AN ORDINANCE AMENDING ORDINANCE NO. 1638, THE ZONING
ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING
THE DEFINITION OF NIGHT CLUB CONTAINED IN SECTION 2 AND BY
SPECIFICALLY ADDING RESTAURANTS OF A MAXIMUM OF 1500 SQUARE
FEET WITHOUT DRIVE THRU FACILITIES TO THE LIST OF CONDITIONAL
USES CONTAINED IN SECTION 7.15.
WHEREAS, the C-3 zoning district is designed to provide locations for commercial sites
that are too small for many permitted uses in the General Commercial District, and
WHEREAS, the C-3 zoning district is designed for relatively low traffic generators that
would have little or no impact on adjacent areas and on adjacent thoroughfares, and
WHEREAS, small restaurants, those under 1500 square feet, without drive thrus do not
generate the traffic associated with larger restaurants or ones with drive-thrus and thus are
considered lower traffic generators, and
WHEREAS, The City Council of the City of College Station held a public hearing on
August 29, 1996, and determined to amend this section;
NOW, TttEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION:
That Section 2 of Ordinance No. 1638, the Zoning Ordinance of the City of College
Station, Texas, is hereby amended by amending the definition of "night club" to read as
follows:
"NIGHT CLUB: A commercial establishment including, but not limited to
bars, coffee houses or similar establishments where a dance floor, music,
games or other entertainment is provided and where the serving of food is
not the principal business. Specifically included in this classification are
establishments that derive 75% or more of their gross revenue from the on-
premise sale of alcoholic beverages. Sexually oriented commercial
enterprises as defined in the City of College Station Code of Ordinances,
Chapter 4 Section 17 are not included in this definition."
II.
That Section 7.15 DISTRICT C-3 PLANNED COMMERCIAL of Ordinance No. 1638,
the Zoning Ordinance of the City of College Station, Texas, is hereby amended to read as
follows:
"7.15 DISTRICT C-3 PLANNED COMMERCIAL
PURPOSE: This district is designed to provide locations for commercial sites that
are too small for many permitted uses in the General Commercial District. These

are moderately iow traffic generators that have little impact on adjacent areas and
on adjacent thoroughfares.
PERMITTED USES: All in A-P plus the following:
Alcoholic beverage sales - retail and wholesale
Car wash.
Cleaner/laundry.
Cold storase.
Garage, commercial.
Mini-storage warehouses.
Nursery/plant sales.
Radio and TV stations (no towers).
Rental - vehicles and equipment.
Repair shops.
Retail sales and service.
Shopping center.
Other uses may be permitted by the Commission.
SITE PLAN/LANDSCAPE REVIEW REQUIRED: Refer to Sections 10 and 11.
CONDITIONAL USES PERMITTED: The following conditional uses shall be
allowed in addition to any use allowed under Section $. 12:
Restaurants, at a maximum of 1500 square feet, without a drive-thru.
Funerai homes.
Large recycling collection facilities.
AREA REQUIREMENTS: Refer to Table A at the end of this section. Maximum
lot size 3 acres.
PARKING REQUIREMF-NTS: Refer to Section 9.
SIGN REGULATIONS: Refer to Section 12."

III.
This ordinance shall become effective from and aRer its passage in accordance with the
Charter of the City of College Station.
