ORDINANCE NO. 2861
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, PROPOSING AN AMENDMENT TO THE CITY CHARTER; CALLING AN
ELECTION ON SAID ISSUE; PROVIDING FOR PUBLIC NOTICE AND AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
WHEREAS, the City Council of the City of College Station hereby calls a special election to
allow the voters to determine whether the Charter should be changed as hereinafter
set out; and
WHEREAS, Section 9.004 of the Local Government code provides that a charter election shall
beheld not less than thirty (30) days after the passage of this Ordinance calling for
Charter Amendment; and
WHEREAS, Section 41.001(a) of the Election Code provides that the next earliest time for a
Charter election is the second Saturday in May (May 13, 2006); now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART I: That a special election is hereby ordered to be held within the jurisdiction of the
City of College Station, Texas, on the 13th day of May, 2006, pursuant to the laws
of the State of Texas and the Charter of the City of College Station, Texas. Said
election shall be held for the purpose of amending the College Station City
Charter,
PART 2: That said special election shall be held in conjunction with the regularly scheduled
City Council election on said same date.
PART 3: That the following proposed Charter change be submitted for vote on May 13,
2006:
PART 3(a): That a new Section 30, City Internal Auditor, of Article III, The City Council, of
the Charter of the City of College Station, Texas, be submitted for amendment,
and if approved by a majority vote, be changed to read as follows:
"City Internal Auditor
Section 30. The City Council may appoint an officer of the City to be the City
Internal Auditor, who may be removed from office by the Council. The City
Internal Auditor shall carry out the audit functions and shall perform such other
duties as the City Council shall assign to him. The City Council may also enter

into a contract for the duties of City Internal Auditor, to be carried out by an
outside firm, if it so chooses.
The City Internal Auditor shall have the power to appoint an assistant or
assistants, if deemed necessary by him, subject to the approval of and at such
compensation as may be fixed by the City Council and such assistant or assistants
may be removed from office by the City Internal Auditor."
PART 3(b): That the present Sections 30 to 132 of the City Charter, are hereby renumbered
respectively to 31 to 133, upon passage of this amendment by the voters.
PART 3(c): That said amendment be presented for "yes" or "no" vote in the following form:
Proposition No. I
"Shall the charter be amended to provide for the creation of a 'City Internal
Auditor'?"
PART 4:
That a copy of this ordinance shall be published in its entirety in the official
newspaper of the City of College Station, Texas.
PART 5:
That this ordinance shall take effect immediately from and after its date of final
passage.
PART 6:
That an election is hereby called on May 13,2006, on said aforementioned charter
amendment. If said City Charter amendment shall receive a majority of "yes"
votes, it shall be declared passed. Said amendment passing by a majority vote
shall be entered upon the records of the City of College Station and be declared by
the City Council to be adopted and shall be effective henceforth.
