGENDA ITEM NO.3: Hear visitors for items not on agenda. Dan Sears asked if anyone would like to speak on an item not on the agenda. No visitors chose to speak. AGENDA ITEM NO.4: Consideration, discussion and possible action to approve minutes from the Building & Standards Commission meeting from May 19, 2003. Frank Cox motioned to approve the minutes. Mike Lane seconded the motion. The motion passed unanimously. (5-0). 10f4 Building & Standards Commission September 29 2003 - Minutes AGENDA ITEM NO.5: Presentation, discussion, public hearing and possible action concerning a report by the Building Official concerning the condition of the structure located at 3019 Barron Cut-Off Road (Robert Stevenson League, tract 15, 1.4 acres, College Station, Texas). Dan Sears asked staff to brief the Commission. Lance Simms, Building Official, took the floor. Lance stated that the structure at 3019 Barron Cut-Off Road is substandard. He said a title report on the property indicates that the property owner is Wayland Terrell of Houston, Texas. The Brazos County tax appraisal office has the value of the structure listed as $830.00. Lance then showed the Commission pictures of the structure that indicated exterior and interior conditions of the structure. Lance then reviewed a list of violations of the International Property Maintenance Code that existed at the structure and reminded the Commission that that if the repairs can be made to the structure for 50% orless ofthe. value of the structure then repairs are deemed feasible and the Commission has the option to order repairs. to be made to the structure. He went on to state ifthe repairs cost more than 50% of the value of the structure then they are not deemed feasible and the Commission is obligated to order the structure be demolished. Lance then recommended that the Commission declare the structure unsafe. Furthermore, he recommended that the Commission order the owner to demolish the structure and remove all debris within 30 days. Dan Sears asked if anyone would like to speak in opposition to the request. Wayland Terrell, property Qwner, took the floor. Mr. Terrell stated that the structure was being used as a single family home until about 1990, after that it has been usedasa storage building. Mr. Terrell went on to say that he would like the Commission to give him as much time as possible to demolish the structure. He stated that he lived in Houston and would only be able to work on the structure duringweekends. Dan asked Lance if the. ordinance would allow the Commission to allow the. owner more than 90 daysto accomplish the work. Lance stated that the Commission could allow more that 90 days if the owner submits a detailed plan and time schedule and establishes that the work cannot be reasonably performe(j within 90 days because of the scope and complexity of the work. The Commission discussed this requirementand the consensus was that the that the work could reasonably be performed within 90 days. Dan Sears closed the public hearing and asked if anyone would like to make a motion. Frank Cox made a motion that the structure be declared unsafe. Mike Lane seconded the motion. The motion passed unanimously, (5-0) Mike Lane made a motion to allow 90 days to demolish the structure and remove all debris. Dan Sears asked staff to brief the Commission. Lance Simms, Building Official, took the floor. Lance showed the Commission pictures of the structure. Lance.stated that the structure was a wood framed house that was moved to the property but never connected to utilities. The pictures indicated that the structure has totally collapsed. Lance went on to say that he was contacted byan adjacent property owner who expressed interest in seeing the structure removed. Lance said that a title report on the property indicates that the property owners are Mamie Lee Peterson and Natalie Brown Barnett. He stated that the Brazos County tax appraisal office has the value of the structure listed as $0.00. Lance reminded the Gommission that the ordinance states that repairs are deemed feasible if the. cost of repair, reconstruction, or improvement of a structure equals less than fifty percent. (50%) of the market value of the structure. However, where fifty (50%) or more of the value of a structure is damaged ordeteriorated, it must be. ordered demolished or removed. The structure never had. any public utility connections. Lance recommended that the Commission declare the structure unsafe. Furthermore, he recommended that the Commission order the owner to demolish the structure and completely remove all debris within 30 days. Dan Sears opened the public hearing and asked if anyone would like to speak in opposition to the request. Marilyn K. Austin, the daughter to the owner of the structure, took the floor. Ms. Austin said the house was moved onto the property with plans to remodel it. Due to finances and the weather, she stated. that the work ceased. She also confirmed that the house had collapsed during this time. She said they intended to demolish it. Terry Austin took the. floor. He stated that it should take him 90 days or less to demolish the structure and haul off the debris. Dan Sears asked if anyone would like to speak in favor of the request. No one came forward. The Commission discussed the agenda item and asked questions. 30f4 Building & Standards Commission September 29 2003 - Minutes Dan Sears closed the public hearing and asked if anyone would like to make a motion. Frank Cox made a motion that the structure be declared unsafe. Mike Lane seconded the motion. The motion passed unanimously, (5-0) Frank Cox made a motion to allow 90 days to demolish the structure and clear the debris. Shawn Slocum seconded the motion. The motion passed unanimously, (5-0) AGENDA ITEM NO.7: Consideration, discussion and possible action on future agenda items There were none. AGENDA ITEM NO.8: Adjourn Mike Lane motioned to adjourn.
