HomeMy WebLinkAbout1999-2367 - Ordinance - 01/14/1999ORDINANCE NO. 2 3 6 7 AN ORDINANCE REZONING A PARCEL OF LAND TOTALING 93.5 ACRES LOCATED IN THE ROBERT STEVENSON LEAGUE, ABSTRACT NO. 54, KNOWN AS THE ALEXANDRIA SUBDIVISION, IN COLLEGE STATION, BRAZOS COUNTY, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That the City of College Station Zoning Ordinance //1638, more specifically the Official Zoning Map, be amended as set out in Exhibits "A", "B' and "C" attached hereto and made a part of this ordinance for all purposes. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 3: That any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two Thousand Dollars ($2000.00). PART 4: A notice of the time and place, where and when said ordinance would be given a public hearing and considered for final passage, was published in The Eagle, a daily newspaper of general circulation in the Cities of Bryan and College Station, said publication being on Wednesday, December 30, 1998, the same being at least fifteen (15) days prior to a public heating to be held in the Council Room of the City Hall in College Station, Texas, at 7:00 p.m., on Thursday, January 14, 1999, to permit the public to be heard prior to final consideration of this ordinance. PAGE 2 OF 5 EXHIBIT "A" That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance #1638, is hereby amended as follows: The subject 93.543 acre tract described by metes and bounds in the attached Exhibit "B" and shown graphically in Exhibit "C" is rezoned from A-O Agricultural Open to R-1 Single Family Residential. ORDINANCE NO. 2367 PAGE 3 OF 5 EXHIBIT "B" FIELD NOTES 93.543 ACRE TRACT Being all that certain tract or parcel of land lying and being situated in the ROBERT STEVENSON SDRVEY, A-54 in College Station, Brazos County, Texas and being a portion of the 93.543 acre tract conveyed to Edward Froehling by deed dated June 16, 1998 and recorded in Volume 3162, Page 199 of the Official Records of Brazos County, Texas (O.R.B.C.) and also being a portion of the 3.89 acre tract conveyed to Lance R. Leschper, et ux by deed recorded in Volume 1589, Page 73 (O.R.B.C.) and being more particularly described by metes and bounds as follows: BEGINNING: at a found iron rod in concrete marking the east corner of this tract, the south corner ofSpringbrook - Oakgrove Subdivision as recorded in Volume 1833, Page 33 of the Official Records of Brazos County (O.R.B.C.) and being in the northx~est margin cfa pubhc road, commonly known as Ban'on Road; THENCE: S 44° 05' 53" W along said line of Barron Road for a distance of 585.70 feet to a found l/2-inch iron rod at a fence comer for comer, said iron rod also marking the east corner of the said 3.89 acre Lance R. Leschper et ux tract; THENCE: S 44° 07' 16" W continuing along said Barron Road line for a distance of 191.46 feet to a I/-inch iron rod set for comer; THENCE: 162.49 feet into the interior of said Leschper tract along the arc cfa curve having a central angle of 09° 35' 53", a radius of 970.00 feet, a tangent of 81.44 feet and a long chord bearing N 49° 41' 05~ W at a distance of 162.30 feet to a i/2-inch iron rod set for the Point of Tangency; THENCE: N 54° 29' 02" W for a distance of 138.81 feet to a I/2-inch iron rod set for the Point of Curvature cfa curve to the right; THENCE: 18.77 feet along the arc of said curve having a central angle of 01 o 02' 39", a radius of 1030.00 feet, a tangent of 9.39 feet and a long chord bearing N 53° 57' 43" W at a distance of 18.77 feet to a l/2-inch iron rod set for comer; THENCE: S 44° 39' I I" W, at 339.38 feet pass a l/2-inch iron rod set in the southwest line of the beforementioned Lesehper 3.89 acre tract and continue for a total distance of 674.16 feet to a 1/2-inch iron rod set for comer; THENCE: S 45° 20' 49" E for a distance of 318.68 feet to a l/2-inch iron rod set in the said Barton Road right-of- way; THENCE: 1) along the fenced northwest line of said Barton Road for the following three (3) calls: S 44° 53' 17" W for a distance of 30.68 feet to a set l/2-inch iron rod, 2) S 45° 27' 22" W for a distance of 369.64 feet to a set l/2-inch iron rod and 3) S 45° 55' 57" W for a distance of 151.21 feet to a set l/2-inch iron rod at a cross-tie fence comer for comer, said iron rod also marking the east comer of the 39.229 acre Lick Creek Farm and Ranch, Inc. tract described in Volume 2904, Page 145 (O.R.B.C.); THENCE: N 44° 53' 22" W approximately along a fence marking the common line of this tract and the said 39.229 acre tract for a distance of 2101.37 feet (adjoiner call N 44° 28' 56" W - 2101.40') to a found i/2-inch iron pipe at a cross-tie fence corner for corner, said iron pipe also marking the north comer of the 39.229 acre tract and being in the southeast line ofthe 49.026 acre College Station Independent School District tract described in Volume 2774, Page 269 (O.R.B.C.); THENCE: N 45° 16' 33" E approximately along a fence marking the line between the said 49.026 acre school tract and this tract for a distance of 720.95 feet (adjoiner call S 44° 18' 18" W - 720.83') to a found l/2-inch iron pipe near a cross-tie fence comer for comer, said iron pipe marking the common corner of the said school tract and the 68.442 acre Lisa M. Neelley tract described in Volume 2999, Page 319 (O.R.B.C.), a found l/2-inch iron rod of unknown origin bears N 42° 20' 46" E at a distance of ! .01 feet; THENCE: N 45° 03' 16" E for a distance of 1029.43 feet (called N 45° 06' 34" E - 1029.30') approximately along a fence marking the line between the said 68.442 acre tract and this tract to an 8-inch diameter fence post; ORDINANCE NO. 2367 PAGE 4 OF 5 EXHIBIT mmBl' (CONT.) FIELD NOTES 93.543 ACRE TRACT PAGE 2 THENCE: N 44° 34' 14" E continuing along said fence for a distance of 296.58 feet (called N 44° 36' 31" E - 296.78') to a found 3/8-inch iron rod at a fence corner for corner, said iron rod also marking the west corner ofthe Peyton Waller 22.796 acre tract described in Volume 327, Page 90 (B.C.D.R.); THENCE: S 45° 14' 21" E for a distance of 423.66 feet (called S 44° 28' E - 423.82') along the fenced common line of the said Waller tract and this tract to a found 5/8-inch iron rod for corner, said iron rod being the south corner of the Waller tract and the west corner of the I 1.254 acre Springbrook- Common Area described in Volume 2387, Page 241 (O.R.B.C.); THENCE: S 45° 19' 06" E along said Common Area line for a distance of 539.00 feet to a fence pos', for corner; THENCE: S 44° l 1' 17" E, at 118.75 feet a found l/2-inch iron rod marks the west corner ofthe beforementioned Springbrook - Oakgrove Subdivision, continuing along said course for a total distance of I 124.25 feet to the POINT OF BEGINNING and containing 93.543 Acres of land, more or less.
