AN ORDINANCE AMENDING CHAPTER 7, "HEALTH AND SANITATION", OF THE
CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY
AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A
SEVERABILITY CLAUSE; AND DECLARING A PENALTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That Chapter 7, "Health and Sanitation", of the Code of Ordinances of the City of
College Station, Texas, be amended as set out in Exhibit "A", attached hereto and
made a part of this ordinance for all purposes.
PART 2: That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 3: That any person, firm, or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than
Five Hundred Dollars ($500.00). Each day such violation shah continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective ten (10) days nt~er its publication in the
newspaper, as provided by Section 35 of the Charter of the City of College
Station.

EXHIBIT "A"
That Chapter 7, Section 4, is hereby amended by deleting the current paragraph "F" regarding the
penalty as the penalty is contained in Chapter l, Section 5, and shall be punishable by a fine from
Twenty-five Dollars ($25.00) to Five Hundred Dollars ($500.00), as provided by this Code of
Ordinances, and by amending paragraph "F" to read as follows:
"F. POSSESSION OF GLASS IN AREA WHERE PROHIBITED
It shall be unlawful for any person in the City of College Station,
Texas, on any right-of-way or street, sidewalk or pedestrian-way in
the Northgate Area, as defined below, to possess any glass
beverage container.

NORTHGATE AREA: That area bounded by and included
within University Drive to the south; South College Avenue
to the east; the City of Bryan to the north; and Wellborn
Road to the west. This specifically includes the four
boundary streets and their intersections with each other.
(ii)
EXEMPTIONS: Notwithstanding any other provision of
this section, nothing in this section shall prohibit the
possession of, including but not limited to, the following
glass containers in the Northgate Area:
Baby bottles containing products for
consumption by babies.
This section shall not prohibit possession of glass containers in
motor vehicles, buildings not owned or controlled by the City of
College Station, residential structures, or inside premises located in
the Northgate Area."
