AN ORDINANCE REZONING A 2.9 ACRE TRACT OF LAND LOCATED IN TI-~
CRAWFORD BURNETT LEAGUE, ABSTRACT NO. 7, BEING LOT 4, BLOCK 1 OF THE
MELROSE SUBDIVISION OF RECORD IN VOLUME 2970, PAGE 211 OF THE OFFICIAL
RECORDS OF BRAZOS COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
The following tract of land is rezoned as described:
A 2.973 acre tract described by metes and bounds in "Exhibit A" and shown graphically
in "Exhibit B" also known as lot 4, block 1 of the Melrose Subdivision filed in volume
2970, page 211 of the Official Records of Brazos County, Texas. Said tract is rezoned
from R-5 Medium Density Apartments to PDD-B Planned Development District -
Business. The Development Plan approved as part of the PDD-B zoning district is
described in "Exhibit C" and shown in concept in "Exhibit D".
A notice of the time and place, where and when said ordinance would be given a public hearing
and considered for final passage, was published in The Eagle, a daily newspaper of general
circulation in the Cities of Bryan and College Station, said publication being on Wednesday,
February 25, 1998, the same being at least fifteen (15) days prior to a public hearing to be held in
the Council Room of the City Hall in College Station, Texas, at 7:00 p.m., on Thursday, March
12, 1998, to permit the public to be heard prior to final consideration ofthis ordinance.

ABSTRACT NO. 7 SITUATED IN THE CITY OF COLLEGE STATION, BRAZOS
COUNTY, TEXAS, BEING ALL OF LOT 4, BLOCK 1 MELROSE SUBDIVISION, A
SUBDIVISION OF RECORD IN VOLUME 2970, PAGE 211 OF THE OFFICIAL
RECORDS OF BRAZOS COUNTY, TEXAS; SAID 2.973 ACRES BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING at a 1/2 inch iron rod set at the intersection of the
dedicated westerly line of Jones-Butler Road (R.O.W varies) with
the dedicated southerly line of Luther Street (R.O.W. varies) as
shown on said Melrose Subdivision Plat for the northeasterly
corner of said Lot 4;
T~w~NCE, S43°02'27"E, along the dedicated westerly line of Jones-
Butler Road, same being the easterly line of said Lot 4 a distance
of 370.66 to a 1/2 inch iron rod set for the southeasterly corner
of said Lot 4, same being an easterly corner of Lot 3, Block i of
said Melrose Subdivision;
Tw~NCE, leaving the westerly line of Jones-Butler Road, in part
with a northerly line and a easterly line of said Lot 3, same being
southerly and westerly lines hereof, the following two (2) courses
and distances:
1)
S44°18'00"W, a distance of 349.79 feet to a 1/2 inch iron rod
set for the southwesterly corner hereof;
2)
N43°02'27"W, a distance of 370.66 feet to a 1/2 inch iron rod
set in the dedicated southerly line of Luther Street for the
northwesterly corner hereof;
THENCE, N44°18'00"E, along the dedicated southerly line of Luther
Street same being the northerly line hereof, a distance of 349.79 --
feet to the POINT OF BEGINNING, containing an area of 2.973 acres
(129,514 sq. ft.) of land, more or less, within .these metes and
bounds.

The following is a list of elements included in the Development Plan for Lot 4, Block 1 of the
Melrose Subdivision totaling approximately 2.9 acres. These elements were approved as part of
the rezoning request to PDD-B Planned Development District - Business.
Melrose Planned Development District
Statement of Purpose and Intent
This planned development district is designed for a light commercial site that will serve the needs
of the residential uses in the immediate area. This particular development does not fit easily
within any existing zoning district except the C-I district, which has potential negative impacts on
the area. The establishment of PDD zoning on this property ties the land owner and developer to
buffering concepts using barriers and buildings oriented away from adjacent residential uses as
shown in the conceptual plan that is attached as Exhibit "D". Approval of the conceptual plan
does not constitute approval of any other site elements and a subsequent final site plan must meet
all development requirements. The development plan further restricts existing and future land
uses exclusively to the following:
· All A-P uses
· General retail and service
· Dry cleaners with on-site cleaning facilities
· Restaurant and drive-through eating establishment
· Convenience store
· Arcade
· Gasoline and service station with car wash
This PDD assures neighboring properties that the uses as listed above will not vary from what is
approved, without further public hearing and action by the Planning & Zoning Commission and
City Council.

Dear Mr. Jaffar:
On March 12, 1998, the City Council rezoned the above referenced property from R-5
Apartment/Medium Density to PDD-B Planned Development District - Business (Ordinance
No. 2315). Since that time, the City of College Station has not received any applications for
the development of this land until your request for a rezoning from PDD-B to R-5 was
received on August 21, 2002. In regards to PDD rezonings, Section 7.25.M of the Zoning
Ordinance states:
The Concept Plan shall expire and the zoning shall revert to the previous zoning
classification that existed on the affected properties prior to the PDD rezoning if further
development action has not been apparent within 24 months of the effective date of the
PDD Ordinance.
As there have been no submittals to the City to further the development of the land in over
53 months, the land has reverted back to previous zoning of R-5, in accordance with
Section 7.25.M of the Zoning Ordinance. The zoning for the subject property will be
updated on the official Zoning Map.
