AN ORDINANCE REZONING A 1.69 ACRE TRACT OR PARCEL OF LAND ALSO
BEING PART OF LOT Al, SOUTHWOOD VALLEY SECTION 30, A SUBDIVISION
OF COLLEGE STATION, BRAZOS COUNTY, TEXAS, ACCORDING TO THE
REPLAT THEREOF DATED MAY 16, 1994, AND RECORDED IN VOLUME 2110,
PAGE 168, OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS, FROM
C-3 PLANNED COMMERCIAL TO C-1 GENERAL COMMERCIAL AND OV
CORRIDOR OVERLAY DISTRICT.
WHEREAS, on January 11, 1996, the City Council of the City of College Station
convened and, pursuant to notices proscribed by law, held a public hearing with regard to
the application for the rezoning of a 1.69 acre tract or parcel of land also being a part of
Lot Al, Southwood Valley Section 30, a subdivision of College Station, Brazos County,
Texas, according to the Replat of Tract A dated May 16, 1994 and recorded in Volume
2110, Page 168 of the Official Records of Brazos County, Texas, and being more
particularly described by metes and bounds as shown on Exhibit A, attached hereto;
WHEREAS. the above-described property is currently zoned C-3 Planned Commercial;
WHEREAS, the owners of the above-described property, Jeffrey L. McDowell and James
H. Woods, have applied for the rezoning of the above-described property to C-1 General
Commercial and OV Corridor Overlay District zoning;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence of the
ongoing residential development of this area;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence as to
the location of the property on the southeast comer of F.M. 2818 at its intersection with
Welsh Avenue;
WHEREAS, evidence was presented that the proposed use of the property as a
convenience store with a sit-down food service area will provide support facilities for the
nearby residential areas, both those residential areas currently in existence and those are
to be developed yet;
WHEREAS, evidence was presented that the proposed zoning change is in accordance
with the Comprehensive Plan;
WHEREAS, the City Council of the City of College Station, Texas, has concluded that
the development taking place in this area is a changed condition that makes the subject
properly more suited to General Commercial and Corridor Overlay zoning use;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION, TEXAS, that the above-described property is hereby rezoned
from C-3 Planned Commercial to C-1 General Commercial and OV Corridor Overlay
District, effective immediately.

Field Notes of a 1.69 acre tract or parcel of land also being a part of Lot Al,
Southwood Valley Section 30, as shown on the Replat of Tract A dated May 16, 1994
and filed in Volume 2110, Page 168, Official Records of Brazos County, Texas, and
being more particularly described by metes and bounds as follows:
BEGINNING: at a 1/2" diameter iron rod found marking the northwest comer of Lot A1
of the aforesaid Replat of Tract "A", Southwood Valley Section 30 and also marking the
intersection point of the northeast right-of-way line of Texas State Farm-to-Market Road
2818 (West By-Pass);
THENCE: N 56°59'10'' E - 272.25 feet along said F.M. 2818 R.O.W. line to a 1/2" iron
rod found for the most northerly common comer of Lot A1 and Lot A2 of the aforesaid
Replat of Tract "A";
THENCE: S 32°57'31'' E - 299.39 feet along the northeast common line of said Lot A1
and said Lot A2 to a 1/2" iron rod found for the most easterly common comer of Lot A1
and Lot A2; same being in the northwesterly R.O.W. line of an existing 28 foot-wide
access R.O.W.;
THENCE: S 68035'05" W - 257.46 feet along said R.O.W. line to a 1/2" iron rod found
for the beginning of a curve to the right;
THENCE: along said curve to the right for an arc distance of 34.23 feet to a 1/2" iron rod
marking the end of same curve to the right, same iron md also lying in the most easterly
right-of-my line of Welsh Avenue, central angle: 78°27'24", radius = 25.00 feet, tangent
= 20.41 feet and chord bears N 72°11'13" W - 31.62 feet;
THENCE: N 32°57'31" W - 223.11 feet along said Welsh Avenue R.O.W. line to the
PLACE OF BEGINNING; and containing 1.69 acres of land, more or less.
