AN ORDINANCE REZONING A 2.25 ACRE TRACT OF LAND SITUATED IN THE
MORGAN RECTOR LEAGUE IN THE CITY OF COLLEGE STATION, BRAZOS COUNTY,
TEXAS A_ND BEING A PORTION OF THE 300 ACRE TRACT OF LAND DESCRIBED BY
DEED RECORDED IN VOLUME 394, PAGE 766 OF THE DEED RECORDS OF BRAZOS
COUNTY, TEXAS, FROM M-1 PLANNED INDUSTRIAL AND A-O AGRICULTURAL-
OPEN TO A.P. ADMINISTRATIVE-PROFESSIONAL
WHEREAS, on March 28, 1996, the City Council of the City of College Station convened and,
pursuant to notices prescribed by law, held a public hearing with regard to the application for the
rezoning of 2.25 acres of property situated the Morgan Rector League, in the City of College
Station, Brazos County, Texas, and more particularly described as follows:
TRACT ONE:
Being all that certain tract of land lying and being situated in the Morgan Rector
League in College Station, Brazos County, Texas, being a part of the 300 acre
tract described by deed recorded in Volume 394, Page 766 of the Deed Records of
Brazos County, Texas, and being more particularly described as follows:
BEGINNING: at an iron rod found at the northwest cut-off of State Highway 6
and Emerald Parkway as recorded in Volume 1162, Page 613.
THENCE: along the east right-of-way line of State Highway 6 N 1°54'09'' W
142.85 feet to a point for the northeast comer of the herein described tract.
THENCE: across the remaining portion of the 300 acres of land as recorded in
Volume 394, Page 766 of the deed records of Brazos County, Texas, the following
4 courses:
S 87°54'09" E 75.00'
S 78°54'09" E 198.00'
S 63°54'09'' E 150.00'
S 71°09'09" E 107.12'
THENCE: S 1°51'50" E to a point on the north right-of-way line of Emerald
Parkway on a curve a distance of 90.78 feet to the southeast comer of the herein
described tract.
THENCE: along a curve to the left on the north right-of-way line of Emerald
Parkway (R=1045.00') through a central angle of 4o38'38'' the chord which bears
N 82°46"21" W - 84.70' to an iron rod set at the end of said curve.
TI-IliNCE: along the north right-of-way line of Emerald Parkway N 85013'45" W
a distance of 131.03' to an iron rod found for a corner of the herein described tract.
THENCE: along the north right-of-way line of Emerald Parkway N 81°24'54'' W
a distance of 266.41 feet to an iron rod found for a comer of the herein described
tract.

THENCE: along the north right-of-way line of Emerald Parkway N 42°16'24'' W
a distance of 37.96' to the Point of Beginning and containing 1.708 acres of land
more or less.
TRACT TWO:
Being all that certain tract of land lying and being situated in the Morgan Rector
League in College Station, Brazes County, Texas, being a part of the 300 acre
tract by Deed Recorded in Volume 394, Page 766 of the Deed Records of Brazes
County, and being more particularly described as follows:
Beginning at an iron rod found at the most southerly comer of Lot 3 in Block One
of Emerald Forest Phase One Addition to the City of College Station, Texas,
according to plat record in Volume 422, Page 871 of the Deed Records of Brazes
County, Texas.
THENCE: along the north right-of-way line of Emerald Parkway a curve to the
right (R=1401.00') through a central angle of 10°01'19'' at a distance of 245.58
feet to an iron rod found at the end of said curve;
THENCE: along the north right-of-way line of Emerald Parkway N 79038'30'' W
a distance of 36.78' to an iron rod set at the beginning ora curve to the let~;
THENCE: along the north right-of-way line of Emerald Parkway a curve to the
let~, (R=1045.00') through a central angle of 5°56'58" - the chord of which bears N
79o58'33'' W - 17.32 feet to a point on said curve;
THENCE: N 1°51'50'' W a distance of 90.78 feet to a point, said point being an
angle point for the herein described tract.
THENCE: S 71009'09'' E a distance of 80.88 feet to a point, said point being an
angle point for the herein described tract.
THENCE: S 83056'22'' E a distance of 215.53' to a point on the west line of Lot
3, Block I of Emerald Forest Phase One Addition as recorded in Volume 422,
Page 871 of the Deed Records of Brazes County, Texas.
THENCE: along the west line of Lot 3, Block 1 of Emerald Forest Phase One
Addition as recorded in Volume 422, Page 871 of the Deed Records of Brazes
County, Texas, S 7°17'46'' E a distance of 74.94 feet to the Point of Beginning,
and containing a 23,535.7 square feet (0.540 acres) of land more or less.
WHEREAS, the above-described property is currently zoned A-O Agricultural Open and M-1
Planned Industrial and the current use is vacant;
WHEREAS, the owner of the above-described property, Haldec, Inc., purchased the property on
April 19, 1978, by deed recorded in Volume 394, Page 766 of the Official Records of Brazes
County, Texas;
WHEREAS, the owner has applied for the rezoning of the above-described property to A-P,
Administrative Professional;

WHEREAS, the City Council of the City of College Station heard evidence that the area in which
the above described tract is located is currently used as vacant land;
WHEREAS, the City Council of the City of College Station heard evidence that the previous
rezoning of this property and relocation of Emerald Parkway created a change from the original
zoning, creating smaller M-1 and A-O areas;
WHEREAS, rezoning the subject tracts of land in the aforementioned manner would allow the
owner to develop the property in such a way that it fills a need in the local real property marke{
and provides administrative and professional offices for College Station;
WHEREAS, the City Council of the City of College Station heard evidence that there are three
different zoning classifications on the subject tract due to gaps created from previous rezoning
and this proposed rezoning request will create one zoning classification (A-P) for the area
proposed for re-development; and
WHEREAS, the subject rezoning is consistent with the City's Comprehensive Plan for
development;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the 2.25 acre tract mentioned above is hereby rezoned from
A-O Agricultural-Open and M-1 Planned Industrial to A-P Administrative-Professional, effective
immediately.
