CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS
August 23, 1999

AGENDA ITEM NO. 1: Call meeting to order
The meeting was called to order by Chairman Dan Sears
AGENDA ITEM NO.2: Hear visitors for items not on agenda
There were no visitors
AGENDA ITEM NO.3: Approve minutes from Construction Board of Adjustments and
Appeals Meeting on June 7, 1999.
George McLean motioned to approve the minutes, Robert Mooney seconded the motion,and The
Board concurred, (7-0).
AGENDA ITEM NO.4: Consider Variance request 99-005, to request modification to Section 504,
1994 Standard Mechanical Code.
Dan Sears asked for staff to explain the variance request

Lance Simms,Building Official, took the floor to explain the variance request to the board members.
He stated that the applicant,Marion Homes,applied for a building permit to construct a new 4,000 square
foot office/model home. During the plan review process it was noted that the plans called for a fully
operational"model kitchen"with a range and cook top. The applicant was notified that the mechanical
code requires a commercial hood and fire extinguishing system because the cooking equipment is in a
commercial building. The applicant is requesting a variance from this code requirement.
Lance read the staff report to the board members including the staff recommendation. Staff recommended
approval with the condition that a 40BC fire extinguisher be provided in the kitchen in a location approved
by the Fire Marshal. Lance told the board that the recommendation was made based on the fact that the
cook top is a residential appliance and the intended use does not include commercial cooking.Lance also
stated that this recommendation is consistent with previous variance requests involving residential
appliances in commercial settings.
Robert Mooney asked staff if this building would be sold and used as a home. Staff told Mr. Mooney that
the property zoning at the location of the building would not allow for single-family homes.The building is
located in a commercially zoned district.
Dan Sears opened the public hearing.
Larry Marion,the applicant, took the floor to speak in favor of granting the variance. He reiterated that
the building would only be a model home,however, his office would also be located in the building.
Dan Sears closed the public hearing.
Dan asked the board if they had a motion.
Glenn Thomas made a motion to grant the variance with the condition a 40BC fire extinguisher is
installed.
Frank Cox seconded the motion; the motion passed unanimously 7-0.
