AN ORDINANCE REZONING A 17.28 ACRE TRACT OF LAND SITUATED IN THE
ROBERT STEVENSON LEAGUE, ABSTRACT NO. 54, IN THE CITY OF COLLEGE
STATION, BRAZOS COUNTY, TEXAS, AND BEING A PORTION OF THE HORACE
SCHAFFER, ET AL 56.5 ACRE TRACT (400/7), FROM A-O AGRICULTURAL OPEN
TO R-1 SINGLE FAMILY RESIDENTIAL.
WHEREAS, on April 11, 1996, the City Council of the City of College Station convened
and, pursuant to notices prescribed by law, held a public hearing with regard to the
application for the rezoning of 50 acres of property situated in the Robert Stevenson
League, Abstract No. 54, ~n the City of College Station, Brazos County, Texas, and
more particularly described as follows:
Being all of that certain tram or parcel of land lying and being situated in the
Robert Stevenson League, College Station, Brazos County, Texas and being a
part of Tract (a) conveyed to Horace Schaffer and Clyde Schaffer, Trustee by
Fritz Schaffer et ux, recorded in Volume 400 page 7, Deed Records of Brazos
County, Texas and being described as follows:
BEGINNING: at a %" iron rod found at the most westerly common comer of the
remainder of said 77.00 acre tract and the Brazos County 0.48 acre tract
(810/820); same being in the southeast right-of-way line of Arnold Road;
THENCE: N 45°00'00" E - 945.31 feet along said Amold Road line to a %" iron
rod at the most westerly comer of the Bodley P. Thornton 12.1 acre tract
(1321/140);
THENCE: S 45°58'13.. E - 970.27 feet along the common line between said
77.00 acre tract and said Thornton tract and comer in the centeriine of a creek;
THENCE: along said Creek centedine for the following calls:
N 79°41'27" W - 206.44 feet,
S 49°35'48" W - 105.11 feet,
S 77°19'27" W - 139.69 feet,
S 58°11'54" W - 121.82 feet,
S 33°02'42" W- 138.93 feet,
S 16058'36" W - 167.55 feet and
S 5°37'07" W - 304.89 feet and comer in the northeast line of said
Brazos County tract;
THENCE: N 44°57'21" W - 36.39 feet, S 45°02'37.. W - 27.03 feet and N
44°57'21" W - 918.72 feet along said Brazos County tract to the PLACE OF
BEGINNING; and containing 17.28 acres of land, more or less.
WHEREAS, the above-described property is currently zoned A-O Agricultural Open,
and the current use is agricultural;
WHEREAS, the owner of the above-described property, Horace Schaffer, purchased
the property on September 20, 1994, by deed recorded in Volume 2224, Page 208 of
the Official Records of Brazos County, Texas;
WHEREAS, the owner has applied for the rezoning of the above-described property to
R-1 Single Family Residential;

WHEREAS, the City Council of the City of College Station heard evidence that the area
in which the above described tract is located is currently used for agriculture;
WHEREAS, the City Council of the City of College Station heard evidence that the
property situated immediately across Schaffer Road from the subject property has been
rezoned and developed for single-family residential use;
WHEREAS, the City Council of the City of College Station heard recommendations
from the Planning and Zoning Commission that the property be rezoned subject to the
following special conditions:
1. That the North-South collector be included at the time the property is
platted;
2. That the East-West collector be included at the time the property is
platted;
3.That there be a loop connection between Aster and Hasselt;
4. That landscape buffer be developed along the East side of the loop when
the two collectors are connected and choose to relocate the collector
system;
5. That an emergency access connection be developed to Schaffer from the
proposed subdivison; and
6. That the rear portion of the industrial site, to the West across Schaffer,
retain access to Schaffer.
WHEREAS, rezoning the subject tract of land into the aforementioned tract would allow
the owner to develop the property in such a way that it fills a need in the local real
property market; and
WHEREAS, the subject rezoning is consistent with the City's Comprehensive Plan for
development;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the 17.28 acre tract mentioned above is hereby
rezoned from A-O Agricultural-Open to R-1 Single Family Residential, effective imme-
diately.
